COMPLAINT
The Plaintiff, LANDMARK AMERICA, INC., by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action

of Assumpsit against the Defendant to recover tbe sum of SIXTEEN THOUSAND, FIVE HUNDRED TWENTY-EIGHT
DOLLARS AND NINETY-ONE CENTS ($16,528.91), together with interest thereon at the per diem rate of Two Dollars and
Eighteen Cents ($2.18) from July 21, 2000, plus accruing late charges, upon a cause of action of which the following is a
statement:
1. The Plaintiff, LANDMARK AMERICA, INC., is a corporation organized and existing under the laws of the
State of Ohio, having its principal office and place of business at 3711 Youngstown Road, Warren, Ohio 44484.
2. The Defendant, RODNEY HERR, is an adult individual residing at 115 Hershey Road, Lot #7, Shippensbnrg,
Cumberland County, Pennsylvania 17257.
3. On or about August 4, 1999, Defendant did complete and execute an Application for Extension of Credit with
Federal Assurance Corporation of New Castle, Pennsylvania, for the purchase of a 1993 Freightliner FLD 11264ST Tractor.
A true and correct copy of said Application is attached hereto, marked as Exhibit "A" and made a part hereof.

4. Defendant did further enter into a Retail Installment Contract, Security Agreement and Federal Disclosure
Statement for the purchase of the aforesaid vehicle, for a total sale price of Thirty-Three Thousand, Seven Hundred Thirty-Five
Dollars and Fifty-Two Cents ($33,735.52). A true and correct copy of said Contract, Security Agreement and Federal Disclosure
Statement is attached hereto, marked as Exhibit "B" and made a part hereof.
5. Defendant did default in the tenus and conditions of the Retail Installment Contract, Security Agreement and
Federal Disclosure Statement referenced as Exhibit "B" hereinabove, which resulted in the repossession of the aforesaid vehicle.
After notification to Defendant and proper procedures to obtain the highest possible price for the repossessed vehicle, a deficiency
balance remains in the amount of Thirteen Thonsand, Seven Hundred Seventy-Four Dollars and Nine Cents ($13,774.09).
6. Pursnant to the tenus and conditions of the Retail Installment Contract, Security Agreement and Federal
Disclosure Statement referenced as Exhibit "B" hereinabove and made a part hereof, Defendant is further liable for attorney's
fees, which have been added to said account in the total amount of Two Thousand, Seven hundred Fifty-Four Dollars and Eighty-
Two Cents ($2,754.82).
7. The aforesaid Federal Assurance Corporation did, on May 30, 2000, did sell and assign to Plaintiff herein, by
means of an Asset Purchase Agreement, the delinquent account of Defendant herein. A true and correct copy of the Limited
Power of Attorney referencing said Asset Purchase Agreement is attached hereto, marked as Exhibit "C" and made a part
hereof.
8. The balance due and owing by Defendant to Plaintiff is the sum of Sixteen Thousand, Five Hundred Twenty-
Eight Dollars and Ninety-One Cents ($16,528.91).
9. Plaintiff has freqnently demanded payment from Defendant of said amount due and owing as aforesaid, but
Defendant has refused and neglected and stin refnses and neglects to pay said amount of any part thereof.

Assurance Corporation, and its successors and assigns ("Seller"), for valuable
consideration, given and paid by Landmark America, Inc., and it successors and assigns
("Buyer"), receipt whereof is hereby acknowledged, constitutes and appoints Robert L.
Delisio (as duly authorized Officer of Buyer), or his successor in office, the true and
lawful Attorney-In-Fact of the Seller ("Attorney"), with full power by an instrument in
writing to appoint a substitute for and in the name and stead of the Seller but for the
benefit of Buyer, for the purpose of effecting collection of the indebtedness (collectively
the "Loans"), to endorse and/or to execute Lost Note :Affidavits, any and all insurance
policies beld as security for the Loans, and all other property of every kind described in
that certain Asset Purchase Agreement dated May 30, 2000 between the Seller and
Buyer, under which Asset Purchase Agreement title to the Loans and other property and
the right and interest of the S~ller in all security for the Loans have been sold, delivered
to and vested in Buyer, the Seller hereby ratifying and confinning all acts and things done
by the Attorney or his substitute or substitutes in pursuance of the authority herein
granted. Nothing in this limited power of attorney shall be deemed to extend to Attorney
the abIlity to execute any document that creates any direct or indirect liability or any
representation or warranty in or to Seller (or its successors and assigns) that would
enlarge the liability representations or warranties contained in the Asset Purchase
Agreement.
This limited Power of Attorney sball be effective as of the execution date hereof;
and shall continue itl full force and effect until the earlier of three (3) years from the date
hereof or the Seller's execution and delivery to the Buyer of an' instrument revoking the
authority hereby granted (the ''Revocation''):
