STIPULATION AGAINST LIENS
THIS AGREEMENT made this '761-- day of AloYel1lJ'j~
between HAUBERT HOMES, INC., a Pennsylvania
hereinafter referred to as Contractor,
1999, by and
Corpo:ca t ion,
AND
CHARLES A. HOLLISTER AND JOANNE E. HOLLISTER, husband and wife,
hereinafter referred co as Owners, whereby the contractor undertook
and agTeed to erected a.nd construct a dwelling on the certain lot
of ground situate in Cumberland County, Commonwealth of
Pennsylvania, and more fUlly described in Exhibit "A" which is
attached hereto and made a part hereof known as 1211 Peffer Road,
Mechanicsburq, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherw'ise, for, towards, in, or about
t.he erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situate in Monroe Township, Cumberland
County, Pennsylvania, being identified as Lot #2 on a plan of lots as set forth on a
"Final Subdivision Plan for Duane E. Nicholson" prepared by Eric L. Diffenbaugh
P.L.S., dated October 24, 1997 (Revised February 12, 1998), recorded July 2, 1998
in the Office ofthe Recorder of Deeds in and for Cumberland County, Pennsylvania
in Plan Book 77, Page 21, and being more fully described as follows to wit:
BEGINNING at a set Parker-Kalon Nail iu Peffer Road at lands of Paul Peffer, said
Parker-Kalon Nail being North 16 degrees 24 minutes 48 seconds West 18.89 feet
from a set iron pin; thence along lands of Paul Peffer South 16 degrees 24 minutes
48 seconds East 373.43 feet to a set iron pin; thence along Lot 3 South 73 degrees 21
minutes 43 seconds West 216.98 feet to a set iron pin; thence continuing along Lot 3
North 16 degrees 38 minutes 17 seconds West 419.91 feet to a set Parker-Kalon Nail
in Peffer Road, said Parker-Kalon Nail being North 16 degrees 38 minutes 17
seconds West 29.41 feet from a set iron pin; thence through Peffer Road North 85
degrees 22 minutes 31 seconds East 223.33 feet to a set Parker-Kalon Nail, the Place
of BEGINNING.
