STIPULATION AGAINST LIENS
WHEREAS, RS. Mowery & Sons. Inc., with offices at 625 Hamilton Street. Carlisle. Pennsylvania, hereinafter
called "contractor", entered into a contract with Manufacturers and Traders Trust Company, located at 100
Frederic,k Street, Hanover, Pennsylvania, 17331 , hereinafter called "Owner", to provide materials and perform
labor necessary for the construction of a new branch bank facility located at 6475 Carlisle Pike, Silver Spring
Township, PA, Contract No. 99111-A, dated N"~..,,,b r r 2... ,2000 - General Construction in the County
of Cumqerland and Commonwealth of Pennsylvania, being identified as Condominium Unit #4 of Shadow
Oaks CQndominium, a Pennsylvania Flexible Condominium created pursuant to the Declaration recorded on
Januaryl9, 1998in Cumberland County Record Book 566, page 119, which Unit #4 is a part of the premises
that Shapow Oaks Associates, a Pennsylvania general partnership, acquired by its deed dated 12/13189 and
recorded 12/18/89 in the Recorder of Deeds Office in and for Cumberland County, Pennsylvania, in Deed
Book 1-34, page 153 and its deed dated 4/12/91 and recorded 4/17/91 in Deed Book B-35, page 111.
Thereaft~r Shadow Oaks Associates leased Unit #4 to Keystone Financial Bank, N.A., now Manufacturers
and Traders Trust Company, herein designated as "Owner" by a lease dated 1/14100, as amended (see
Exhibit "A").
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
Contract and for the consideration therein set forth, that neither the undersigned Contractor, any
Subcontractor or material supplier, nor any other person furnishing labor or materials to the said Contractor
under this Contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished
to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary in accordance with the
, requirements of Section 1402 of the Mechanics Lien Law of 1963 of the Commonwealth of Pennsylvania in
such case provided.

presents to be executed by their proper corporate officers, and their respective corporate seals hereunto
