HANSEN TRUCKING and WARD HOMER ELKINS, Defendants JURY TRIAL DEMANDED COMPLAINT AND NOW, come the Plaintiffs, Donald E. Kramer and Sarah A. Kramer by their attorney, Dale F. Shughart, Jr., and file the following complaint: 1. The Plaintiffs are Donald E. Kramer and Sarah A. Kramer, adult individuals residing at 1209 Center Road, Newville, Cumberland County, Pennsylvania. 2. Defendant David W. Hansen Trucking is a corporation with its offices and principal place of business at 209l W 6400 S, Spanish Fork, Utah 84660. 3. Defendant Ward Homer Elkins is an adult individual residing at Route 3, Box 628, Prices Creek, Burnsville, North Carolina 28714. 4. On March 21, 2000 at about 4:30 a.m. Plaintiff Donald E. Kramer was driving his Ford pick up truck North on 1-81 in Middlesex Township, Cumberland County, Pennsylvania. He traveled down the ramp at Exit 17 to go East on Route 11 and stopped at the stop sign at the intersection with Route 11. 5. At said time and place, Defendant Ward Homer Elkins was driving a tractor trailer owned by Defendant David W. Hansen Trucking in the course of his employment for Defendant David W. II' <h _"- ,- 1 -"'-k". '-'-0'__;_' -,' "C' ,', ~"" ,~ ~'o'~ . Hansen Trucking. 6. Mr. Elkins traveled down the exit ramp and negligently and carelessly collided with the rear of the Plaintiff's stopped vehicle causing the damages hereinafter set forth. 7. Defendant Elkins and Defendant David W. Hansen Trucking, through the conduct of its agent, servant and employee were negligent and careless in: A. Violating the Assured Clear Distance Ahead Rule; 2. Traveling too fast for conditions; 3. Failing to observe the Plaintiff's vehicle in time to avoid a collision; and 4. Failing to have the tractor trailer under control. COUNT I DONALD E. KRAMER v. DEFENDANTS 8. As a result of the negligence and carelessness of the Defendants, Plaintiff Donald E. Kramer sustained an abrasion to the posterior scalp and a sprain of the thoracic spine superimposed on degenerative arthritis. He was taken by ambulance to the Carlisle Hospital where he was treated in the emergency room. 9. As a result of his injuries, the Plaintiff was unable to work at his job at Roadway Express for four weeks and lost wages in the amount of $3,689.60. 10. As a result of his injuries, the Plaintiff also lost profit from his self-employment as a farmer in the amount of $7,150.00. As a result of his injuries, the Plaintiff sustained physical and mental pain and suffering and loss of life's pleasures. WHEREFORE, Plaintiff Donald E. Kramer demands judgment against the Defendants for an amount in excess of $25,000 plus interest and costs of suit. COUNT II SARAH A. KRAMER v. DEFENDANTS 12. The allegations of Paragraphs 1-11 are incorporated herein by reference. 13. Plaintiff Sarah A. Kramer, as the spouse of Donald E. Kramer, sustained a loss of consortium as a result of the injuries to her husband. WHEREFORE. plaintiff Sarah A.
