Complaint
1. The plaintiff is Citibank (South Dakota) N,A., with place of business located at
701 EAST 60th STREET NORTH, SIOUX FALLS, SD,
2. The defendant is LORI M HEVl\:'ER, who resides at 8 VILLAGE ROAD,
MECHANICSBURG, CUMBERLAND County, Pennsylvania,
3. At the defendant's request, plaintiff issued the defendant a credit card with account
number 5424180443183444 for the defendant's use in making credit purchases and securing cash
advances subject to the terms and conditions governing the use of the credit card. Attached hereto,
made a part hereof and marked Exhibit A is a true and correct copy of the terms and conditions,
4. The defendant accepted the credit card and the terms and conditions governing its
use for the purchase of goods, merchandise and services and/or cash advances from vendors
who accepted plaintiffs credit card. In using the credit card, the defendant agreed to comply
with the terms and conditions governing its use which included the obligation to pay plaintiff
for all the charges made in full upon receipt of the statement or in installments subject to monthly
fmance charges,
5. The defendant utilized the credit card by making/obtaining purchases of goods,
merchandise and services and/or cash advances from vendors who accepted the credit card.
Monthly statements were sent to the defendant which detailed the charges made to the account
including finance charges, late and/or over limit charges. The balance due for the charges made
by the defendant including any finance charges, late or over limit charges is $8,243,70,
6. Defendant did not pay the balance due in full upon receipt of the billing statements
and failed to make the required minimum monthly payment set forth in the the billing statement, As
such, defendant is in default of the terms and conditions governing the use of the credit card.
7, Although demand has been made by plaintiff upon defendant to pay the sum of $8,243,70,
the defendant failed and refused to pay all or any part thereof.
8. Plaintiff alleges it is entitled to recovery of attorney's fees from defendant pursuant
to the terms and conditions governing the account. Plaintiffs counsel is not a salaried employee
ofCitibank (South Dakota) N.A. Plaintiff seeks recovery of attorney fees in the sum of$I,566.30.
WHEREFORE, plaintiff demands judgment against the defendant in the sum of $8,243,70,
attorneys fees in the sum of $1,566.30 and the costs of this action.

ANSWER AND NOTICE OF INTENTION TO DEFEND
Defendant Lori Hevner answers the Complaint of Citibank (South
Dakota) N.A. as follows:
1. The Defendant contracted for the debt alleged.
2. Defendant has been unable to pay the debt for the following
reasons:
Defendant and her fianc6 are in debt for over $47,954,50.
Defendant has held onto a college debt for over 10 years now just
barely paying the minimum. Her fianc6's father suffered from an illness:
and as a result, the fianc6 switched jobs to handle his father'sl
business, causing an income drop of 30%. As a result of the
aforementioned circumstances, Defendant ca.nnot meet the minimum
payments on her credit cards, much less make any headway on the
principal balance because of interest rates,. late payments and over
limit charges,
3. Defendant did not and does not wish to file bankruptcy, as
suggested to her, but instead she wishes to pay her debts. Defendant
simply needs more time in which to settle her current debts,
4. Defendant has engaged the services of the National Consumer
Council (NCC), a non-profit consumer advocate institution, and
Financial Rescue Services, an affiliate of NCe, in order to resolve his
debt problem. Defendant is therefore, asking for more time and for the
Plaintiff to work with the Defendant and Financial Rescue Services.
Financial Rescue Services has made numerous calls to Plaintiff with no
response,
5. Defendant offers to restructure pclyments on the debt which
Defendant can afford.
6. Defendant is willing to make payment arrangements with the
Plaintiff.
WHEREFORE, Defendant begs this Court fox' the following:
1.That Judgment is found for Defendant; or in the
alternative
2.That Plaintiff ~s ordered to work with Defendant and
Financial Rescue Services ~n a S.lncere manner to
resolve this debt;
3.That no additional interest by awarded to Plaintiff;

