WHEREAS, East Gate Seniors Associates, L. P., Owner, of 114 North Hanover Street, Carlisle,
Pennsylvania is about to have assigned to it by Cumberland Senior Housing Associates contemporaneously
herewith, a contract, with SGS Architects Engineers. Inc., Architect, of One Tyler Court, Carlisle,
Pennsylvania, for the design and oversight of the construction of a building and other improvements upon
a lot of land situate in South Middletown Township, Cumberland County, Pennsylvania, being more fully
bounded and described on Exhibit A attached hereto and made part hereof.
NOW, N 111.1( w.~""'" () , 2000, at the time of and immediately before the assignment of the principal
contract, and before any authority has been given by the said Owner to the said Architect to commence
work on the said building or purchase materials for the same in consideration of the making of the said
contract with Architect and the further consideration of one dollar. to Architect paid by Owner it is agreed
that no lien shall be filed against the building by the Architect, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased
for the erection of said building, the right to file such liens being expressly waived.

EXHIBIT A
ALL THAT CERTAIN tract of land situate in South Middleton Township,
Cumberland County, Pennsylvania, being Lot No. 2 as shown on a Plan entitled Final
Subdivision Plan for Old Field Partnership, dated June 15, 2000, and last revised August 22,
2000, by Brehm-Lebo Engineering, Inc., and recorded in Cumberland County Plan Book 82,
Page 35, being bounded and described as follows:
BEGINNING at a comer formed by the intersection of the proposed eastern right-of-
way line of Eastgate Drive and the nortl1ern boundary line of the land now or formerly of Old
Field Partnership as laid out and shown on the Prelin1inary Subdivision Plan of Summerfield
Development as prepared by Statler-Brehm Associates, Inc., dated March 20, 1997; thence.
leaving said place of beginning and said eastern right-of-way line and running with and binding
a portion of the boundary of said Old Field Partnership land, the following courses and
distances, viz: (1) Nortl1 58 degrees 56 minutes 37 seconds East, 360.19 feet to an iron pin
found, and thence (2) South 88 degrees 45 minutes 35 seconds East, 699.41 feet to a corner
formed by the intersection of said Old Field Partnership boundary and an arc with a radius of
400.00 feet, said arc being a portion of a circle centered on the municipal well located on the
land now or formerly of the South Middleton Municipal Authority located adjacent to the said
Old Field Partnership land; thence leaving said Old Field Partnership boundary and running
with and binding on said arc (3) by a line curving to the left in a southerly direction, with a
radius of 400.00 feet, for a distance of 185.61 feet, the arc of which is subtended by a chord
bearing, South 02 degrees 47 minutes 48 seconds West, 183.95 feet to a corner formed by the
intersection of said 400.00 foot arc and the nortl1ern boundary line of a 40.00 foot wide utility
easement as laid out and shown on said Prelin1inary Subdivision Plan of Summerfield
Development and as recorded at the Cumberland County Recorder of Deeds Office in
Miscellaneous Book 499, Page 451; thence running with and binding on a portion of said
40.00 foot wide utility easement, the three following courses and distances, viz: (4) South 86
degrees 53 minutes 16 seconds West, 77.96 feet; thence (5) South 69 degrees 09 minutes 18
seconds West, 402.83 feet; and thence (6) South 73 degrees 46 minutes 39 seconds West,
386.66 feet to a Corner formed by the intersection of the nortl1ern boundary line of said 40.00
foot wide utility easement and the herein mentioned eastern right-of-way line of Eastgate
Drive; thence running with and binding on said eastern right-of-way line the following courses
and distances, viz: (7) by a line curving to the right in a northwesterly direction with a radius
of 470.00 feet for the distance of 30.70 feet, the arc of which is subtended by a chord bearing
Nortl134 degrees 30 minutes 34 seconds West, 30.69 feet; and thence (8) North 32 degrees 38
minutes 19 seconds West, 288.99 feet to the place of BEGINNING.
BEING PART OF THE SAME premises which Old Field Partnership, a Pennsylvania
general partnership, by its Deed dated ,/1/ovemkr /3 ,2000 and intended to be recorded
simultaneously herewith in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania granted and conveyed unto East Gate Seniors Associates, L. P., a Pennsylvania
limited partnership, Owner herein.
