MUNICIPAL LIEN DOCKET 2000 -7,Py/ Ml-,O MUNICIPAL CLAIM MUNICIPAL CLAIM FOR TOWNSHIP WASTE AND RECYCLABLES COLLECTION SERVICES AND RATES AND NOW, comes North Middleton Township, of 2051 Spring Road, Carlisle, Pennsylvania, by and through its Township Manager, Deborah A. Steffee, and files the following municipal claim against Marcus D. Johnson and Cora L. Johnson, husband and wife, as adult individuals, owning property located at 1120 Rebecca Street, Carlisle, North Middleton Township, Cumberland County, Pennsylvania, their last known mailing address being: 1120 Rebecca Street, Carlisle, Pa. 17013. Marcus D. Johnson and Cora L. Johnson husband and wife, are the owners of all that certain lot of ground, including any improvements located thereon, being more fully described as follows: ALL THOSE TWO (2) certain lots of ground situate in North Middleton Township, Cumberland County, Pennsylvania, bounded and described in accordance with Plan of Lots known as Marriot Acres recorded in the hereinafter names Recorder's office in plan Book No.2, Page 105, as follows: BEGINNING at a point on the southern line of 50 foot wide Rebecca Avenue on the northern line of Lot No. 112, which point at the Place of Beginning is 100 feet East of the eastern line of 50 foot wide Marbeth Avenue at the dividing line between Lots Nos. 112; thence from said point at the Place of Beginning along the southern line of said 50 foot wide Rebecca Avenue eastwardly, a distance of 105.5 feet to a point in line of land now or formerly of Clyde Brenner; thence along the western line of said land now or formerly of Clyde Brenner, southwardly a distance of 150 feet at the northeastern corner of Lot No. 108; thence along the dividing line between said Lot No. 108 and Lots Nox. 110 and 111, westwardly a distance of 105.5 feet, more or less, to a point at the southeastern comer of Lot No. 112; thence by the dividing line between Lots Noc. 111 ans 112, northwardly a distance of 150 feet to a point on the southern line of 50 feet wide Rebecca Avenue at the Place of BEGINNING. The above described tract of land contains 105.5 feet in front along the southern line of 50 foot wide Rebecca Avenue and extends southwardly therefrom at an even width a distance of 150 feet, and is all of Lots Nos. 110 and 111 as shown on said Plan of Marriot Acres, dated November 1934 and recorded in Plan Book 2 at Page 105.. The above described tract of land is subject to the following building and use restrictions originally imposed by deed dated June 9, 1941 and recorded July 5, 1941, in Deed Book "J", Volume 12, Page 334, as follows: BEING the same premises which Terry T. Albright and Betty A. Albright, husband and wife, by Deed dated October 31, 1995, and recorded in the Cumberland County Recorder if Deeds Office, in Deed Book "130", Page 505, granted and conveyed unto Marcus D. Johnson and Cora L. Johnson, husband and wife, Owners. Tax Property Map Parcel Number: 29-18-1367-062 North Middleton Township hereby files this municipal claim for municipal waste and recyclables collection services and rates levied and assessed from August 5, 1997 through an including September 30, 2000 (third calendar quarter 1997 through and including third calendar quarter 2000). Said Township municipal waste and recyclables collection services and rates were levied and assessed pursuant to Township Ordinance No. 97-6, same being known and cited as the "North Middleton Township Solid Waste and Recycling Ordinance of 1997", as amended by Township Ordinance No. 99-5. Attached hereto and incorporated herein are the statements forwarded by North Middleton Township to Marcus D. Johnson and Cora L. Johnson, husband and wife, for municipal waste and recyclable collection services from August 5, 1997 through and including September 30, 2000 (Third calendar quarter 1997 through and including third calendar quarter 2000, which services total in the amount of $ 446.91, which sum was duly assessed against Marcus D. Johnson and Cora L. Johnson, husband and wife, and the real property described herein from the date of said billing statements as attached hereto, ad for which sum, with interest in the amount of ten (10%) percent, along with penalties as provided in the within referred to Township ordinances and all costs, including attorney's fees, a municipal claim is claimed against the above-described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq.
