COMPLAINT
COUNT I
1. The Plaintiffs are Herminia Garcia Medina and Lauro Medina, Jr., husband and
wife, and adult individuals who reside at 340 Hummel Street, Harrisburg, Dauphin County,
Pennsylvania 17104.
2. Defendant, Thomas Dilworth, is an adult individual who resides at 1011
Tunbridge lane, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. On November 19, 1998, Plaintiff Herminia Garcia Medina was a back-seat
passenger in a 1991 Mazda Protege operated by Yvette Pabon and registered in New York,
which vehicle was not owned by Plaintiffs or any family member in their household.
4. Plaintiff Herminia Garcia Medina, an additional passenger, Julia Medina, and Ms.
Pabon were traveling west in the right lane on SR581 , near the SR 11/15 intersection.
5. At that time and place, Defendant Thomas Dilworth was operating a 1993 Ford
Explorer in the left lane next to Ms. Pabon's vehicle, also traveling west on SR581, near the SR
11/15 intersection.
6. At that time and place, while attempting to pass and/or change lanes, Defendant
Thomas Dilworth caused the motor vehicle that he was operating to strike the vehicle operated
by Ms. Pabon and in which Plaintiff was a passenger.

7. Upon initial impact, the vehicle being operated by Ms. Pabon was forced off the
roadway into the berm and back across two lanes of SR 581, struck again by Defendant's
vehicle, flipped over, traveled on its roof, and then came to rest upside down.
8. The occupants, including Plaintiff Hermina Garcia Medina, were suspended
upside down in the vehicle when it came to rest.
9, Plaintiff was transported to the Harrisburg Hospital by ambulance.
10. The accident at issue in this case and the resulting injuries and damages
suffered by Hermina Garcia Medina and her husband, Lauro Medina, Jr., were the direct and
proximate result of the negligence, recklessness, and carelessness of Defendant Thomas
Dilworth in that he:
(a) failed to keep a proper and/or reasonable lookout for other vehicles lawfully on
the roadway, specifically the vehicle in which Plaintiff was a passenger;
(b) failed to observe Ms. Pabon's vehicle on the road and apply his brakes and/or
take other appropriate or evasive action to avoid the incident at issue herein;
(c) failed to keep his motor vehicle under proper control;
(d) operated his motor vehicle at a speed that was too fast for conditions;
(e) failed to keep his eyes on the roadway and observe the conditions then and there
existing;
(f) failed to observe the assured clear distance ahead rule;
(g) failed to sound his horn or otherwise warn of the impending impact;
(h) failed to properly change lanes;
(i) operated his motor vehicle in violation of the Pennsylvania Motor Vehicle Code:
75 Pa. C.SA ~ 3303 (a)(1), Overtakina Vehicle on the Left;

11. As a direct and proximate result of the negligence, carelessness, and
recklessness of Defendant Thomas Dilworth, as set forth herein, Hermina Garcia Medina has
suffered serious and permanent injuries that include the following:
(a) right clavicle fracture with displacement;
(b) multiple contusions;
(c) disfigurement;
(d) shoulder and thoracic pain;
(e) thoracic spine strain;
(f) muscle spasms right upper trapezius;
(g) decreased strength upper extremity;
(h) myofascial pain;
(i) post traumatic right clavicular fracture;
OJ decrease in internal rotation of the right shoulder;
(k) deficit right grip strength.
12. As a result of the aforesaid injuries, Plaintiff Herminia Garcia Medina has
undergone and in the future will continue to suffer pain, mental anguish and suffering,
humiliation, inconvenience, embarrassment, and loss of life's pleasures.
13. As a result of her injuries, Plaintiff Herminia Garcia Medina has and will continue
to require medical care, therapy, and treatment.
14. As a further direct and proximate result of the aforesaid incident and related
injuries, Plaintiff Herminia Garcia Medina has been damaged as follows:
(a) she has and may continue to be limited in her normal daily activities;
(b) she has and may continue to suffer great nervous and emotional distress;

