Dennis E. Major ofl48 I S, Mountain Road, Dillsburg, Pa 17019 is the appellee in this matter, and
is the owner of the damaged rental apartment at 318 West Keller Street, Mechanicsburg, Pa 17055,
Matthew and Kelly Castner of 32 Farm House Lane, Camp Hill, Pa 170 II are the appellants in
this matter, and were the tenants of the damaged rental apartment at 318 West Keller Street, Mechanicsburg
Pa 17055.
The Castners were signatories of a written lease for the period December 15, 1998 to December
14, 1999 and a written extension of that lease for the period December 15, 1999 to December 14, 2000,

The property in qnestion is located at 318 West Keller Street, Mechanicsburg Pa 17055, The
portion leased to the Castners is described as first floor, one bedroom on the second floor and basement.
During a call from Matthew Castner in late June 2000 concerning the late June rent (paid June 22
$400, July 6, $175), he informed me that they would be moving out about July 15, citing financial
difficulties, He also stated that they would pay rent to the end of July, to be fair. He inquired if they could
be let out of the balance of the lease. I replied that they were obligated to pay the full lease, but that I
would not require it in could re-rent the apartment within a reasonable period, i.e. that it be in condition to
show upon their move out, or even prior if prospective tenants wanted to see it. He indicated that he
understood and appreciated that. I subsequently discussed the condition that it would need to be in for
return of their security deposit and relief from paying rent past the month of July, during a walkthrough
visit shortly after Matthew's initial calL I discussed specifically what items needed to be accomplished and
also indicated that, due to the amount of cleaning needed it was unlikely they could have their cleaning
satisfactorily completed before move-out. That lengthened the time it would take me to have another
tenant in, and they relieved from rent obligations. More serious, I pointed ont was the heavily stained
condition of the carpeting. I told them it was very unlikely to be cleanable, in my experience. Ifit were
not, I would have to replace it. I said that, due to the age of the carpet (eight years, plus or minus) 1 would
guess that I would depreciate the carpet about 65 percent and they would be responsible for 35 percent.
Another item discussed was the bathroom door hanging from one hinge, Matthew said he would replace it.
As the projected July 15 move date approached I called to see if that date still obtained, 1 was
informed that the move to his parents was delayed by on-going construction in the basement and it would

be a little longer. I stressed that while I understood, I also had to remind them that it was reducing my time
available to prepare the place for new tenants and thus increasing their financial liability, Several
additional calls were exchanged with the same news; not ready to move. No rent payment for July had
been received as promised.
I spoke with Kelly July 24 and she informed me that they were almost out. She also said that Matt
wanted a written agreement that they had no further financial liability under the lease, I told her that I
would need to see the condition of the apartment after their move and then I would talk to Matt,
On July 25 Matthew called me and said that he wanted a written agreement to be released from
liability. 1 reiterated what I had told Kelly about the need for fmal inspection of condition and that 1 then
could make a determination. 1 brought up that I had yet to receive July's rent and although he had clearly
stated in June that I would be paid, he now insisted that it was his right to use the security deposit as rent.
When I pointed out that that was for security against damage loss, he said that he would pay rehabilitation
costs as needed. He at this point became contentious and I told him nothing would be resolved by
volleying back and forth. I told him that they should finish their moving out and cleanup and I would
inspect the apartment on July 26 or 27; then we would have a known condition and facts to deal with, A
memo of the conversation is attached,
On July 27, 2000 1 inspected the apartment, rough notes attached. The apartment was, in few
words, damaged and filthy. Despite my comments during my walkthrough in late June, conditions were
not improved, and any effort made to clean had yielded no apparent result. I contacted the appropriate
tradespeople to arrange repairs. The following paragraphs will provide detail to explain the invoice 1 wrote
to the Castners on August 23, 2000, copy attached, Pictures were taken, before and after, and are included,
Comments on the charges in the subsequent paragraphs follow the order in the letter to the Castners,
Kitchen Knobs $3,17
As picture shows, two missing knobs and separate trim plates, One knob and plate found in drawer.
Purchase of missing knob only available in 2-pack. Other trim plate is no longer available,
Light Bulbs $7,05
This charge is documented in the packet of receipt copies attached and the inspection notes made during
owner's walk-through on July 27, 2000,
Front Door Mini-Blind $3.76
Damage to blind is shown in photograph, This is the second blind needing replacement during their
tenancy. I requested in January 2000 that they replace its predecessor as it was similarly damaged.
Cleaning Supplies $5.05
These supplies, used by the owner to clean the apartment, are supported by receipt. This cleaning was done
after the painting, carpeting and other repairs were completed. During the hearing before District Justice
Elder, the defendants repeatedly emphasized how much time and effort was expended on cleaning at move
out. Whether true or not, the salient point was; is it now clean? The answer was no, it was filthy and
damaged throughout. The enclosed pictures document that. Witnesses to the condition of the apartment
were two tradespeople, who worked in the apartment just before and just after the Castner tenancy. They
were able to testify at the District Justice hearing as to clean, good order condition before, and the mess
encountered aftelWards. Attached receipts document the dates of their work, bracketing the tennre of the
defendants. These comments, while under the heading of cleaning supplies, will also serve to explain
some of the charges to follow,
Professional Cleaning Service $87,50
This service was performed to expedite the rehabilitation project. The dirt and prints on walls and
woodwork was so extensive that only when cleaned would I be able to determine if cleaning was sufficient
to the need, or wonld repainting be required. This also did two services for the tenant: That which cleaned
up saved the greater cost of paint work, and since cleaning comes before painting, this expedited the
process as I was at that time too bnsy to do the cleaning myself. Therefore reducing the tenant exposure to

