1. Plaintiff is Paula p, Camplese- Leader, an adult individual, sui juris, with a current mailing
address of 20 South Market Street, City of Mechanicsburg, County of Cumberland, Commonwealth of
Pennsylvania, 17055,
2, Defendant is Ronald C, Neugebauer, a/kJa "Rohn" Neugebauer, an adult individual, sui
juris, who resides at 2746 North Second Street, City of Harrisburg, County of Dauphin, Commonwealth
of Pennsylvania, 1711 0,
3, This case is an appeal from a District Justice Judgment in favor of Plaintiff, Paula Camplese-
Leader and against Defendant, Ronald C. Neugebauer.
4, Plaintiff is a licensed real estate agent in the State of Pennsylvania.
5. At times relevant hereto, Defendant was a licensed real estate agent in the State of
Pennsylvania.
6, On March 22, 1999, and while an agent for Jack Gaughen Realtors, (hereinafter" broker"),

Plaintiff entered into an Exclusive Right to Sell Agreement with Mark and Lee Johnson, the owners of a
property more commonly known as 237 Susquehanna Avenue, Enola, P A, 17025.
7. Plaintiff 1hIIde substantial efforts to sell the property, however, during the term of the
Agreement, she took employment with another broker, Walker Realty.
8, Plaintiff was advised that she would not be able to take the listing to her new brokerage,
9, Prior to her departure from Jack Gaughen Realtors, Plaintiff sought out an agent to take the
listing.
10. Plaintiff selected Defendant to take the listing due to a relationship of trust and prior dealings
between the parties. Additionally, Defendant represented to Plaintiff that he would be willing to divide
any commission equally between the parties,
11, Plaintiff relied on the representations of defendant and as acceptance of the parties verbal
Agreement as to the commission, gave defendant the aforementioned listing
12. Plaintiff relied to her detriment on the representations of Defendant in that she did not seek a
written agreement as to the commission,
13, On or about June 30, 1999 and shortly after the transfer of the listing, the property sold for
$80,000,
14, Plaintiff was to receive $748.24 in commission and an additional $60,00 for the commission
on a home warranty,
15, Despite numerous representations as to his intent to make good on his obligation to Plaintiff,
Defendant failed to do so,
16, Defendant repeatedly avoided, plaintiff's correspondence in attempting to collect her share of
the commission,
17, Defendant has repudiated his obligation to pay Plaintiff on several occasions.
18, Defendant has sought to delay any efforts to settle this matter and comes to this court after

verbal accusations in open court that the District Justice acted with impropriety in rendering a judgment
for Plaintiff.
WHEREFORE, plaintiff claims damages of $853.24 for defendant's breach and for her detrimental
reliance on his promise to pay, together with costs.

NEW MATTER
19. The Real Estate Licensing and Registration Act requires every salesperson and
associate broker promptly on receipt by him of a deposit or other money on any
transaction in which he is engaged on behalf of his broker-employer shall pay over the
deposit to the broker. 63 P.8. Section 604(a) (5) (ii).
20. The Real Estate Licensing and Registration Act prohibits the acceptance of a
commission or any valuable consideration by a salesperson or associate broker for the
performance of any acts specified in this Act, from any person, except the licensed real
estate broker with whom he is affiliated 63 P.S. Section 604 (a) (12).
21. The Real Estate Licensing and Registration Act prohibits the payment of a
commission or any valuable consideration by a broker to anyone other than his licensed
employee or another real estate broker for the performance of any acts specified in this
act 63 P.S. Section 604 (a) (12.1).
22. The Regulation of the Real Estate Commission require a licensee who acts in a
representative capacity in connection with a real estate transaction shall ensure that the
sale or lease contracts, commitments and agreements regarding the transaction that he
has knowledge of, or that he can reasonably should be expected to have know of, are !JY.
WRITING. 49 PA CODE Section 35.281(a).
23. Any agreement to pay any valuable consideration by a licensed Real Estate
Salesperson to another licensed Real Estate Salesperson for the sale of real estate, is
violative of the Real Estate Licensing and Registration Act and Real Estate Commission
Regulations.
24. Provisions of the Plaintiff's alleged contract requiring unlawful conduct would be
void and unenforceable.
WHEREFORE, the Defendant ask for this court to dismiss this complaint
filed in this action.
