COMPLAINT
The Plaintiff, UNITED REFRIGERATION, INC., by its attorneys, KNUPP, KODAK & IMBLUM,
P.C., brings this action of Assumpsit against the Defendants to recover the sum of THIRTEEN THOUSAND,
FIVE HUNDRED AND NINETY -THREE DOLLARS AND SEVENTY -SEVEN CENTS ($13,593.77), along
with costs of this suit and interest thereon at the rate of2% per month from July 7, 2000 upon a cause of
action of which the following is a statement:
1. The Plaintiff, UNITED REFRIGERATION, INC., is a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania, having an office and place of business at 4490 Lewis
Road, Harrisburg, Dauphin County Pennsylvania 17111.
2. The Defendant, V & S CONSTRUCTORS, LTD., is a corporation organized and existing
under the laws ofthe Commonwealth of Pennsylvania, having its principal office and place of business at 117
South Market Street, Mechanicsburg, Cumberland County, Pennsylvania 17055-0062.
3. The Defendant, MICHAEL STRAUS, is an adult individual with and address at 117 South
Market Street, Mechanicsburg, Cumberland County, Pennsylvania 17055-0062.

4. On the dates, in the amounts, and for the prices set forth in a true and correct copy ofthe
Plaintiffs books of entry hereto attached, made a part hereof and marked Exhibit "A", Plaintiff, at the
special instance and request ofthe Defendant, V & S CONSTRUCTORS, LTD, sold and delivered goods,
wares and merchandise ofthe kind and description set forth on said Exhibit to the total amount of ELEVEN
THOUSAND, THREE HUNDRED TWENTY -EIGHT DOLLARS AND FOURTEEN CENTS ($11,328.14).
5. The prices charged for said goods, wares and merchandise were just and reasonable, were the
legal and market prices therefor and were the prices which the Defendant promised and agreed to pay
Plaintiff therefor.
6. Due to Defendant's default in payments of said amount due and owing as aforesaid and under
the terms and conditions accepted and agreed to by the Defendant in the Agreement Section ofthe Credit
Application as shown on Exhibit "B" attached hereto and made a part hereof, attorney's fees in the total
amount ofTWO THOUSAND, TWO HUNDRED SIXTY -FIVE DOLLARS AND SIXTY-THREE CENTS
($2,265.63), have been incurred.
7, The balance due and owing by Defendant to Plaintiff is the sum of THIRTEEN THOUSAND,
FIVE HUNDRED AND NINETY-THREE DOLLARS AND SEVENTY-SEVEN CENTS ($13,593.77).

8. Plaintiff has frequently demanded payment from Defendant of said amount due and owing as
aforesaid, but Defendant has refused and neglected and stiR refuses and neglects to pay said amount of any
part thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendant, V & S CONSTRUCTORS, L TD,
the sum of THIRTEEN THOUSAND, FIVE HUNDRED AND NINETY-THREE DOLLARS AND
SEVENTY-SEVEN CENTS ($13,593.77), along with costs ofthis suit and interest thereon at the rate of2%
per month from July 7, 2000.

v. MICHAEL STRAUS. Individually - PERSONAL GUARANTOR
9, Paragraphs #1 through #8 are incorporated herein as if fully and at length set forth.
10. On or about September 22, 1993, in order to induce Plaintiff to extend credit to a corporation
known as V & S CONSTRUCTORS, LID, Defendant, MICHAEL STRAUS, did complete and execute, and
agree to the terms and conditions of, an Personal Guarantee. A true and correct copy of said Guarantee is
attached hereto at Exhibit "B".
11. Defendant, V & S CONSTRUCTORS, LTD, has defaulted in payment to Plaintiff as set forth
hereinabove in Paragraphs #4 through #8.

12. Plaintiff has frequently demanded payment from Defendant & S CONSTRUCTORS, LTD,
of said amount due and owing as aforesaid, but Defendant has refused and neglected and stilI refuses and

13. Defendants' refusal and/or inability to pay its' indebtedness to Plaintiff creates liability for
Defendant, MICHAEL STRAUS, under the aforesaid Personal Guarantee.
WHEREFORE, Plaintiff brings this suit to recover from Defendant, MICHAEL STRAUS, the sum
of THIRTEEN THOUSAND, FIVE HUNDRED AND NINETY-THREE DOLLARS AND SEVENTY-
SEVEN CENTS ($13,593.77), along with costs ofthis suit and interest thereon at the rate of2o;" per month
from July 7, 2000.
