STIPULATION AGAINST LIENS
THIS AGREEMENT made the ) S" day of October, 2000, by and between TIM MARTIN
tJdIb/a l\lild J BUILDERS, hereinafter referred to as Contractor, and LA VON R. WEAVER and
JANE N. WEAVER, hereinafter referred to as Owner, whereby the former undertook and agreed to
erect and construct a custom built home on that certain lot of ground situate at 682 Walnut Bottom
Road, Shippensburg, Cumberland County, Pennsylvania, more fully described in Exhibit "A"
attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: Thatthe said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant.

shown as Lot 2 on the Subdivision Plan for Abram G. Seavers, prepared by John R. Kissinger dated
June 25,1997, revised July 29,1997, and recorded among the land records of Cumberland County
Plan Book 75, Page 54, bounded and described as follows:
BEGINNING at a point within the right-of-way of Walnut Bottom Road (Pa. 174), being a railroad
spike located at the Northen common comer of Lot I and Lot 2 shown on the Subdivision Plan for
Abram G. Seavers, prepared by John Kissinger dated June 25, 1997, revised July 29,1997; thence
62 degrees 47 minutes 47 seconds East 89.19 feet to a point; thence North 73 degrees 17 minutes
47 seconds East 112.16 feet to a set railroad spike; thence South 25 degrees 27 minutes 51 seconds
East 333.53 feet to a set iron pin; thence following along a curve with a radius of7,669.50 feet, an
arc length of200.57 feet, a chord bearing of South 60 degrees 14 minutes 02 seconds West, and a
chord length of200.57 feet to a set iron pin; thence North 25 degrees 27 minutes 51 seconds West
362.95 feet to a set railroad spike, being the place of BEGINNING.
CONTAINING 1.62 acres ofland more or less.
