WHEREAS, Rita Hudson of Cumberland County, Pennsylvania (herein "Owner")
is about to execute contemporaneously herewith, a contract, with Bryant Minnich of
Cumberland County, Pennsylvania (herein "Contractor"), for the construction work on a
building upon 8 Middle Road, Newville, Cumberland County, Pennsylvania, more
particularly set forth on Exhibit "A" attached hereto and made a part hereof.
NOW, April 3, 2003, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by said Owner to the said
Contractor to commence work on the said building, or purchase materials for the same
in consideration of the making of the said contract with Owner and the further
consideration of One ($1.00) Dollar in hand paid to Contractor by Owner it is agreed
that no lien shall be filed against the building by the Contractor, or any sub-contractor,
nor by any of the material-men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.

SCHEDULE C
ALL THAT CERTAIN tract of land situate in Upper Mifflin
Township, Cumberland County, Pennsylvania, bounded and described in
accordance with a Subdivision Plan for Samuel L. and Katie S. Fisher by
Stephen G. Fisher, Professional Land Surveyor, dated August 4, 1989, revised
August 30, 1989, and recorded in Cumberland County Plan Book 59, Page 8, as
follows:
BEGINNING at an existing iron pin on the eastern line of a 50 foot
private right-of-way as recorded in Plan Book 56, Page 141, and being further
described as the northwest corner of Lot 3 as recorded in Plan Book 54, Page
130; thence by the eastern line of said 50 foot wide private right-of-way, North 10
degrees 26 minutes 50 seconds East 319.90 feet to an iron pin set; thence by lot
addition "A", North 88 degrees 00 minutes 00 seconds East 471.81 feet to an iron
pin set on line of lands now or formedy of Samuel D. Shenk; thence by said lands
now or formerly of Samuel D. Shenk, South 2 degrees 00 minutes 00 seconds
East 638.47 feet to an existing pin; thence by Lots 5, 4 and 3 as recorded in Plan
Book 54, Page 130, North 60 degrees 54 minutes 35 seconds West 631.47 feet
to an existing iron pin, the Place of Beginning.
TOGETHER with a right-of-way to the Grantees, their heirs,
successors and assigns, over said 50 foot wide private right-of-way as shown on
said Plan from the above described lot to Middle Road (T-402) for the purpose of
ingress, egress, and regress over said private right-of-way all as shown on said
Plan. By acceptance of this deed, Grantees agree to equally share in the
maintenance of said 50 foot private right-of-way with the owners of Lot 6, Lot 8
and Lot A as set forth on said Plan.
UNDER AND SUBJECT to the following Building and Use
Restrictions which the Grantees, by acceptance of this Deed, expressly agree to
be bound:
1. This lot shall be used for residential purposes only, which
purpose shall include home occupations.
No trailer, mobile home or doublewide-mobile home may be
located on any lot, temporarily or permanently, for any use
whatsoever.
3. The minimum square footage for any dwelling to be erected on
said lot shall be 1500 square feet, including garage area.
4. No unlicensed or junk vehicles shall be stored on the demised
premises.
5. No livestock or farm animals, with the exception of two homes
and one steer, shall be kept or raised on the demised premises.
These restrictions shall be binding on and confined to Lots 7, 8
and Lot Addition "A" on the aforementioned Plan of Lots
recorded in Cumberland County Plan Book 59, Page 8.
BEING the same premises which Douglas James Kuhn and Amy Kuhn,
husband and wife, by their deed dated May 31, 2002 and recorded June 6, 2002
in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Deed Book 252, Page 240, granted and conveyed unto Rita
Hudson, single woman, in fee.
