Defendant, appearing pro se, hereby files Defendant's Response to Plaintiff's
Important Notice as follows:
1. Plaintiff was served Praecipe to Enter Rule to File Complaint and Rule to File on
November 28, 2000 which provided Plaintiff twenty days after the date of service
to file a complaint by personal service or by certified or registered mail.
2. Plaintiff failed to serve Defendant by personal service or by certified or registered
mail within 20 days subsequent to the service.
3. Pursuant to PeffilSylvania Rules of Civil Procedure, Rule 237.1 "Notice of
Praecipe for Entry of Judgment of Non Pros for Failure to File Complaint or by
Default for Failure to Plead" , certification that a written notice of intention to file
the praecipe was requited to be mailed to Plaintiff's attorney of record.
Accordingly, this notice of intention to file the praecipe, entitled "Important
Notice" was mailed to Plaintiff's attorney of record via certified mail, return
receipt requested on January 19, 2001. (Copy attached)
4. Pursuant to Rule 237.1, the entry of non pros is governed by Pennsylvania Rules
ofCivil Procedure 1037(a) and is subject to this rule.
5. PeffilSylvania Rule of Civil Procedure 1037 (a) proscribes that: "If an action is not
commenced by a complaint, the prothonotary, upon praecipe of the defendant
shall enter a rule upon the plaintiff to file a complaint". This praecipe was served
on the plaintiff on November 28, 2000. This praecipe required the plaintiff to file
a complaint within 20 days after the date of service of the rule.

6. Pennsylvania Rule of Civil Procedure 1037 (a) further proscribes that: "If the
complaint is not filed within twenty days after the service of the rule, the
prothonotary, upon the praecipe of the defendant, shall enter ajudglllent of non
pros."
WHEREAS, Plaintiff has not served Defendant in the manner proscribed and
in the time proscribed. Accordingly, and in cornpliance with the Pennsylvania
Rules of Civil Procedure, Defendant expressly requests the Court to enter a
judgment of non pros against Plaintiff and Defendant is attaching Defendant's
certification that a written notice of intention to file the Praecipe for Entry of
Judgment of Non Pros For Failure to File Complaint which was rnailed to the
Plaintiff's attorney via US mail and certified mail, return receipt requested on
January 19, 2001.

Defendant, appearing pro se, hereby files Defendant's Response to Plaintiff's
Important Notice as follows:
1. Defendant received Plaintiff's Irnportant Notice on January 17, 2001.
2. Plaintiff's Important Notice advised Defendant that Defendant is in
default because Defendant failed to file in writing with the court
defenses or objections to the claim set forth in the complaint served on
the Defendant on December 15, 2000.
3. Defendant was never served with a cornplaint in the matter of Docket
No. 00- 8294 and has no knowledge of such a cornplaint.
4. Plaintiff sued Defendant in District Justice Court and judgernent was
entered for the Plaintiff on October 30, 2000.
5. Defendant timely appealed and served Plaintiff Notice of Appeal and
Praecipe to Enter Rule To File Cornplaint and Rule to File on November
28, 2000. (Exhibit attached)
6. Defendant served Plaintiff with Notice of Appeal and Praecipe to Enter
Rule To File Cornplaint and Rule to File via certified mail- return receipt

Plaintiff that a rule had been entered for Plaintiff to file a cornplaint in

MEMORANDUM OPINION AND ORDER
In this case the defendant appealed from an adverse ruling by a district justice. She
praeciped for a rule on the plaintiff to file a complaint within twenty days. The plaintiff did, in
fact, file a complaint within the twenty-day period and mailed a copy of it to the defendant by
ordinary mail. It is the defendant's position that she should have been served with the complaint
by personal service or by certified or registered mail. Believing that she had not been properly
served, she filed a praecipe for entry of judgment of non pros against the plaintiff. This praecipe
has been treated as a motion, which we now deny.
The rules governing appeals from district justices provide that the notice of appeal must
be served by personal service or by certified or registered mail. The same rule providing for
such service, Pa.R.C.P .D.J. 1005(D) provides expressly that where a complaint is filed in
response to an appeal, service shall be made "upon the opposite party in the appeal by leaving a
copy for or mailing a copy to him at his address as shown hint in the district justice records. . ."
No mention is made of "registered" or "certified" mail let alone of personal service.

Because the defendant's position in this case is so obviously wrong, the plaintiff has
sought counsel fees under 42 Pa.C.S.A. 2503(7). While the defendant's approach to the rules of
procedure borders on insouciance, we are not prepared to conclude that her conduct in this
litigation has been dilatory, obdurate or vexatious.

