13. No response required.
14. Denied. If changes or additions were made, and Plaintiff agreed to them,
that would not be a breach of contract. No bill was ever presented to the Defendants
for any changes or corrections, so therefore, Plaintiffs could not have refused
payment.
15. (a) Admitted. However, was not actually completed.
(b) Admitted. However, Defendant never accormted in the original
contract for the installation of any outside lights, which should have been provided.
Plaintiffs purchased the light fixtures and simply asked the Defendant to install them.
He never submitted an estimate of cost of installation, but he did agree to install
them.

(c) Denied. To the contrary, Plaintiffs offered to have the Defendant use
wood boards that the Plaintiffs already owned. No bill was submitted and no
estimate was given.
(d) Denied as stated. The garage door change was agreed upon verbally
at the time when final payment was made to the Defendant at the Plaintiffs' home on
February 22,2000. Defendant framed the 9 X 8 opening but never supplied doors.
(e) Denied as stated. Defendant asked the Plaintiffs if they wanted the
garage wrapped with Tyvek, and Plaintiffs told him to give them an estimate of costs.
Rather than giving them an estimate, he simply installed the Tyvek, and never
submitted a bill or an estimate prior thereto.
(f) Denied as stated. Plaintiffs had verbally discussed their desire for a
flagstone to be laid in the breezeway, which they provided and laid out the design of.
Defendant agreed to lay it out, stating that it was "no problem".
16. Denied. After reasonable investigation, the Plaintiffs are without
lmowledge or information sufficient to form a belief as to the truth of the averment
and strict proof thereof is demanded at trial. In further reply, no bill or estimate was
ever submitted to the Plaintiffs for any changes.

NEW MATTER BY WAY OF COUNTER CLAIM
BREACH OF CONTRACT
13. Defendant's answers to Plaintiff's Complaint in paragraphs 1 through 12, inclusive, are
hereby incorporated as if set forth in full.
14. Plaintiffs breached their contract with Defendant by making chances and additions to the
original design during the course of the work on the project, for which they later refused to
pay Defendant.
15. The chances made to the original contract are as follows:
(a) Gas pipe laid below garage sub floor for future heat; (completed)
(b) Wiring for additional interior and exterior lighting: (partially completed)
(c) Plywood decking laid on over head joists for light storage: (completed)

COMPLAINT
1. The Plaintiffs are Ryan Chance and Donna Chance, adult married
individuals with a current address of 2200 Memmac Avenue, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
2. The Defendant is K.A. Vachon Construction & Design, Inc., a corporation
organized and existing under laws of the Commonwealth of Pennsylvania, with a
business address of 1520 Doris Drive, Linglestown, Dauphin County, Pennsylvania
17112.
3. On or about December 12, 1999, both parties entered into a contract for the
Defe;dant to construct a 12' x 14' open air breezeway with an attached 24' x 24'
garage to the north side of their existing structure. A copy of the contract is attached
as Exhibit "A".
4. Defendant promised that it would be done in accordance with Local

Building Codes and completed in a timely manner, with a shingle and vinyl siding
colors to match the existing structure.
5. Defendant commenced working on the project, and was ultimately paid the
entire contract price to complete the job, of $13,550.00.
6. The job was to be completed by March 3, 2000.
7. To this date, the job has not been completed.
8. The Plaintiffs requested the Defendant, through counsel, to complete the job
within ten days of July 25, 2000. Again, no response was forthcoming from the
Defendant, and Defendant has failed and/or refused to complete the job.
9. The Plaintiffs have been forced to obtain an estimate for the completion of
the job from another contractor.
10. That contractor has indicated that much of the work performed by the
Defendant was not in'accordance with acceptable standards, or building codes, and
needs to be redone.
11. The cost to completely redo the entire job will be $21,740.00. A copy of the
new contractor's estimate is attached hereto and made a part hereof as Exhibit "B".

12. The Defendant has breached his contract with the Plaintiffs.
13. As a result of the breach, Plaintiffs will suffer damages in the amount of
$21,740.00.
WHEREFORE, the Plaintiffs request this Honorable Court to enter judgment in
favor of the Plaintiffs and against the Defendant in the amount $21,740.00 plus
interest and cost of suit.

We hereby submit specifications and estimates to bring a recently constructed 12 'XI4' breezeway
and 24 'X24' garage up to national building code, and complete any remaining unfinished work.
. Provide necessary plans and building permits
. Re/llove all existing wiring in the gnrage and breezeway to allow for roof removal, and rewire
completed structure to code. This wiring will be inclusive of; install owner supplied light
fixtures, 6-outlets, 8- switches, 4- ceiling lights, 1- sub-panel, 1- weather proof 3-way switch
for breezeway light, 2- spotlights, 1- garage door outlet, 1- attic light, 4- weather proof outside
outlets, finish conduit in the basement and to the sub-panel, and pull new wires to the
basement. Supply all necessary electrical inspections.
. Remove all siding and soffit material necessary to facilitate removal of the entire roof
structure from the gnrage and breezeway. Cut framing and install adequate headers over all
wall openings (i.e.: windows and doors). Double the existing beams for the breezeway.
Provide and install engineered light storage trusses on the garage and common trusses over
the breezeway, sheet roof using Yz" OSB ,apply 15# roofing felt, white aluminum drip edge,
and shingles to match that of the existing structure. Install siding and soffit as necessary,
install aluminum fascia, and aluminum gutters and downspouts.
. Cut a control joint in the concrete slab along the garage wall and seal with concrete caulk as
per the township inspector's request.
. Install two, white steel insulated raised panel garage doors in the respective openings. 1-
9'XI6', and 1- 9'X8'.
. Tear up existing driveway and haul away. Bring in necessary 2-A modified limestone to
regrade driveway for use from both garages. Fine gmde and roll new stone, apply 1 Yz" binder
surface and ai' wearing surface. Additionally, there will be 3" sch. 20 drain lines buried
under the drive at this lime to allow for rain removal from the gutters.
. Insta1l adequate foundation bolts to code around perimeter of garage walls.
. Remove first course of siding and install aluminum flashing per township inspector's request.
. Inspect remaining structure and repair any inadequate work found
At the end of each workday the area will be left in a neat and orderly fashion. AU trash generated
by the above work will be hauled away and discarded AU workman.hip provided by Gary Jones
Building & Remodeling carries a one-year warranty. AU materials are guaranteed to be as
specified and all work accomplished in a workmanlike manner according to standard practiCes.
Any alteration, or deviation, from the above listed specifications resulting in extra costs will be
executed only upon written authorization and will become an additional charge over and above the