(c) she has and may continue to suffer impairment to her general health, strength
and vitality;
(d) she has and may continue to be required to spend money for medical expenses
in the future, for which a claim is made herein, to the extent permitted by
applicable law;
(e) she has and may continue to suffer other financial losses for which she claims to
the extent permitted by applicable law;
(f) she has and may continue to suffer loss of earnings and earning capacity for
which she claims to the extent permitted by applicable law.
15. The injuries suffered by Plaintiff Herminia Garcia Medina are serious injuries that
have resulted in serious impairment of body function in her right upper extremity that has placed
her at risk for injury due to lifting below the level required of her job; she suffers from decreased
upper extremity strength and presence of muscle spasm in the right upper trapezius which limits
her endurance capabilities, and has significantly impaired her strength, range of motion,
functioning capabilities at work, lifting capabilities, daily activities, and social activities.
16. Plaintiff Herminia Garcia Medina was an insured under an automobile insurance
policy issued by Liberty Mutual at the time of the incident that carried the limited tort option; said
poliCy insured a vehicle owned by one or both Plaintiffs, and Plaintiff Lauro Medina, Jr. was the
named insured on said policy.
17. Plaintiff Herminia Garcia Medina has sustained injuries which represent serious
injuries and a serious impairment of body function and as such her claim for non-economic
damages is not restricted by the limited tort option and is governed by the full tort option.
18. In the alternative, since Plaintiff Herminia Garcia Medina was a passenger in an
out-of-state vehicle not owned by her or her husband, or any family member in their household,
the limited tort option referenced above is not applicable.

WHEREFORE, Plaintiff Herminia Garcia Medina requests that judgment be entered in
her favor and against Defendant Thomas Dilworth, in an amount not in excess of the
jurisdictional amount requiring mandatory arbitration.
COUNT II
19. Paragraphs 1 through 18 are incorporated herein by reference and made a part
hereof as if set forth in their entirety.
20. As a further result of the injuries sustained by his wife, Plaintiff Lauro Medina, Jr.
has and will be deprived of the assistance, companionship, consortium and society of his wife,
all of which has been and will be to his great detriment and loss for which damages are claimed.
WHEREFORE, Plaintiff Lauro Medina, Jr. demands judgment against Defendant
Thomas Dilworth in an amount not in excess of the jurisdictional amount requiring mandatory
arbitration.

AND NOW, comes the Defendant, Thomas Dilworth, by and
through his counsel who files this Complaint to Join an
Additional Defendant by respectfully stating the following:
1. Defendant Thomas Dilworth, hereinafter "Mr. Dilworth,"
is an adult individual who currently resides at 1011 Tunbridge
Lane, Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. Mr. Dilworth is the Defendant in the above captioned
matter.
3. It is believed and therefore averred that Additional
Defendant Yvette Pabon is an adult individual who has a last
known address of 1612 Wayne Street, Harrisburg, Dauphin County,
Pennsylvania 17104.

4. Plaintiffs commenced this action with the filing of a
Writ of Summons on November 14, 2000. A copy of the Writ of
Summons is attached hereto as Exhibit A.
5. Plaintiffs filed their Complaint on or about February
13, 2002, and the Complaint was served on Mr. Dilworth's counsel
on the same date. A copy of the Complaint is attached hereto as
Exhibit B. r

Contemporaneously with the filing of this Complaint,

Mr. Dilworth will file an Answer with New Matter to Plaintiffs'
Complaint which is attached hereto as Exhibit C.
7. Plaintiff Hermina Garcia Medina was a passenger in an
automobile operated by the Additional Defendant.
8. Plaintiffs claim to have suffered damages as a result
of a motor vehicle accident which occurred on November 19, 1998.
See Exhibit B.
9. Plaintiffs alleged injuries, if any, were directly and
proximately caused by the negligence of Additional Defendant
Yvette Pabon in that she:
a) failed to keep proper control of her motor vehicle as
she operated it upon the highway;
b) operated her vehicle at a speed in excess of what was
reasonable under the circumstances;
c) failed to be alert and keep a proper lookout for other
vehicles on the roadway; and

d) drove her vehicle inattentively without regard to the
rights and safety of Plaintiffs.
10. As a direct and proximate result of Additional
Defendant Yvette Pabon's negligence, Plaintiffs sustained their
alleged injuries and is therefore jointly and severally liable to
Mr. Dilworth, or in the alternative, liable over to Mr. Dilworth
for indemnity or contribution.
WHEREFORE, Mr. Dilworth respectfully requests that
Additional Defendant Yvette Pabon be found jointly and severally
liable on Plaintiffs' claims, or in the alternative, found liable
over to Mr. Dilworth on the claims asserted by Plaintiffs.