Reply to averments of Defendant's Answer which are incorporated by reference as
paragraphs 11. of Defendant's New Matter:
1.-2. No reply required.
3. Denied. The events which allegedly preceded the written agreement of August 18,
1995 are irrelevant and immaterial, and are barred by the parol evidence rule. Plaintiff moves
these averments be stricken and disregarded by the fact-finder. It should be noted that Defendant
does not deny that she prepared the subject agreement, and that she signed the agreement.
4. No reply required.
5. Denied. In reply to the first sentence of paragraph 5, Defendant sought and
obtained Plaintiffs permission to defer monthly payments, with the understanding that interest
would accrue on the unpaid balance at the rate prescribed by the agreement. The remaining
averments of paragraph 5. are scandalous, impertinent and irrelevant in their entirety and Plaintiff
moves that they be stricken and that all of such averments be disregarded by the fact-finder.
6. Denied. Defendant did nothing about repayment of the loan until demand was
made by Plaintiff. It is admitted, however, as pleaded in the Complaint, that Defendant repaid

the principal amount of the loan on August 8, 1997. The remaining averments of paragraph 6
of Defendant's Answer are scandalous, impertinent and irrelevant, and Plaintiff moves that they
be stricken and disregarded by the fact-fmder.
7. Denied. The averments of paragraph 7 are denied, except it is admitted that
Defendant repaid the principal in a lump sum. Plaintiff demanded interest in the amount pleaded
in the Complaint. Plaintiff did not agree to have a bank compute the interest due and did not
agree with the subsequent "computation" presented by Defendant which had allegedly been
prepared, albeit incorrectly, by an unnamed bank. Defendant was so notified, both orally and in
writing.
8. Denied. In reply, the averments of the Complaint, and particularly paragraphs 7
through 10, are incorporated by reference.
9. Denied. Each and every allegation of paragraph 9 of Defendant's Answer is
denied, and to the contrary, paragraph 7, above, and paragraphs 7 through 10 of Plaintiffs
Complaint are incorporated by reference.
10. Denied. Paragraph 10 of Defendant's Answer pleads a conclusion ofIaw to which

13. Denied. Paragraph I3 in its entirety avers impertinent, scandalous and irrelevant
matters which Plaintiff moves be stricken and disregarded by the fact-finder. Insofar as said
paragraph attempts to assert a claim against Plaintiff for monetary damages, these conclusory
averments do not constitute a proper construction, nor are they correctly pleaded; Defendant thus
fails to state any claim upon which relief can be granted. In the alternative, each and every
allegation of paragraph 13 is denied and placed at issue, and strict proof demanded if material
and relevant. It is further denied that Plaintiff has any liability to Defendant as to the alleged

1. Admitted.
2. Admitted with correction. Defendant resides at 79 Green Ridge Road.
3. Denied. On or about May 20, 1995, Plaintiff and Defendant had a verbal
agreement and Plaintiff loaned Defendant $27,000.00. At the time of the loan,
Plaintiff and Defendant's verbal agreement included an agreement of 6.0%
interest. Between May and August 1995, Defendant provided Plaintiff with a
draft contract that included an interest rate of 6.5% and Plaintiff signed the
contract on August 18, 1995.

5. Denied. Defendant attempted to make monthly payments and Plaintiff advised
Defendant that she was in no hurry to collect the loaned monies. Plaintiff waived
monthly payments because Defendant had a romantic relationship with Plaintiff's
son, Mr. David S. Kretzing and Mr. Kretzing was living with the Defendant. Mr.

Kretzing was not making much of an income and Plaintiff was loaning and gifting
her son with money to cover some of his living expenses. Because Plaintiff knew
that her son was not paying his share of his living expenses to the Defendant and
Defendant was taking care of her son, Plaintiff told Defendant that she wanted to
ease Defendant's financial burden and advised her that she could pay the loan off
at a later, undefined date when she and Mr. Kretzing were more financially
secure.
6. Denied. Plaintiff never demanded repayment from Defendant, as set forth above.
Defendant and Mr. Kretzing terminated their relationship in mid July of 1997.
Two days after this termination, Defendant telephoned Plaintiff to advise her of
the "break up" and that she would immediately make arrangements to pay the
loan. Defendant then surrendered her 401 K and secured a loan in the amount of
$27,000.00 and on August 8,1997, Defendant paid the entire principal of
$27,000.00

Denied. Plaintiff never demanded (and therefore could not further demand) an
interest payment or a specified value to the interest payment. Plaintiff had
advised Defendant that she did not have to make any monthly payments, and
Defendant paid the principal in one lump sum. Because monthly payments were
not made, Plaintiff and Defendant agreed to have a bank compute the interest
due. Defendant requested a bank to compute this amount and presented the
schedule to the Plaintiff. Both parties agreed to the amount that the bank
calculated and Defendant paid that amount.

