for the erection of a Free Stall Barn building upon a lot of land situate
on two tracts of land containing 133 acres, more or less, and lying in Southampton Township, Cumberland
County, Pennsylvania, and more particularly described in a deed dated April 5, 2001. The said deed being
recorded in Deed Book 242 Page 411. Reference is hereby made to said deed for a more particular
description as contained in said deed. The description contained in said deed is incorporated herein
by reference as if same were textually contained herein.
NOW, October 4th, 2001 , at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said John B. Noir
to the said John Stoltzfus to commence work on the said building, or pumhase materials
for the same in consideration of the making of the said contract with John Stoltzfus
and the further consideration of One Dollar, to John Stoltzfus
paid by John B. Nolt , it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or
materials purchased for the erection of said building, the right to file such liens being expressly waived.