COMPLAINT
COUNT I
1. The Plaintiffs are Herminia Garcia Medina and Lauro Medina, Jr., husband and
wife, and adult individuals who reside at 340 Hummel Street, Harrisburg, Dauphin County,
Pennsylvania 17104.
2. Defendant, Thomas Dilworth, is an adult individual who resides at 1011
Tunbridge Lane, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. On November 19, 1998, Plaintiff Herminia Garcia Medina was a back-seat
passenger in a 1991 Mazda Protege operated by Yvette Pabon and registered in New York,
which vehicle was not owned by Plaintiffs or any family member in their household.
4. Plaintiff Herminia Garcia Medina, an additional passenger, Julia Medina, and Ms.
Pabon were traveling west in the right lane on SR581, near the SR 11/15 intersection.
5. At that time and place, Defendant Thomas Dilworth was operating a 1993 Ford
Explorer in the left lane next to Ms. Pabon's vehicle, also traveling west on SR581 , near the SR
11/15 intersection.
6. At that time and place, while attempting to pass and/or change lanes, Defendant
Thomas Dilworth caused the motor vehicle that he was operating to strike the vehicle operated
by Ms. Pabon and in which Plaintiff was a passenger.

Upon initial impact, the vehicle being operated by Ms. Pabon was forced off th~

roadway into the berm and back across two lanes of SR 581, struck again by Defendant's
vehicle, flipped over, traveled on its roof, and then came to rest upside down.
8. The occupants, including Plaintiff Hermina Garcia Medina, were suspended
upside down in the vehicle when it came to rest.
9. Plaintiff was transported to the Harrisburg Hospital by ambulance.
10. The accident at issue in this case and the resulting injuries and damages
suffered by Hermina Garcia Medina and her husband, Lauro Medina, Jr., were the direct and
proximate result of the negligence, recklessness, and carelessness of Defendant Thomas
Dilworth in that he:
(a) failed to keep a proper and/or reasonable lookout for other vehicles lawfully on
the roadway, specifically the vehicle in which Plaintiff was a passenger;
(b) failed to observe Ms. Pabon's vehicle on the road and apply his brakes and/or
take other appropriate or evasive action to avoid the incident at issue herein;
(c) failed to keep his motor vehicle under proper control;
(d) operated his motor vehicle at a speed that was too fast for conditions;
(e) failed to keep his eyes on the roadway and observe the conditions then and there
existing;
(f) failed to observe the assured clear distance ahead rule;
(g) failed to sound his horn or otherwise wam of the impending impact;
(h) failed to properly change lanes;
(i) operated his motor vehicle in violation of the Pennsylvania Motor Vehicle Code:
75 Pa. C.SA S 3303 (a)(1),Overtakina Vehicle on the Left;

11. As a direct and proximate result of the negligence, carelessness, and
recklessness of Defendant Thomas Dilworth, as set forth herein, Hermina Garcia Medina has
suffered serious and permanent injuries that include the following:
(a) right clavicle fracture with displacement;
(b) multiple contusions;
(c) disfigurement;
(d) shoulder and thoracic pain;
(e) thoracic spine strain;
(f) muscle spasms right upper trapezius;
(g) decreased strength upper extremity;
(h) myofascial pain;
(i) post traumatic right clavicular fracture;
Ol decrease in internal rotation of the right shoulder;
(k) deficit right grip strength.
12. As a result of the aforesaid injuries, Plaintiff Herminia Garcia Medina has
undergone and in the future will continue to suffer pain, mental anguish and suffering,
humiliation, inconvenience, embarrassment, and loss of life's pleasures.
13. As a result of her injuries, Plaintiff Herminia Garcia Medina has and will continue
to require medical care, therapy, and treatment.
14. As a further direct and proximate result of the aforesaid incident and related
injuries, Plaintiff Herminia Garcia Medina has been damaged as follows:
(a) she has and may continue to be limited in her normal daily activities;
(b) she has and may continue to suffer great nervous and emotional distress;