9. Denied. Plaintiff did not call any computation error, or any error to Defendant's
attention. Therefore, Defendant was never in a position to refuse or persist in a
refusal to pay any balance due. Plaintiff asked Defendant to have a bank
detennine the amount owed and had approved of the amount and accepted the
interest that Defendant paid. Plaintiff never advised Defendant that the interest
payment was unacceptable, incomplete, inaccurate or in any other way wrong or
in error. Because Plaintiff did not advise Defendant that she wanted more money,
Plaintiff cannot now come to the Court and demand more money.
10. Denied. Because Plaintiff is not entitled to a balance due on interest, she is not
entitled to interest accruing from August 8,1997.
WHEREFORE, the Defendant requests this Honorable Court to enter judgment in
favor of the Defendant and against the Plaintiff and dismiss the Complaint.
NEW MATTER
11. The factual averments set forth in the responses in Paragraphs 1-10, above are
incorporated hereof as if set forth at length.
12. Plaintiff's filing of this action is frivolous and constitutes independent legal
harassment as well as on-going legal harassment and is designed for the sole
purpose of causing economic loss to the Defendant. Plaintiff and Defendant had a
close personal relationship. Plaintiff loaned Defendant a large sum of money
because they had such a close relationship and because Defendant was taking care

of Plaintiff' s son. Plaintiff did not want to accept Defendant's monthly loan
payments until Defendant and Plaintiff's son had more financial stability.
Defendant provided and Plaintiff accepted a mutually agreed upon dollar amount
that represented 6.5 % interest on August 11th of 1997. This rate of interest was
0.5% more than what Plaintiff and Defendant had initially agreed. Plaintiff never
telephoned or wrote to Defendant to advise her that either the amount she
accepted was unacceptable or that she wanted more money. Three years after
Plaintiff accepted payment and three days before the statute of limitations had
run, Plaintiff filed a civil complaint.
This complaint is the third legal action taken by Plaintiff and her son against the
Defendant in retaliation for the Defendant terminating a romantic relationship and
ceasing to provide financially for the Plaintiff's son. The first legal action was
withdrawn by the Plaintiff's son. The second legal action is pending.
13. Plaintiff's filing of this action constitutes intentional infliction of emotional
distress and contributes to the demonstration of a pattern of intentional infliction
of emotional distress. Plaintiff's willful conduct sought in retaliation because
Defendant is no longer taking care of Plaintiff' s son has caused Defendant great
mental and emotional pain, suffering, embarrassment, anxiety, humiliation,
inconvenience, and distress, for which monetary damages are also demanded.

COMPLAINT
1. The Plaintiff is Mary Jane Kretzing, an adult individual residing at 6940 Carlisle Pike,
New Kingstown, Cumberland County, Pennsylvania 17072.
2. The Defendant is Deborah M. Lessard, an adult individual residing at 70 Green Ridge
Road (Silver Spring Township), Mechanicsburg, Cumberland County, Pennsylvania 17050.
3. On or about May 20, 1995, pursuant to the terms of a written agreement prepared by
Defendant, Plaintiff loaned Defendant the cash sum of Twenty-Seven Thousand Dollars ($27,000.00).
A copy of said written agreement is appended hereto and incorporated by reference as Exhibit "A".
4. The agreement provided for interest on the loan at the rate of 6.5%, for repayment in
monthly payments beginning on October 1, 1995, and that the term of the loan was two years, with
"maturation date" of May 19, 1997.
5. During the term of the loan, Defendant made no monthly payments to Plaintiff on account
of principal or interest, nor did she make any repayment on the aforesaid maturation date.
6. After demand by Plaintiff, Defendant repaid the entire principal of $27,000 to Plaintiff
on August 8, 1997.
7. Upon further demand by Plaintiff, Defendant paid Plaintiff interest in the sum of
$2,095.27, leaving interest unpaid and still due Plaintiff in the sum of $1,804.20. The total interest at

6.5% due on the loan of $27,000 from May 20, 1995 until August 8, 1997, a period of 811 days, was
in the sum of $3,899.47.
8. When Plaintiff demanded the balance of the interest due, Defendant incorrectly cited an
amortization table for her computation of the amount due, which computation did not recognize the fact
that the table contemplated monthly reductions of principal, which had not occurred.
9. Although this computation error was called to Defendant's attention, she refused, and still
persists in such refusal, to pay the balance of interest on the aforesaid loan to which Plaintiff is justly
entitled.
10. Plaintiff also claims interest at the legal rate of six percent (6%) on the aforesaid sum of
unpaid loan interest, computed from August 8, 1997 and thereafter until Plaintiff is satisfied in full.
WHEREFORE, Plaintiff demands tht judgment be entered in her favor and against the Defendant
in the sum of $1,804.20 together with interest thereon computed at the legal rate of 6% from August 8,
1997 until Plaintiff is satisfied in full, the total sum demanded thus requiring referral of this action for
trial by compulsory arbitration.