further rent liability, Various other items were also cleaned by the service. Note in the photos the broken
moldy eggs and the generally dirty condition of the refrigerator. The picture of the microwave stand shows
the lack of cleaning of surfaces that are easily seen and remedied, During the walkthrough in June 2000 I
asked the Castners, among other things, to clean the inside of the windows, wash curtains, clean blinds, All
showed evidence of the residue of smoking. Again, if they cleaned any of that, it was not apparent. Items
not cleaned by the service included the kitchen linoleum and the tub surround. These items were worsened
during their occupancy, but were ready for replacement. Thus no charge for cleaning or replacing was ever
levied on the Castners.
Professional Painting $180
The living room was painted because of the extensive writing on the wall, obviously by a child, No photo
of this is included as the painting contractor was able to get there a day before predicted and thus it was
painted when I took pictures, These pictures show the painted walls as well as where the painter pulled up
the to-be-replaced carpet to access the trim for coating. The paint contractor, Mr Rodney Whitcomb, told
me that he had to use special sealant to hide the wall graffiti,it was so persistent and extensive. Although
no pictures exist of the damage, Mr Whitcomb testified to it at the DJ's hearing to include the information
that he had painted this room just prior to the Castners moving in and could and did comment that the
apartment was clean, undamaged and orderly as a general observation. The trim painting cited in his
receipt was required due to extensive chipping.
Re-carpet living room, dining room and main bedroom $444
The attached photographs show extensive spotting and spills and discoloration. Note in the living room
pictures that where the carpet is pulled back the huge stained areas on the backing and on the padding,
During the DJ hearing the Castners contended that they were not given the opportunity to clean the carpets,
That is not entirely correct. 1 did say during the June walkthrough that I did believe this level and extent of
damage was not cleanable. I also said that I would depreciate the carpeting 65%, The invoice shows this;
$1,268.56 less 65% equals $444, The opportunity the Castners had to clean this carpet was during 19
months of occupancy, and certainly before the landlord did a wa1kthrough prior to their moveout.
Cleaning Service for Second Bedroom Carpet $28,26
Several stained areas that occurred during their tenancy required professional cleaning. Depreciated 50%.
Owner's Cleaning Time $150
Charged 12 hours oftime for cleanup. It is expected that the landlord will have some cleanup time between
tenants and some fair wear and tear. And of course sometimes people leave it so clean and orderly that
nothing is required but a heart-felt thank you. This is emphatically not the case here; this reflects the need
to clean literally everything, This is a charge for that excess, Note numerous pictures of dirt and disorder.
Also included are "after" pictures to show present state of clean and neat.
Replace Bathroom Door $60
This charge is documented by picture and installer's invoice, This door was new approximately one year
before the Castners moved in.
July Rent Unpaid $575
As cited above, Matthew Castner backed away from his June commitment to pay all of July's rent, in the
July 25 telephone conversation, Although the lease signed by the defendants allows the landlord to
withhold the security deposit as liquidated damages in the event of any breech of the terms of this
agreement, it does not permit use of this deposit as in-lieu-of rent. 1 specifically told Mr Castner that rent
was both due and expected for July 2000.
August Rent Unpaid $575
This charge is to compensate owner for loss of rental income and is in keeping with what was told the
Castners when they asked to be let out of the balance of their lease. The documentation shows that the
apartment was not fit to rent when they moved out and that fairly extensive work was needed. The dates on
the receipts submitted show the owner moved quickly to rehabilitate and to mitigate loss. Nonetheless, the

time to line up and get on the tradesman's schedule, plus showing to prospective tenants consumed the
month of August. The lease, and the negligence ofthe Castners , obligate them to this rent.
Security Deposit Credit -$575
The foregoing is submitted and owner believes it is a full and fair accounting of the Complaint.
The attached NOTICE OF JUDGEMENT, signed by District Justice Elder on November 9, 2000 entered
judgment for plaintiff in the amount of$I,378.52 out of the filed-for $1543.79, Costs were also awarded of
$79.50, for a total award of$1,458.02. Why the Castners desire further adjudication of this matter is
unknown to the Plaintiff. This landlord understands that the Castners are in fmancially straitened
circumstances, but this does not relieve them oftheir fmancial responsibilities, I have on numerous
occasions been lenient with them when late with their rent. Reviewing their record shows that they have
been, in 19 months, late; seven times more than ten days, of that twice more than 20 days and once five
weeks late. I did not charge them a late fee, 1 was patient. Although not requested to, upon movein on
December 15, 1998, I reduced theirlast half of December's rent from $287.50 to $175.