Plaintiff, Citibank (South Dakota) N.A., by its counsel, Burton Neil & Associates, P.C.,
hereby moves the Court for summary judgment pursuant to Pa R.C. P. 1035.2 against defendant
Lori M. Hevner and in support avers as follows:
I. Plaintiff filed a complaint against defendant to recover the balance owed on a credit card
issued to defendant plus attorney's fees. A copy is attached hereto as Exhibit "A".
2. Defendant filed an answer which closed the pleadings. A copy is attached hereto as
Exhibit "B".
3. Defendant's answer is simply a narration of financial difficulty and defendant's
enrollment in a debt management program.
4. Defendant's aforesaid answer is completely unresponsive to any of the averments of
plaintiffs complaint, fails to deny any complaint averment specifically or by necessary implication
and should therefore be deemed an admission of the entire complaint.
5. Attached as Exhibit "C" is plaintiffs counsel's affidavit pertaining to attorney's fees.
6. The record shows the following material facts are undisputed thereby constituting grounds
for the entry of summary judgment:
a. Plaintiff issued a credit card to defendant with account no. 5424180443183444.
b. Plaintiff mailed the credit card to defendant with the terms and conditions
governing their use, that is, the credit card agreement.
c. Defendant received the credit card and the terms and conditions.
d. Defendant used the credit card and accepted the terms and conditions.
e. Plaintiff sent defendant montWy billing statements for the account which detailed
the charges made to the account including finance charges, late and/or over limit
charges.
f. Defendant failed to make a minimum monthly payment or the balance in full.
g. Defendant contracted for the debt.
h. Defendant was not able to pay due to financial reasons.
I. The balance due as ofthe filing ofthe complaint was $8,243.70.
J. Plaintiff is entitled to attorneys fees pursuant to the terms and conditions of the
account in the sum of$I,566.30.
k. The law firm of Burton Neil & Associates, P.c. and its attorneys are not salaried
employees of Citibank (South Dakota) N.A.
8. Subsequent to the filing of the lawsuit, defendant's account was credited with $0.08.
WHEREFORE, plaintiff Citibank (South Dakota), N.A. moves the Court enter summary
judgment for it and against defendant Lori M. Hevner under Pa.R.C.P. 1035.2 for the sum of
$8,243.62 plus attorneys fees of $1 ,566.30 for a total judgment of $9,809.92 plus the costs of this
action.

6. Defendant did not pay the balance due in full upon receipt of the billing statements
and failed to make the required minimum monthly payment set forth in the the billing statement. As
such, defendant is in default of the terms and conditions governing the use of the credit card.
7. Although demand has been made by plaintiff upon defendant to pay the sum of$8,243.70,
the defendant failed and refused to pay all or any part thereof.
8. Plaintiff alleges it is entitled to recovery of attorney's fees from defendant pursuant
to the terms and conditions governing the account. Plaintiff's counsel is not a salaried employee
ofCitibank (South Dakota) N.A. Plaintiff seeks recovery of attorney fees in the sum of$I,566.30.
WHEREFORE, plaintiff demands judgment against the defendant in the sum of $8,243.70,
attorneys fees in the sum of$1,566.30 and the costs of this action.

ANSWER AND NOTICE OF IN'l.'ENTION TO DEFEND
Defendant Lori Hevner answers the Complaint of Citibank (South
Dakota) N.A. as follows:
1. The Defendant contracted for the debt alleged.
2. Defendant has been unable to pay the debt for the following
reasons:
Defendant and her fiance are in debt for over $47,954.50.
Defendant has held onto a college debt for over 10 years now just
barely paying the minimum. Her fiance's father suffered from an illness:
and as a result, the fiance switched jobs to handle his father's'
business, causing an income drop of 30%. As a result of the
aforementioned circu:mstances, Defendant cannot meet the minimum
payments on her credit cards, much less make any headway on the
principal balance because of interest rates, late payments and over
limit charges~
3. Defendant did not and does not wish to file bankruptcy, as
suggested to her, but instead she wishes to pay her debts. Defendant
simply needs more time in which to settle her current debts.
4~ Defendant has engaged the services of the National Consumer
Council (NeC), a non-profit consumer advocate institution, and
Financial Rescue Services, an affiliate of NCC, in order to resolve his
debt problem. Defendant is therefore, asking for more time and for the
Plaintiff to work with the Defendant and Financial Rescue Services.
Financial Rescue Services has made numerous calls to Plaintiff with no
response.
5. Defendant offers to restructure payments on the debt which
Defendant can afford.
6. Defendant is Willing to make payment arrangements with the
Plaintiff.
WHEREFORE, Defendant begs this Court for the following:
I.That Judgment is found for Defendant; or in the
alternative
2.That Plaintiff is ordered to work with Defendant and