she has and may continue to suffer impairment to her general health, strength
and vitality;
(d) she has and may continue to be required to spend money for medical expenses
in the future, for which a claim is made herein, to the extent permitted by
applicable law;
(e) she has and may continue to suffer other financial losses for which she claims to
the extent permitted by applicable law;
(f) she has and may continue to suffer loss of earnings and earning capacity for
which she claims to the extent permitted by applicable law.
15. The injuries suffered by Plaintiff Herminia Garcia Medina are serious injuries that
have resulted in serious impairment of body function in her right upper extremity that has placed
her at risk for injury due to lifting below the level required of her job; she suffers from decreased
upper extremity strength and presence of muscle spasm in the right upper trapezius which limits
her endurance capabilities, and has significantly impaired her strength, range of motion,
functioning capabilities at work, lifting capabilities, daily activities, and social activities.
16. Plaintiff Herminia Garcia Medina was an insured under an automobile insurance
policy issued by Liberty Mutual at the time of the incident that carried the limited tort option; said
policy insured a vehicle owned by one or both Plaintiffs, and Plaintiff Lauro Medina, Jr. was the
named insured on said policy.
17. Plaintiff Herminia Garcia Medina has sustained injuries which represent serious
injuries and a serious impairment of body function and as such her claim for non-economic
damages is not restricted by the limited tort option and is governed by the full tort option.
18. In the alternative, since Plaintiff Herminia Garcia Medina was a passenger in an
out-of-state vehicle not owned by her or her husband, or any family member in their household,
the limited tort option referenced above is not applicable.

WHEREFORE, Plaintiff Herminia Garcia Medina requests that judgment be entered in
her favor and against Defendant Thomas Dilworth, in an amount not in excess of the
jurisdictional amount requiring mandatory arbitration.
COUNT II
19. Paragraphs 1 through 18 are incorporated herein by reference and made a part
hereof as if set forth in their entirety.
20. As a further result of the injuries sustained by his wife, Plaintiff Lauro Medina, Jr.
has and will be deprived of the assistance, companionship, consortium and society of his wife,
all of which has been and will be to his great detriment and loss for which damages are claimed.
WHEREFORE, Plaintiff Lauro Medina, Jr. demands judgment against Defendant
Thomas Dilworth in an amount not in excess of the jurisdictional amount requiring mandatory
arbitration.

1. Stephen M, Greecher, Jr., of Tucker Arensberg & Swartz represents Hermina
Garcia Medina and Lauro Medina, Jr., Her Husband, in the above captioned case,
2. This case arises out of a motor vehicle accident that occurred on November 19,
1998, in which Hermina Garcia Medina suffered injuries for which she is making a claim in the
above action and, with respect to said accident, her husband, Lauro Medina, Jr., is asserting a
claim for loss of consortium.
3, A Praecipe for Writ of Summons was filed on November 14, 2000, and a
Complaint was filed on February 13, 2002,
4. An Answer with New Matter was filed on February 21, 2002.
5. Interrogatories were served by Defendant on February 26, 2002,
6, The Reply to New Matter was prepared and forwarded to Hermina Garcia
Medina and Lauro Medina, Jr., Her Husband, on March 8, 2002.
7. The Interrogatories were forwarded to Hermina Garcia Medina and Lauro
Medina, Jr. on April 1, 2002.

