HARMAN, single woman, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Hampden Township, Cumberland County, Pennsylvania, more particularly described in attached Exhibit "A", also referred to as 5803 Stephen's Crossing, Mechanicsburg, Pennsylvania. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($l,OO) Dollar to KEELEY AND COMPANY in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, cOvenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. our hands and seals this as..d day of ~, WITNESS 2000, Signed, Sealed and Delivered in the Presence of (Seal) (Seal) KEELEY Se&ureJ. t.-.J p-/~8crll / , 'i' ~." ;r , tr';' EXHIBIT "A" ALL THAT CERTAIN lot or tract of land, situate in Township of Hampden, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the southern line of Stephen's Crossing, at the eastern line of Lot #90 on the hereinafter mentioned Plan; thence along the southern line of Stephen's Crossing, South 54 degrees 46' 09" East, 96.58 feet to a point; thence along a culdesac of Stephen's Crossing, by a curve to the right having a radius of 20.00', an arc distance of 19.64 feet to a point; thence continuing along Stephen's Crossing, by a curve to the left, having a radius of 70.00', an arc distance of 83.26 feet to a point at the western side of Lot #57; thence along the line of said Lot, South 23 degrees 20' 11" West, 88,40 feet to a point; thence North 54 degrees 46' 09" West, 204.06 feet to a point at the eastern line of Lot #90; thence along the eastern side of Lot #90, North 35 degrees 13' 51" East, 125.00 feet to a point at the southern line of Stephen's Crossing, the point and Place of BEGINNING, CONTAINING 21,613.32 square feet.
