The police who hiwe jurisdiction over the plaintiff's residence OR any location

shall enforce this order. An arrest for violation of Paragraph 1 of this order may
be without warrant, based soley on probable cause, whether or not the violation
is committed in the presence of the police. 23 Pa.C.S. g6113.
Subsequent to arrest, the police officer shall seize all weapons used or
threatened to be used during the violation of the protection order or during prior
incidents of abuse. The shall maintain possession of the weapons until further
order of this Court.
When the defendant is placed under arrest for violation of this order, the

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
Jonathan R. Birbeck, Chief Deputy District Attorney of Cumberland County,
Pennsylvania, brings the following Petition for a hearing on charges ofIndirect Criminal
Contempt:
I. A Protection from Abuse Order was issued by the Court. A true and correct
copy ofthe Order is attached.
2. The" defendant's violation of this Order is averred in the attached criminal

complaint.. ,
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonwealth is requesting a hearing on the charges of Indirect
Criminal Contempt pursuant to 23 Pa.C.S.A. S 6113.
6. The plaintiff and/or the defendant may seek modification of the Order based
on the filing of this petition as the Court deems appropriate foIlowing the trial
in addition to any other sentence. 23 Pa.C.S.A. S 6113.
WHEREFORE, the Commonwealth requests the defendant be commanded to
appear before the Court on the charge ofIndirect Criminal Contempt.

Pennsylvania, brings the following Petition for a hearing on charges ofIndirect Criminal
Contempt:
I. A Protection from Abuse Order was issued by the Court. A true and correct
copy of the Order is attached.
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing ofthis criminal complaint.
5. The Commonwealth is requesting a hearing on the charges of Indirect
Criminal Contempt pursuant to 23 Pa.C.S.A. 9 6113.
6. The plaintiff and/or the defendant may seek modification of the Order based
on the filing ofthis petition as the Court deems appropriate following the trial
in addition to any other sentence. 23 Pa.C.S.A. S 6113.
WHEREFORE, the Commonwealth requests the defendant be commanded to
appear before the Court on the charge of Indirect Criminal Contempt.

Jonathan R. Birbeck, Chief Deputy District Attorney of Cumberland County,
Pennsylvania, brings the following Petition for a hearing on charges of Indirect Criminal
Contempt:
I. A Protection from Abuse Order was issued by the Court. A true and correct
copy of the Order is attached.
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonwealth is requesting a hearing on the charges of Indirect
Criminal Contempt pursuant to 23 Pa.C.S.A. ~ 6113.
6. The plaintiff and/or the defendant may seek modification of the Order based
on the filing of this petition as the Court deems appropriate following the trial
in addition to any other sentence. 23 Pa.C.S.A. ~ 6113.
WHEREFORE, the Commonwealth requests the defendant be commanded to
appear before the Court on the charge of Indirect Criminal Contempt.

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
Jonathan R. Birbeck, Chief Deputy District Attorney of Cumberland County,
Pennsylvania, brings the following Petition for a hearing on charges of Indirect Criminal
Contempt:
1. A Protection from Abuse Order was issued by the Court. A true and correct
copy of the Order is attached.
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonwealth is requesting a hearing on the charges of Indirect
Criminal Contempt pursuant to 23 Pa.C.S.A. ~ 6113.
6. The plaintiff and/or the defendant may seek modification of the Order based
on the filing of this petition as the Court deems appropriate following the trial
in addition to any other sentence. 23 Pa.C.s.A. ~ 6113.
WHEREFORE, the Commonwealth requests the defendant be commanded to
appear before the Court on the charge of Indirect Criminal Contempt.

AND NOW, comes the Defendant, Mark Alan Bailey, by and through his attorney,
Timothy L. Clawges, Esquire, Deputy Public Defender, and moves this Honorable Court to issue
a Rule to Show Cause on Allen McGill, 1415 Market Street, Harrisburg, Pennsylvania, 17103, as
to why he should not be held in contempt for failure to appear at a hearing on Tuesday,
November 21, 2000 and/or why security should not be ordered to insure his appearance at any
future hearing, and in support thereof avers as follows:
1. On or about November 7, 2000, this Court scheduled a hearing to determine
whether Defendant, Mark Alan Bailey, should be found in indirect criminal contempt for
violation of a Protection From Abuse Order.
2. Through investigation, counsel for Defendant ascertained that Allen McGill might
have exculpatory information regarding the alleged PF A violation.
3. On November 17,2000, a subpoena compelling the attendance of Allen McGill at
a hearing on Tuesday, November 21, 2000, at 11:00 o'clock a.m. was personally served on
McGilL A copy of the Subpoena indicating personal service is attached hereto as Exhibit A.

4. McGill failed to appear at the hearing on November 21,2000.
5. Defendant Bailey anticipates that a further hearing regarding the alleged violation
of a PF A Order will be scheduled.
6. Defendant Bailey believes that McGill has exculpatory information regarding the
alleged PF A violation and that his attendance at the hearing is necessary.
7. Defendant Bailey requests this Court issue a Rule upon McGill to show cause
why he should not be found in contempt for failing to honor the subpoena compelling his
appearance at the November 21,2000 hearing and requests this Court take appropriate measures
to compel McGill's presence at any future hearing.
WHEREFORE, the Defendant respectfully requests this Honorable Court to grant
Defendant's Petition and issue a Rule upon McGill to show cause why he should not be found in

AND NOW, this 9th day of February, 2001,
the Defendant having been previously convicted of Indirect
criminal Contempt, sentence of the Court is that the
Defendant pay the costs of prosecution, make restitution to
Kim L. Beshore for any medical bills sustained as a result
of the incident on November 4, 2000, and undergo
imprisonment in the Cumberland County Prison for not less
than 17 days nor more than 6 months.
It appearing to the Court that the Defendant
has already served the minimum sentence, he is paroled