8. Both by phone and by correspondence, multiple efforts were made to contact
Hermina Garcia Medina, who has not returned telephone calls or responded to correspondence.
9, Hermina Garcia Medina and Lauro Medina, Jr" Her Husband, have not provided
the Verification for the Reply to New Matter.
1 O. Tucker Arensberg & Swartz and Stephen M. Greecher, Jr. cannot continue to
represent Hermina Garcia Medina and Lauro Medina, Jr., Her Husband, in the above case in
that they fail to respond to requests for information or to otherwise communicate and cooperate
with counsel.
11. Yvette Pabon has been added as an Additional Defendant in the above action,
12. Yvette Pabon was the driver of the motor vehicle in which Hermina Garcia
Medina was a passenger.
13. Stephen M. Greecher, Jr. and Tucker Arensberg & Swartz had represented
Yvette Pabon with respect to the accident of November 19, 1998, and Yvette Pabon's case was
settled.
14. Counsel, Stephen M, Greecher, Jr., has written to Hermina Garcia Medina
regarding a potential conflict of interest created by Defendant adding Yvette Pabon as an
Additional Defendant to this action,
15, Hermina Garcia has not responded to counsel, Stephen M. Greecher, Jr.'s, letter
to her regarding the conflict of interest.
16. Given that Plaintiffs, Hermina Garcia Medina and her husband, Lauro Medina,
Jr" have not responded to correspondence and telephone calls from counsel and do not
communicate with counsel, and given the potential conflict of interest, counsel, Stephen M.
Greecher, Jr" requests leave to withdraw as counsel for Hermina Garcia Medina and Lauro
Medina, Jr., her husband, in the above action,

AND NOW, comes the Defendant, Thomas Dilworth (hereinafter
"Mr. DilworthU), by and through his counsel, Goldberg, Katzman &
Shipman, P.C., who files this Motion for Non Pros by respectfully
stating the following:
1. This matter arises from an automobile accident which
occurred on November 19, 1998.
2. Plaintiffs are limited tort plaintiffs.
3. Plaintiffs instituted this action by filing a Praecipe
for Writ of Summons on November 14, 2000.
4. Plaintiffs were represented by Attorney Stephen M.
Greecher, Jr., of the law firm Tucker Arensberg & Swartz when
this action was commenced by the above referenced Praecipe.

5. Attorney Greecher filed a Complaint on behalf of
Plaintiffs on or about February 13, 2002.
6. Plaintiffs have not issued any written discovery nor
have Plaintiffs requested any depositions in this matter.
7. Plaintiffs have failed to answer the written discovery
propounded by Mr. Dilworth,
8. Plaintiffs have also failed to file a reply to the New
Matter filed by Mr. Dilworth on February 22, 2002.
9. On August 14, 2002, Attorney Greecher filed a Petition
to Withdraw as Counsel. A copy of the Petition is attached
hereto as Exhibit A.
10. Attorney Greecher avers in his Petition to Withdraw as
Counsel that Plaintiffs have failed to respond to his requests
for information or to otherwise communicate and cooperate with
counsel. See Exhibit A, Paragraph 10.
11. Plaintiffs failure to cooperate with Attorney Greecher
included their failure to provide a verification for a reply to
new matter and to supply discovery information. See Exhibit A,
Paragraphs 9 and 10.
12. A Rule was issued on August 19, 2002 upon to the
parties to show cause why Attorney Greecher should not be granted
leave to withdraw as counsel. A copy of the Rule is attached
hereto as Exhibit B.

13. No response was filed by an Party to the Rule issued on
August 19, 2002.
14. On or about November 26, 2002, Attorney Greecher filed
a Motion to Make Rule Absolute. A copy of the Motion is attached
hereto as Exhibit C.
15. Attorney Greecher avers that the Plaintiffs were served
with Petition to Withdraw as Counsel and Rule on August 24, 2002.
See Exhibit C, Paragraphs 4 and 5. A copy of the return receipt
is attached to Attorney Greecher's Motion to Make Rule Absolute.
16. Judge Hess issued an Order on December 5, 2002 which
granted Attorney Greecher permission to withdraw as counsel in
this matter, and Attorney Greecher withdrew his appearance as
Plaintiffs' counsel.
17. Substitute counsel has not entered an appearance for
Plaintiffs in this matter.
18. On January 14, 2003, Mr. Dilworth served a Praecipe for
Listing Case for Trial upon Plaintiffs. A copy of the
transmittal letter is attached hereto as Exhibit D.
19. Mr. Dilworth's counsel also forwarded to Plaintiffs
copies of the applicable local rules of court concerning pre-
trial conferences and jury trials. See Exhibit D.
20. Mr. Dilworth's counsel also indicated in the letter

