NOW COMES ALEXIS MACHIN, Defendant and DAVID JAMES
DITTENHAFER, Plaintiff and Stipulate and Agree as follows:
1. Plaintiff David Jarnes Dittenhafer hereby withdraws the Writ of Execution and terminates
any and all judgment collection proceedings against Defendant with prejudice and
satisfies his District Justice Civil Judgment taken in the captioned case numbers against
Defendant, Alexis Machin, in consideration of Defendant's agreement with the terms of
settlement herein and the full performance as agreed herein.
2. Defendant, Alexis Machin, in consideration of Plaintiff's agreement with the terms of
settlement herein withdraws his Motion for Post-Trial Relief and his Motion to Set Aside
theWrit of Execution entered in CV 00- 8040 Civil herein.

3. Upon the execution of this Stipulation, Plaintiff acknowledges receipt of delivery from
Defendant Alexis Machin of that certain 1987 Nissan automobile purchased by
Defendant from David Jarnes Dittenhafer.
4. Defendant AIexis Machin further stipulates and agrees to deliver to his Attorney, David
S. Brady, a money order, certified check or cashier's check for Five Hundred Dollars
payable to David James Dittenhafer on or before January 12,2001, and David Jarnes
Dittehhafer agrees to accept the same in full satisfaction of all claims whatsoever that
Plaintiff asserts against Defendant.
5. It is further Stipulated and agreed by the parties hereto that the effective date of this
Stipulation shall be upon the filing of the Stipulation with the court which shall not occur
before the final delivery of both the automobile and the cash payment provided for
herein; Counsel of record for Defendant shall receive and hold this Stipulation executed
by the parties, pending the delivery of the Five Hundred Dollar money order specified
above to Plaintiff and Counsel shall then file the Stipulation, with the Court together
with a proposed Order approving sarne.
6. It is further agreed that Plaintiff shall not be obliged to Show Cause or otherwise respond
to the Court's Order of December 19,2000 pending the filing by Counsel of this
Stipulation with the Court along with a proposed Order approving the settlement by the
parties.

PURSUANT TO PA.R.CIV.P. 3121 (b) (2)
NOW COMES ALEXIS MACHIN and files his Motion for Post-Trial Relief
pursuant to Pa.R.Civ. P. 227.1 and Motion to Set Aside Writ of Execution pursuant to
Pa.R.Civ.P. g3121(b)(2) and by and through his Attorney David S. Brady does says as follows:
1. Defendant purchased a 1987 Nissan from David Dittenhafer, Jr. on May 11, 2000 for the
purchase price of $200 which Defendant paid in cash. [ See copy of the receipt for the
purchase of the Vehicle attached and marked as Exhibit 1.]
2. As a result of the transaction, Plaintiff was paid in full and was owed nothing further for
the purchase.
3. Plaintiff fraudulently formulated a Complaint against Defendant suing Defendant for ten

times the arnount of the purchase price or $2000 .
4. Plaintiff filed the Complaint on or about July 7, 2000 in the court of District Justice
Paula P. Correal, in Magisterial District Number 09-2-01 in Carlisle, Pennsylvania.
5. Upon service of the process in the District Justice suit, Defendant appeared in the District
Justice Office and informed the court he would interpose a defense to the Complaint.
6. The District Justice Office duly noted the defense and set the matter for hearing on
September 25, 2000.
7. At the aforesaid time and date, Defendant appeared in court and no one appeared for
Plaintiff.
8. The Defendant requested that the matter be dismissed. The court personnel declined to
dismiss the matter and set it down for October 9, 2000 at which time Defendant appeared
for the hearing.
9. At the October 9,2000 hearing Defendant Alexis Machin presented himself and David
Dittenhafer, Sr, appeared but his son, the Plaintiff in this matter, did not appear and no
testimony was taken.
10. Defendant was informed that the court would set a new date and would inform him of the
date and time.
11. Defendant did not receive another notice in this matter until he was served with a Writ of
Execution on December 4,2000, to collect $2077.88, none of which is owed to Plaintiff.
12. Until December 4, Defendant Alexis Machin was cornpletely unaware that Plaintiff had
obtained a judgment against him on October 13, 2000.
13. Defendant fully intended to defend the fraudulent complaint ofthe Plaintiff on the merits
at hearing and upon receiving notice of the writ of execution was outside the time for the

filing of an appeal from a District Justice Judgment in the normal course.
14. Defendant affirms and believes that, if the court sent him a notice of the October 13
hearing that the notice was not delivered to his mailbox as he did not receive the notice.
15. The Plaintiff s judgment is improper and not founded upon
16. Defendant was unable to afford legal counsel and sought representation through the
Cumberland County legal services.
17. Cumberland County legal services had a conflict and assigned David S. Brady the
captioned case as a pro bono matter.
18. All delays oftime to appeal from the judgment were the result of Defendant's ignorance
of his legal remedies insofar as appeal and/or setting aside the judgment within thirty
days as provided by the District Justice Rules. Defendant has acted promptly to pursue
his rights and remedies upon learning of the judgment.
19. The Defendant lives with his four children in an apartment with one Jennifer Jumper,
who is the mother of an expected child of the Defendant's.
20. Most ofthe property levied upon in the writ of execution is the personal property
belonging to Jennifer Jumper.
21. Some of the property listed in the levy is the personal property of Defendant's children,
such as beds, bedroom furniture and the like.
22. If the judgment of Plaintiff is not set aside and the execution stayed, Defendant would be
left without a remedy.
WHEREFORE, Defendant prays that this court will set aside the judgment
entered before the District Justice in this matter, remand the matter for trial at which Defendant
has representation of Counsel and grant a Stay of Execution pending a trial on the merits of the

captioned Plaintiff's Complaint or in the alternative to grant an outright dismissal and removal
of the judgment as having been based upon the fraudulent complaint by Plaintiff and for such
