COMPLAINT IN EJECTMENT - PURCHASER AT SHERIFF'S SALF
AND NOW, comes, Washington Mutual Bank, FA, successor to North American
Mortgage Company, ("Plaintiff") by and through its attorneys, Weltman, Weinberg, &
Reis, Co., LPA., and files the Complaint in Ejectment as follows:
1. Plaintiff is Washington Mutual Bank, FA, successor to North American
Mortgage Company, a lending institution duly authorized to conduct business within the
Commonwealth of Pennsylvania.
2. Defendants are James A. Gross, Sr., Kimberly I. Gross, and Terre Tenant,
individuals, residing at 592 Gutshall Road, Boiling Springs, PA 17007.
3. Plaintiff is the equitable owner of the aforesaid premises, having purchased
the premises pursuant to a sheriff's sale duly held in Cumberland County on March 5,
2003. A deed from the Sheriff of Cumberland County to Plaintiff was recorded on
March 18, 2003, Deed Book Volume 256, page 621.
4. Said Sheriff's Sale was authorized under the terms of a foreclosure action
and judgment thereon in the Court of Common Pleas of Cumberland County at No. 01-
4942.
5. Defendants, James A. Gross, Sr. and Kimberly I. Gross, herein were owners
of said property by virtue of a Deed from Michael L. Eppler and Virginia D. Eppler to
James A. Gross, Sr. and Kimberly I. Gross, by deed dated August 10, 1998 and
recorded with the Recorder of Deeds of Cumberland County on August 19, 1998 at
Deed Book Volume 183, Page 819, Parcel No 22-31-2473-004. A description of said
property is attached as Exhibit "A".
6. Defendants have no valid legal right to possession and title to said premises.
7. Plaintiff claims the right to possession of the premises to the exclusion of the
Defendants.
WHEREOF, Plaintiff, Washington Mutual Bank, FA, succesSor to North American
Mortgage Company, seeks judgment for the possession of the aforesaid premises.

distance of 108.31 feet to a point; thence along lands now or