that the applicable dates for cases to be tried during the March
2003 trial term were listed upon the Praecipe listing this matter
for trial. See Exhibit D.
21. This matter was listed for trial on January 16, 2003.
A copy of the Praecipe is attached hereto as Exhibit E.
22. This matter was called for trial on February 11, 2003.
23. Plaintiffs did not appear at the call of the trial
list.
24. On the same day as the call of the trial list, Mr.
Dilworth's counsel wrote to Plaintiffs indicating that the matter
had been called for trial. A copy of this correspondence is
attached hereto as Exhibit F.
25. The letter indicates that pre-trial conferences are to
occur on Wednesday, February 19, 2003. See Exhibit F.
26. Plaintiffs were also supplied another copy of the
relevant local rules concerning pre-trial conferences and trial.
See Exhibit F.
27. The letter also indicated that sanctions may be imposed
for a party's failure to appear at the pre-trial conference. See
Exhibit F.
28. All of the letters to Plaintiffs have been to the same
address utilized by Attorney Greecher.
29. None of the letters or documents sent to Plaintiffs

have been returned.
30. Mr. Dilworth has not been provided any other address
for Plaintiffs; thus, it is presumed Plaintiffs are receiving all
of the above referenced correspondence.
31. Plaintiffs have not served a copy of a pre-trial
memorandum upon Mr. Dilworth's counsel.
32. Plaintiffs have not appeared for the Pre-Trial
Conference in this matter.
33. Counsel is under the same duty to appear at a pre-trial
conference as he is to appear at trial. Anderson v. Financial
Resp. A. Cl. Plan, 432 Pa.Super. 54, 637 A.2d 659 (1994).
34. Parties appearing pro se have the same duty to appear
at a pre-trial conference as would their attorney.
Stock v.
Arnott, 415 Pa.Super. 113, 608 A.2d 552 (1992).
35. Plaintiffs failure to attend the Pre-Trial Conference
in this matter is the same is if Plaintiffs failed to attend the
first day of trial. See Anderson, supra.
36. Pennsylvania Rule of Civil Procedure 2l8(a) states,
"Where a case is called for trial, if without satisfactory excuse
a plaintiff is not ready, the court may enter a nonsuit on motion
of the defendant or a non pros on the court's own motion.n
37. Pennsylvania Rule of Civil Procedure 2l8(c)states, "A

38. plaintiff's failure to attend the Pre-Trial Conference
in this matter demonstrates that Plaintiffs are not ready to
proceed with trial, and Plaintiffs do not have a satisfactory
excuse for their inability to proceed with trial.
39. This Court is well within its discretion to enter a non
pros due to Plaintiffs failure to attend the Pre-Trial Conference
of this matter. See Anderson, supra., and Pa.R.C.P. 218.
WHEREFORE, Defendant respectfully requests that this
Honorable Court grant his Motion for Non Pros, and that this
matter be dismissed with prejudice.

RULES OF PROCEDURE
CALL OF CIVIL TRIAL LIST
Rule 2I3-L
For each term of court the civil trial list shall be
called on Tuesday of the fourth week before civil trial
week AsJy case not answered at the first call, shall,
at the option of the court, be placed at the foot of tbe
list or stricken from it.
Note: This rule amends prior rule by dispensing with the
second call of the list.

Rule 213-2,
At the call of the trial list, counsel for all parties
shall indicate that di.covery has been completed, that
all pretrial actions have been taken, and that the case

be placed at the foot of the list or stricken from it,

The trial list for Cases at law shall close seven (7)
weeks before the first day of trials, Trial lists shall
be prepared by the Prothonotary in which the cases
shall be arranged in the order of their listing. Copies
of each trial list shall be made available to members of
the Bar.