AGREEMENT
I. PARTIES This agreement is made between MARY JANE KRETZING and
DEBORAH LESSARD for a loan.
2. AMOUNT Mary Jane Kretzing has loaned Deborah Lessard and Deborah Lessard
agrees to pay the amount of the loan twenty seven thousand dollars and no cents ($27,000.00)
and 6.5% interest.
3. TERM The term of the loan is for two years. The loan was made 5/20/95.
Maturation date of the loan is 5/19/97. Monthly payments are to be determined by Deborah
Lessard and approved by Mary Jane Kretzing.
A It is agreed that monthly payments will begin 10/1/95.
4. DEF A UL T Default is defined at maturation. If the entirety of the principal and interest
is not paid by 5/20/97, the loan will be considered to be defaulted.
5. LAW The governing jurisdiction and application oflaw is Pennsylvania.
6. PRIOR AGREEMENTS This document supersedes all prior agreements, including
but not limited to gift agreements.

seen in this light, you will be able to make a settlement with
Mary Jane. She needs the money for closing costs on the Sun
City house.
She has shown me the card you gave her on August 8. She regrets
deeply being so distracted that she did not give it the courteous
reception that she should.
We have both puzzled over your comment. about anger. If you were
the one to terminate your relati'onship with Dave, we wonder
what you are angry about. If she had understood that, she might
have shown you the concern you expected.

I am fiance and advisor to Mary Jane Kretzing.
We have a misunderstanding with your client, Deborah Lessard,
over the interest due on a two-year $27,000 note at 6.5% given
by Mary Jane on May 20, 1995, copy attached. The loan was made
to enable Debrah to make the down-payment on a farm at 79 Green
Ridge Road, Mechanicsburg.
I understand she is your client in that she borrowed the money
from you to repay this note.
She claimed that you advised her to pay interest based on a
27 month amortization schedule, copy attached. Accordingly,
her payment on interest, which she made August 13, 1997, was
only $2,095.27. But no payments at all had been made until August
8, 1997, when the principle was paid in full.
I am confident that current business practices would interpret
the terms of her note to be with interest compounded monthly
on the entire $27,000 until the first (and only) payment on
principle was made, and the amount due should have been
$4,239.78.
Even at simple interest, the amount due would be: 2.219 years
X .065 X $27,000 = $3,894.35, or $1,800 more than she paid.
Of course, some additional interest should be accruing on the
interest owed, whatever that is.
Would you, in the light of these facts, please determine the
correct interest due?
Ms Lessard has been given an advance copy of the essence of
this inquiry and has adamantly refused to negotiate or even
to communicate with us in any way. Therefore,' it will not be
possible for me to forward your determination to her. Still,
in fairness, I would ask that you send her a copy of your reply
so that, if this must go to Small Claims Court, she will not
be surprised.

To date I have honored your request not to contact the Loan
Officer at CoreStates Bank who you said told you how to compute
the interest owed Mary Jane. You should know that I have a degree
in Business Administration with graduate work in Economics:
I understand interest, but I don't'understand the application
of an amortization schedule to a lump sum payment. Mary Jane
is entitled to an explanation, and I will get it for her.
I can't believe what I have been told about your conversion
of Mary Jane's property. That would be theft, and I'm confident
you are too honorable and intelligent for that. Yet I did see
the letter that you returned to her unopened, signifying an
unwillingness to negotiate. I can't imagine why.
She is now convinced that you will not even allow her to recover
her Kanaga House Christmas decorations. If true, that would
be the most Dog-in-the-Manger and Grinch-like act that I have
ever seen.
You said that your relationship with Dave would not affect your
relationship with Mary Jane. What happened?
what do you want from her? Tell me and I'll try to reason with
her.

AGREEMENT
I. PARTIES This agreement is made between MARY JANE KRETZING and
DEBORAH LESSARD for a loan.
2. AMOUNT Mary Jane Kretzing has loaned Deborah Lessard and Deborah Lessard
agrees to pay the amount of the loan twenty seven thousand dollars and no cents ($27,000.00)
and 6.5% interest.
3. TERM The term of the loan is for two years. The loan was made 5/20/95.
Maturation date of the loan is 5/19/97. Monthly payments are to be determined by Deborah
Lessard and approved by Mary Jane Kretzing.
A. It is agreed thatmontWy payments will begin 10/1/95.
4. D EF A UL T Default is defined at maturation. If the entirety of the principal and interest
is not paid by 5120/97, the loan will be considered to be defaulted.
5. LA W The governing jurisdiction and application of law is Pennsylvania.
6. PRIOR AGREEMENTS This document supersedes all prior agreements, including
but not limited to gift agreements.
