STIPULATION AGAINST LIENS
THIS AGREEMENT made the 8th day of November, 2000, by and between RlDGEVIEW
CUSTOM HOMES, hereinafter referred to as Contractor, and HERBERT G. WEAVER, hereinafter
referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built
home on that certain lot of ground situate at Lot No.1 08, Indian Hills-Section 2, South Middleton
Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto
and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant.

acknowledges himself to be the Sole Proprietor of RIDGE VIEW CUSTOM HOMES and that he

contained by signing the name of the business by himself as the owner.

ALL that certain tract of land situate in South Middleton Township, Cumberland County,
Pennsylvania, and more particularly identified as Lot No. 108 on the Final Subdivision Plan of
Indian Hills - Section II, recorded in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania in Plan Book 77, Page 72 and further described as follows:
BEGINNING at a point on the western side of Silver Maple Drive (50 feet wide right of way) at the
dividing line between Lot No. 108 and Lot No. 126; thence along said Silver Maple Drive on a curve
to the left having a radius of225.00 feet, a chord length of 43.38 feet and a chord bearing of South
02 degrees 13 minutes 10 seconds East to a concrete monument; thence continuing along said Silver
Maple Drive South 03 minutes 18 minutes 16 seconds East a distance of 55.00 feet to a concrete
monument; thence on a curve to the right having a radius of 15.00 feet, a chord length of25.56 feet
and a chord bearing of South 41 degrees 41 minutes 44 seconds West to a concrete monument along
Shirley Lane (60 feet wide right of way); thence along said Shirley Lane South 86 degrees 41
minutes 44 seconds West a distance of 124.91 feet to a point; thence North 03 degrees 18 minutes
16 seconds West a distance of 141.25 feet to a point at the dividing line of Lot No.8 and Lot No.
126; thence along said dividing line South 82 degrees 15 minutes 24 seconds East a distance of
146.81 feet to a point on the western side of Silver Maple Drive, the point and place of
BEGINNING.
CONTAINING 17,864.83 squarefeet.
LOT No. 108 is subject to all associated rights and provisions of a 30 feet wide Storm Drainage
Easement
LOT No.1 08 is subject to all applicable notations and conditions set forth by [mal subdivision plan
approval ofIndian Hills, Section No. II.
