Sensenderfer by and through their Pollock, Esq. to request that this court open this matter entered on September 7, 2000 mentioned below. Sollenberger and attorney, Daniel the judgement in for the reasons 1. The Defendants were allegedly sued by the Plaintiff for an alleged deficiency left the plaintiff due to the plaintiff repossessing a vehicle that the Defendants purchased from the plaintiff. 2. The Defendants Were never served notice by the district court as to the hearing in this matter. 3. On September 7, judgement against the costs. 2000 the Plaintiff received a default defendant for $6,822.16 plus interest and 4. On October 31, 2000 the plaintiff through its attorney filed a writ of execution against the defendants' personal belongings. 5. Until the Defendants were served this writ of execution by the Cumberland County Sheriff's office the Defendants had no knowledge of the Complaint, or the judgement. 6. The entry of a default judgement requires that the defendant had an opportunity to notice of hearing and the opportunity to be heard. 7. The Defendants through no fault of their own did not have notice to the hearing or an opportunity to be heard. 8. The Defendants can offer a defense of breach of contract against the plaintiff and rescinded the contract as their remedy. Wherefore the Defendants Pray that the Judgement be opened and stricken, the writ of execution be quashed and a hearing be scheduled where the defendants may defend against this claim and . -~ l: this matter be heard on its merits.
