MUNICIPAL CLAIM FOR TOWNSHIP WASTE AND RECYCLABLES
COLLECTION SERVICES AND RATES
AND NOW, comes North Middleton Township, of 2051 Spring Road, Carlisle,
Pennsylvania, by and through its Township Manager, Deborah A Steffee, and files the following
municipal claim against David E. Miller and Bette J. Miner, husband and wife, as adult
individuals, owning property located at 1950 Waggoners Gap Road, Carlisle, North
Middleton Township, Cumberland County, Pennsylvania, their last known mailing address
being: 1950 Waggoners Gap Road, Carlisle, Pa. 17013. David E. Miller and Bette J. Miller,
husband and wife, are the owners of all that certain lot of ground, including any improvements
located thereon, being more fully described as follows:
ALL that certain tract ofland situate in North Middleton Township, Cumberland County,
Pennsylvania, bounded and described in accordance with Final Subdivision Plan for John
O. Brownawell prepared by Timothy Carl Wakefield, Registered Surveyor, as revised
September 15, 1982, a copy of which is recorded in the hereinafter named Recorder's
Office in Plan Book 42, page 72, and incorporated herein by reference, as follows:
BEGINNING at an iron pin on the southwestern legal right-of-way line ofL. R. 21032,
Pennsylvania Route 71, known as Waggoner's Gap Road, at the dividing line between
Lots # 1 and # 2; thence along said legal right-of-way line by a curve to the right having a
radius of925.37 feet an arc distance of 47.30 feet to a point; thence South 54 degrees 15
minutes 16 seconds West, a distance of5,OO feet to a point; thence by a curve to the right
having a radius of920.37 feet, an arc distance of 49,57 feet to a point at comer ofland
now or formerly of James B. BeicWer; thence along line of said land now or formerly of
James B, BeicWer, South 20 degrees 59 minutes 37 seconds West, a distance of 79.60 feet
to a stone; thence along line ofland now or formerly of Kathryn K. Dick, South 21
degrees 43 minutes 39 seconds West, a distance of651.24 feet to an iron pin at comer

common to said land now or formerly of Kathryn K. Dick, land now or formerly of Robert
M. Wickard and land now or formerly of Gerald D, Reggi; thence along line of said land
now or formerly of Gerald D. Reggi, North 68 degrees 52 minutes 00 seconds West, a
distance of 442.95 feet to an iron pin at the dividing line between said Lots # 1 and # 2;
thence along said dividing line between said Lots # 1 and # 2, North 29 degrees 40
minutes 00 seconds East a distance of 577.43 feet to a pin; thence still along said dividing
line between said Lots # 1 and # 2, North 85 degrees 30 minutes 42 seconds East, a
distance of 254.44 feet to an iron pin; thence still along said dividing line between said
Lots # 1 and # 2 , North 50 degrees 02 minutes 00 seconds East, a distance of 119.72 feet
to an iron pin on the southwestern right-of-way line of said Waggoner's Gap Rpad at the
Place of BEGINNING.
THE ABOVE described tract ofland contains 6.102 acres and is all of Lot # 2 as shown
on said Final Subdivision Plan for John 0, Brownawell recorded as aforesaid, on which
there is erected a one-story frame dwelling house and other improvements known as and
numbered 1950 Waggoner's Gap Road.
BEING the same premises which John O. Brownawell and Jane A. Brownawell, husband
and wife, by Deed dated May 21, 1991, and recorded in the Cumberland County Recorder
of Deeds Office in Deed Book "COO, Volume 35, Page 1198, granted and conveyed
unto David E. Miller and Bette J. Miller, Owners.

North Middleton Township hereby files this municipal claim for municipal waste and
recyclab1es collection services and rates levied and assessed from August 5, 1997 through an
including September 30, 2000 (third calendar quarter 1997 through and including third calendar
quarter 2000), Said Township municipal waste and recyclab1es collection services and rates were
levied and assessed pursuant to Township Ordinance No. 97-6, same being known and cited as
the "North Middleton Township Solid Waste and Recycling Ordinance of 1997", as amended by
Township Ordinance No. 99-5. Attached hereto and incorporated herein are the statements
forwarded by North Middleton Township to David E. Miller and Bette J. Miller, husband and
wife, for municipal waste and recyclable collection services from August 5, 1997 through and
including September 30,2000 (Third calendar quarter 1997 through and including third calendar
quarter 2000, which services total in the amount of$ 432.58, which sum was duly assessed
against David E. Miller and Bette J. Miller, husband and wife, and the real property described
herein from the date of said billing statements as attached hereto, ad for which sum, with interest
in the amount of ten

and all costs, including attorney's fees, a municipal claim is claimed against the above-described
real property and premises in accordance with the Act of May 16, 1923, P.L. 207,97, as
amended, 53 P,S. 97101, et seq, As amended (Municipal Claims and Tax Liens).
