The plaintiff is Citibank (South Dakota) N,A., with place of business located at 701 EAST 60th STREET NORTH, SIOUX FALLS, SD, 2. The defendant is LORI M HEVl\:'ER, who resides at 8 VILLAGE ROAD, MECHANICSBURG, CUMBERLAND County, Pennsylvania, 3. At the defendant's request, plaintiff issued the defendant a credit card with account number 5424180443183444 for the defendant's use in making credit purchases and securing cash advances subject to the terms and conditions governing the use of the credit card. Attached hereto, made a part hereof and marked Exhibit A is a true and correct copy of the terms and conditions, 4. The defendant accepted the credit card and the terms and conditions governing its use for the purchase of goods, merchandise and services and/or cash advances from vendors who accepted plaintiffs credit card. In using the credit card, the defendant agreed to comply with the terms and conditions governing its use which included the obligation to pay plaintiff for all the charges made in full upon receipt of the statement or in installments subject to monthly fmance charges, 5. The defendant utilized the credit card by making/obtaining purchases of goods, merchandise and services and/or cash advances from vendors who accepted the credit card. Monthly statements were sent to the defendant which detailed the charges made to the account including finance charges, late and/or over limit charges. The balance due for the charges made by the defendant including any finance charges, late or over limit charges is $8,243,70, 6. Defendant did not pay the balance due in full upon receipt of the billing statements and failed to make the required minimum monthly payment set forth in the the billing statement, As such, defendant is in default of the terms and conditions governing the use of the credit card. 7, Although demand has been made by plaintiff upon defendant to pay the sum of $8,243,70, the defendant failed and refused to pay all or any part thereof. 8. Plaintiff alleges it is entitled to recovery of attorney's fees from defendant pursuant to the terms and conditions governing the account. Plaintiffs counsel is not a salaried employee ofCitibank (South Dakota) N.A. Plaintiff seeks recovery of attorney fees in the sum of$I,566.30. WHEREFORE, plaintiff demands judgment against the defendant in the sum of $8,243,70, attorneys fees in the sum of $1,566.30 and the costs of this action. Defendant filed an answer which closed the pleadings. The record before the court consists of the pleadings and the affidavit of plaintiffs counsel. The pleadings in this action are closed. The matter is before the Court on plaintiffs motion for summary judgment under Pa. R.c.P. 1035.2. Defendant's answer acknowledged her liability to plaintiff. The answer explained the she ran into financial difficulty and as a result was not able to pay. Defendant's averments of financial hardship while affecting and stirring one's empathy, do not rise to the level of a defense to plaintiff s action. See Luber v. Luber, 418 Pa. Super. 542 (Pa. Super. Ct., 1992); Felix v. Giuseppe Kitchens & Baths. Inc., 2004 P A Super 120, A.2d 943 (2004); Levev v. Cogen Sklar LLP, 63 Pa. D. & C.4th 543 (Phila., 2003). Plaintiffs motion includes the affidavit of its counsel which reflects the contractual basis for plaintiffs attorneys fees, their calculation and reasonableness. This record makes clear that the Court should grant plaintiffs motion. Pursuant to Pa. R.C.P.I 035.2, plaintiff is still entitled to judgment as a matter oflaw as there are no genuine, material factual issues. Defendant's answer failed to deny any of the complaint's averments or submit any facts to contradict them. Pursuant toPa.R.C.P. 1029(b), the allegations of the complaint were admitted. This is not a harsh result because defendant admitted "she contracted for the debt alleged." The complaint seeks recovery of attorney's fees. The terms and conditions governing the use of the credit card are set forth in Exhibit A to the complaint. Included in the terms is a contractual provision allowing for attorney's fees. Plaintiffs complaint included a claim for attorney's fees. Fees should be granted because of this agreement. See Fidelity-Philadelphia Trust Companv v. Philadelphia Transportation Company, 404 Pa. 541, 173 A. 2d 109 (1961); Chatham Communications, Inc. v. General Press Corporation, 463 Pa. 292, 344 A.2d 837,842 (1975). Even though fees are permitted, it is recognized that it is for this Court to determine whether amount sought as attorney's fees is reasonable. The reasonableness of an award of attorneys fees, of course, is a matter which rests within the sound discretion of the trial judge and will be altered by an appellate court only when there is a clear abuse of discretion [citation omitted). The trial court, in the first instance, is in the best position to evaluate the character of the services rendered, the time necessarily involved and to assess the reasonableness of the fee in light of the usual scale of compensation given the time and place of the litigation [citation omitted). Wrenfield Home Owners' Association v. DeYoung, 410 Pa. Super. 621, 600 A.2d 960, 964 (1991) Because of the answer's admissions, defendant cannot be heard to contradict the complaint's averments. The admissions are binding. See JeweIcor Jewelers & Distributors v. Corr, 373 Pa. Super 536 (1988). This is a clear case. Plaintiff submits there is ample basis in the record before the Court for the entry of summary judgment against the defendant and for plaintiff as a matter of law.
