MICHAEL PANDOLFI, Defendant COMPLAINT FOR CUSTODY 1. Plaintiff is Julie Pandolfi, an adult individual whose residence is at 12B Richland Lane #205, Camp Hill, Cumberland County, Pennsylvania. 2. Defendant is Michael Pandolfi, an adult individual whose residence is at 3 Melwood Lane, Mechanicsburg, Cumberland County, Pennsylvania. 3. Plaintiff seeks custody of her child Gage Pandolfi, born November 4, 1990, currently residing at 3 Melwood Lane, Mechanicsburg, Cumberland County, Pennsylvania. 4. The child is presently in the custody of Defendant. 5. The Plaintiff has not participated as a party or in any other capacity, in other litigation concerning the custody of the child in this or any other Court. 9. Plaintiff has no information of a custody proceeding concerning the child pending in a Court of this Commonwealth. 10. The best interest and permanent welfare of the child will be served by granting the relief requested because the parties agreed as part of their divorce '- ""J--' If settlement that Plaintiff would have the child every Monday and Wednesday and alternating Fridays, Saturdays and Sundays. Defendant would have custody on Tuesdays, Thursdays, and alternating Fridays, Saturdays and Sundays. 11. Beginning in August 2000, the child began to refuse to leave Defendant's home and come with Plaintiff. 12. Plaintiff believes and therefore alleges that Defendant is encouraging the child to refuse to go with Plaintiff because she has a new boyfriend. 13. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action. Not other persons are known to have or claim to have any right to custody or visitation of the child other than the parties to this action. WHEREFORE, Plaintiff requests your Honorable Court to schedule a Custody Conciliation to reduce the parties divorce agreement to an order and to order the defendant not to allow the child to remain in his household during Plaintiffs periods of Custody. The Mother, Julie K. Pandolfi, and the Father, Michael T. Pandolfi, shall enjoy shared legal and shared physical custody of Gage M. Pandolfi, born November 4, 1990. 2. Unless agreed otherwise by the parties, physical custody of the minor child shall be alternated on a week on/week off basis. Exchange of custody shall be every Friday at 6:00 p.m. 3. During the summer months, Mother shall also enjoy custody for one week during the months of June, July and August, the times to be arranged between the parties. Mother shall give Father notice at least on or before of May 151 of each year as to when she intends to exercise her weeks. It is understood that Father shall also have the ability to take vacation time with the minor child and Father shall notifY Mother in advance as to when he will be exercising vacation with the minor child. 6. The parties shall alternate custody of the minor child on holidays from 8:00 a.m. until 7:00 p.m., the holidays to be New Year's Day, Easter, Memorial Day, July 4th, Labor Day and Thanksgiving. For the Christmas holiday, the Father shall have custody of the child from 6:00 p.m. on Christmas Eve until 3:00 p.m. on Christmas Day in odd numbered years and the Mother shall have the same in even numbered years; the Mother shall have custody of the minor child from 3:00 p.m. on Christmas Day until 6:00 p.m. on December 26th in odd numbered years, and the Father shall have the same in even numbered years. 8. The Mother shall always have custody of the minor child on Mother's Day and the Father shall always have custody of the minor child on Father's Day, the timeframe being from 8:00 a.m. until 7:00 p.m. 9. Transportation for exchange of custody shall be handled such that the party receiving custody shall pick up the minor child at the other party's residence. 10. Both parties shall inform the other parent immediately of all medical appointments or any other medical, social, educational or important issues relating to the child. 11. Neither party shall disparage the other parent to the child or in any way estrange the child from the parent. 12. Both parents shall enjoy liberal and reasonable telephone contact with the minor child when the child is in the custody of the other parent. 13. The custodial parent shall provide copies of the child's report card and other reasonable papers affecting the child's education, medical condition or welfare to the other parent. 14. Both parents and the child shall participate in family counseling. Mother shall pay for the counseling provided that the counselors are a participant in Mother's health insurance plan. Mother shall select the counselor to ensure Mother's ability to take advantage of a counseling agency that will be covered through her insurance plan. BY THE COURT, cc: Robert 1.
