STIPllLATION AGAINST LIENS
TIIIS AGREBNENT made the ~hr of Oc-~/'....
2000, by and between JIM MUMPER BUILDER, contractor,
AmI
DONALD T. GILLIGAN and LINDA S. GILLIGAN, husband and wife,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a single family dwelling on
that certain lot of ground situate in
Silver Spring Township, Cumberland County, Pennsylvania, more
particularly described in attached Exhibit "A", also referred
to as Lot #23, 2 Manassas Court, Mechanicsburg, Pennsylvania.
NOW TBBREPORE, TKIS AGREEMEN'r WITNESSETK: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to JIM MUMPER BUILDER in hand paid by Owner, the receipt whereof
is hereby aCknOWledged, and the further consideration mentioned
in the agreement aforesaid, fOr themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no meohanic's liens or olaims shall be
filed Or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account Of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

Spring Township, Cumberland County, Pennsylvania, bounded and
described as follows, to wit, '
BEGINNING at a point at the intersection of the eastern
right-of-way line of Harpers Ferry way and the southern
right-of-way line of a fifty (50') foot existing public
right-of-way; Thence along the southern line of said existing
public right-of-way, North B7 degrees 10 minutes 35 seconds
East a distance of B7.02 feet to a point on the western line of
land nlf Cumberland Valley School bistrict; Thence along the
western line of said school district land, South 29 degrees, 49
minutes 25 seconds East a distance of 241.70 feet to a point at
the northernmost corner of Lot No. 22 on the hereinafter
described Final Subdivision Plan; Thence along the northern
line of said Lot No. 22 South 60 degrees 10 minutes 33 seconds
West a distance of 31.92 feet to a point at the northern
right-of-way line of the cul-de-sac of Manassas Court; Thence
along the northern right-of-way line of the cul-de-sac of
Manassas Court by a curve to the left having a radius of 95.00
feet, an arc length of 179.96 feet to a point; Thence
continuing along the northern right-of-way line of the
cul-de-sac of Manassas Court by a curve to the right having a
radius of 60.00 feet, an arc length of 61.97 feet to a point;
Thence continuing along the northeastern right-of-way line of
the intersection of Manassas Court and Harpers Ferry Way by a
curve to the right having a radius of 20.00 feet, an arc length
Of 32.14 feet to a point on the eastern right-of-way line of
Harpers Ferry Way; Thence along the eastern right-of-way line
of Ha,rpers Ferry Way, North 12 degrees 53 minutes 05 seconds
East a distance Of 205.53 feet southern right-of-way line of a
fifty (50') foot existing public right-of-way, the point and
place of BEGINNING.

2000, recorded in the Office of the Recorder of Deeds of

UNDER AND SUBJECT to the Second Amendment and Supplement to
Declaration of Covenants and Restrictions applicable to
Hillside Farms, dated June 29, 2000, recorded in the Office of
the Recorder of Deeds of Cumberland County, in Misc. Book 648,
Page 702. pursuant to whiCh the Declaration of Covenants and
Restrictions applicable to Hillside Farms, dated August 30,
1996 recorded in the Office of the Recorder of Deeds of
Cumberland County, in Misc. BOOK 529, Page 333, and the Bylaws
of Hillside Farms Homeowners' Association, Inc. dated August
30, ~996, recorded in the Office of the Recorder of Deeds of
Cumberland County in Misc. Book 529, Page 354, were made
applicable to the real estate within the above referenced Final
Subdivision Plan.