Rule 214-3.
Where a case is listed for trial by direction of the
Court, notice of such listing shall be given to counsel
by the Prothonotary.

Rule 223-2
Rule 215-1. Non-Jury Trials.
This is an effort by the court to remove civil non-
jury cases from the call of the civil trial list. If
litigants to a case lmow that it ,viII be a non-jury trial,
they simply may file a praecipe witb the Prothonotary,
who will forward same to the Court Administrator's
Office. The Court Administrator will assign the case
to a judge immediately. This is somewhat similar to
our procedure in equity cases. The hope is that oon-
jury trials might be scheduled more quickly and effi-
ciently in this manner, instead of having to wait for
the call of the civil trial list.
Rule 223-l.
In all trials tbe order of procedure shall he as
follows: The counsel for the affIrmative shall open his
case and state the facts and, if necessary, the princi-
ples of law involved so that the relevancy of the facts
may be understood, hut without argument, Thereaf-
ter, the opposing counsel may open his case and
proceed in like manner or may reserve his right to
open until after the affirmative case in cbief, If
reserved, the counsel for the affIrmative shall call
witnesses for examination and cross-examination. If
not reserved, the counsel for the affirmative shall
present his case in chief at the close of the affrrmative
case, Closing arguments shall be in inverse order of
the opening statements. Unless specifically allowed,
no opening statement or summation shall exceed thir-
ty (30) minutes,
Note: This rule is derived from former Rule 209.

Rule 223-2.
Upon the return of the jury to the courtroom, the
judge shall examine the written verdict. If irregular,
the judge shall further instruct the jury and send it
back for further deliberation, If the written verdict is
in proper form, regular and valid, the judge shall hand
it to the Prothonotary who shall inquire of the fore-
man:
"Have you reached a verdict?"
Upon an affirmative response, the Prothonotary
shall inquire of the foreman:
"What is your verdict?"
Thereupon the foreman shall pronounce the verdict.
Upon demand for a poll being made, the Prothono-
tary shall inquire of each juror separately as to his or
her vel'dict, The Court shall instruct the Protbonota-
ry as to the form of the question after consultation
with counsel if desired.
If no demand for a poll is made or if the poll :::;hows
a legal verdict, the Prothonotary shall enter the ver-

DEFENDANT'S PRE-TRIAL MEMORANDUM
I. Basic Facts as to Liability
This matter arises from an automobile accident which
occurred on November 19, 1998. Plaintiff was a passenger in a
vehicle operated by the Additional Defendant which was traveling
westbound in the right lane of S.R. 581, near its intersection
with S.R. 11/15.
Defendant Thomas Dilworth (hereinafter "Mr.
Dilworth")was operating his vehicle westbound in the left lane of
travel. Mr. Dilworth signaled his intention to move from the
left travel lane to the right travel lane of S.R. 581. The
Additional Defendant was operating her vehicle at an apparent
high rate of speed as Mr. Dilworth entered the right travel lane.
The Additional Defendant's vehicle moved to the right shoulder of

S.R. 581 and then traveled into the path of Mr. Dilworth's
vehicle. The vehicles came into contact and a collision ensued.
II. Basic Facts as to Damages
Plaintiff wife claims to have suffered a right clavicle
fracture as well as strains and contusions.
Plaintiffs are
limited tort plaintiffs.
It is submitted that Plaintiff wife did
not suffer injury which caused her to suffer a serious impairment
of bodily function.
III. Principal Issues as to Liability and Damages
A. Was Mr. Dilworth negligent with regard to the
happening of the accident?
B. Was the Additional Defendant negligent with regard
to the happening of the accident?
C. Which parties negligence, if any, was greater with
regard to the happening of the accident?
D. Was the negligence of Mr. Dilworth and/or the
Additional Defendant, if any, a substantial factor
in causing Plaintiffs' alleged injuries?
E. Did Plaintiff suffer a serious impairment of
bodily function?
IV. Legal Issues
None anticipated at this time.
Plaintiffs and the
Additional Defendant's pro se status may complicate the trial of
this matter, however.
