GATES, t/d/b/a GATES BUILDING AND REMODELING, entered into an agreement with MICHAEL SOTAK, JR. and JANE R. SOTAK to furnish labor and materials for the improvement and repair ora house on property owned by MICHAEL SOTAK, JR. and JANE R. SOTAK, husband and wife, TRUSTEES of THE SOTAK FAMILY REVOCABLE TRUST, dated January 12, 2001, now of 161 West Vine Street, Shiremanstown, Cumberland County, Pennsylvania, which property is described as follows: ALL THAT CERTAIN piece or parcel of land situate in the Borough of Shiremanstown, County of Cumberland, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point which is the southeast comer of Lot No. 1-E on the hereinafter mentioned Plan of Lots; which point is also at the dividing line between Lots Nos. 1-D and 1-E on said Plan; thence along said dividing line south 77 degrees 30 minutes 41 seconds west 18.60 feet to a point; thence along the same south 77 degrees 14 minutes 37 seconds west 33.29 feet to a point; thence along the same south 77 degrees 30 minutes 41 seconds west 11.50 feet to a point at the dividing line between the within described lot and certain common area appearing on said Plan; thence along the said last mentioned dividing line north 12 degrees 29 minutes 19 seconds west 20.05 feet to a point at the dividing line between Lots Nos. 1-E and 1-F on said Plan; thence along said last mentioned dividing line north 77 degrees 30 minutes 41 seconds east 11.50 feet to a point; thence along the same north 12 degrees 29 minutes 19 seconds west. 11 of a foot to a point; thence along the same north 76 degrees 51 minutes 37 seconds east 31.29 feet to a point; thence along the same north 12 degrees 29 minutes 19 seconds west .28 of a foot to a point; thence along the same north 78 degrees 16 minutes 35 seconds east 20.97 feet to a point at the dividing line between the within described Lot and certain common area shown on said Plan; thence along said last mentioned dividing line south 11 degrees 26 minutes 00 seconds east 20.36 feet to a point the Place of BEGINNING. 2. In consideration of entering into the contract for improvements and repairs, and other good and valuable consideration, the receipt of which is hereby acknowledged, I hereby waive and release any mechanic's or materialman's lien, or claim or right of such lien, on the described premises and on improvements now or hereafter located thereon and which now exist or might otherwise arise because of the labor or materials furnished or to be furnished by the undersigned pursuant to the agreement described above. 3.