Plaintiff's Memorandnm of Law in Support of Motion for Summary Judgment
Plaintiff sued defendant to recover the past due balance owed it on a credit card. Defendant
filed an answer which closed the pleadings. The record before the court consists of the pleadings and
the affidavit of plaintiffs counsel. The pleadings in this action are closed. The matter is before the
Court on plaintiffs motion for summary judgment under Pa. R.c.P. 1035.2.
Defendant's answer acknowledged her liability to plaintiff. The answer explained the she ran
into financial difficulty and as a result was not able to pay. Defendant's averments of financial
hardship while affecting and stirring one's empathy, do not rise to the level of a defense to plaintiff s
action. See Luber v. Luber, 418 Pa. Super. 542 (Pa. Super. Ct., 1992); Felix v. Giuseppe Kitchens
& Baths. Inc., 2004 P A Super 120, A.2d 943 (2004); Levev v. Cogen Sklar LLP, 63 Pa. D. & C.4th
543 (Phila., 2003).
Plaintiffs motion includes the affidavit of its counsel which reflects the contractual basis for
plaintiffs attorneys fees, their calculation and reasonableness. This record makes clear that the Court
should grant plaintiffs motion.
Pursuant to Pa. R.C.P.I 035.2, plaintiff is still entitled to judgment as a matter oflaw as there
are no genuine, material factual issues. Defendant's answer failed to deny any of the complaint's
averments or submit any facts to contradict them. Pursuant toPa.R.C.P. 1029(b), the allegations of
the complaint were admitted. This is not a harsh result because defendant admitted "she contracted
for the debt alleged."
The complaint seeks recovery of attorney's fees. The terms and conditions governing the use
of the credit card are set forth in Exhibit A to the complaint. Included in the terms is a contractual
provision allowing for attorney's fees. Plaintiffs complaint included a claim for attorney's fees. Fees
should be granted because of this agreement. See Fidelity-Philadelphia Trust Companv v.
Philadelphia Transportation Company, 404 Pa. 541, 173 A. 2d 109 (1961); Chatham
Communications, Inc. v. General Press Corporation, 463 Pa. 292, 344 A.2d 837,842 (1975). Even
though fees are permitted, it is recognized that it is for this Court to determine whether amount
sought as attorney's fees is reasonable.
The reasonableness of an award of attorneys fees, of course, is a
matter which rests within the sound discretion of the trial judge and
will be altered by an appellate court only when there is a clear abuse
of discretion [citation omitted). The trial court, in the first instance,
is in the best position to evaluate the character of the services
rendered, the time necessarily involved and to assess the
reasonableness of the fee in light of the usual scale of compensation
given the time and place of the litigation [citation omitted). Wrenfield
Home Owners' Association v. DeYoung, 410 Pa. Super. 621, 600
A.2d 960, 964 (1991)
Because of the answer's admissions, defendant cannot be heard to contradict the complaint's
averments. The admissions are binding. See JeweIcor Jewelers & Distributors v. Corr, 373 Pa. Super
536 (1988).
This is a clear case. Plaintiff submits there is ample basis in the record before the Court for
the entry of summary judgment against the defendant and for plaintiff as a matter of law. For the
reasons set forth above, plaintiff submits summary judgment should be entered under Pa.R.C.P.
1035.2 in its favor and against defendant for the sum set forth in complaint less credit of $.08 as
noted in the motion and attorney's fees of$I,566.30.
