WHEREAS, Shughart Custom Homes, Inc., of 337 West Old York Road, Carlisle,
Cumberland County, Pennsylvania 17013, has executed a contract with Shughart Custom
Homes, Inc., of 337 West Old York Road, Carlisle, Cumberland County, Pennsylvania 17013,
for the erection of a residential dwelling upon a tract of land situate in Dickinson Township,
Cumberland County, Pennsylvania, more particularly described in the deed of Linwood B.
Phillips, widower, dated November 28, 2000, and recorded in the Office of the Recorder of
Deeds for Cumberland County, Pennsylvania in Deed Book&t:3J, Page:3ll, and being Lot 16,
Subdivision for Clarendon (Plan Book 77, Page 56), located on the Linden Drive East, Carlisle,
Pennsylvania 17013.
NOW, November 28, 2000, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owners to the said
Contractor to commence work on said building, or to purchase materials for the same in
consideration of the making of the said contract with the said Contractor and the further
consideration of the sum of One and no/100 ($1.00) Dollar to Contractor paid by said Owners, it
is agreed that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor or materials
purchased or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.
WITNESS our hands and seals the day and year aforesaid.
