WHEREAS, David M, Gorski and Cynthia A. Gorski, of l24( Rebert Drive,
Mechanicsburg, Pennsylvania, are about to execute contemporaneously herewith, a contract,
withD CULLY, INC., t/dlb/aC & C Construction, of509 KedronAvenue, Folsom,
Pennsylvania, and 5745 Spring Road, Shermans Dale, Pennsylvania, for construction of a single
family dwelling upon a lot ofland situate at Lot 8, Shuman Drive, Monroe Township,
Cumberland County, Pennsylvania, more fully described in Exhibit A.
NOW, '-/J w' / / , 2000, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Owners
Contractor
to the said Contractor to commence work on the said construction, or purchase materials for the
same in consideration of the making of the said contract with David M. Gorski and Cythia A.
Gorski, and the further consideration of One Dollar to D Cully, Inc., t/dlb/a C & C Construction,
paid by David M, Gorski and Cynthia A. Gorski, it is agreed that no lien shall be filed against the
property by the contractor, or any subcontractor, nor by any of the material men or workmen or
any other person for any labor, or materials purchased, or extra labor or materials purchased for
the construction of a single family dwelling, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN lot or piece of ground situate in Monroe Township, Cumberland County,
Pennsylvania, according to a survey prepared by Stephen G, Fisher, P.L.S., entitled Final
Subdivision Plan for L. Donald Knisely and Carol G. Knisely, dated August 25, 1997, last
revised on November 18,1997 and recorded on December 1, 1997, in the Office of the Recorder
of Deeds of Cumberland County in Plan Book 75, Page 140, being bounded and described as
follows, to wit:
BEGINNING at a Parker Kalon nail set in the center line of Shuman Drive (T -551) at the
dividing line between Lot No. 7 and Lot No.8 of the above referenced subdivision plan; thence
along Lot No.7 South 23 degrees 12 minutes 26 seconds East a distance of 496.61 feet to an iron
pin set at the comer of Lot No.7 and Lot No.8; thence South 67 degrees 25 minutes 59 seconds
West a distance of 175.01 feet to an iron pin set at the comer of Lot No.8 and Lot No.9; thence
North 23 degrees 12 minutes 26 seconds West a distance of 494.65 feet to a Parker Kalon nail set
in the center line of the aforesaid Shuman Drive at the comer of Lot No.8 and Lot No.9; thence
North 66 degrees 47 minutes 34 seconds East along said center line a distance of 175.00 feet to
the point and Place of BEGINNING.
BEJNG designated as Lot No.8 on the above mentioned subdivision plan.
BEJNG part of the same premises which L. Donald Knisely and Carol G. Knisely, husband and
wife, by their deed dated January 21, 1999, and recorded in Cumberland County Recorder of
Deeds Office in Deed Book .J q.3 Page 'O't granted and conveyed unto David M. Gorski
and Cynthia A. Gorski, husband and wife.
