Vioral and Robbin L, vi oral , by and through their attorney, Diane G. Radcliff, Esquire, and files this Complaint against the above referenced Defendant whereof the following is a statement: 1, The Plaintiffs are Eric L. Vi oral and Robbin L. Vioral, adult individuals who are husband and wife and residing at 249 H. Street, Carlisle, Cumberland County, Pennsylvania. 2. The Defendant is Donald R, Barrick, an adult individual residing at 931 Hamilton Street, Carlisle, Cumberland County, Pennsylvania. 3, On or about July 23, 1999, The Plaintiff and the Defendants entered into a contract for the purchase and sale of real estate (hereinafter referred to as "the Real Estate Contract") wherein the Plaintiffs agreed to purchase and the Defendant agreed to sell for a purchase price of $80,000.00 that certain tract of improved real estate known and numbered as 249 H, Street, Carlisle, Cumberland Pennsylvania, County, (Hereinafter referred to as "the Premises"), A true and correct copy of the Real Estate Contract is attached hereto, -2- DIANE G. PA 17011 (717) 737,0100 _;1 ,,_ '-I ~' - I, __~ , ~ " _ ,~ ,_, " ~';,',~ ~'~" 4, As part of this real estate transaction, the Defendant provided the Plaintiffs with a Property Disclosure Statement (hereinafter referred to as the "Disclosure Statement") which he had signed on January 10, 1999, in which he represented certain matters pertaining to the condition of the Premises, A true and correct copy of the Disclosure Statement is attached hereto, marked Exhibit "B" and made a part hereof. 5, Settlement on the Real Estate Contract was held on September 24, 1999, on which date deed title in fee simple to the Premises was transferred by the Defendant to the Plaintiffs, 6. As part of the overall transaction, including, but not limited to, oral statements made by the Defendants, the Real Estate Contract and the Disclosure Statement, the Defendant's represented and/or warranted to the Plaintiffs, and/or their agents, either expressly or impliedly by his words, written statements, actions and/or omission, the following: a. There was no water leakage in the basement of the Premises; b. There was no past or present movement, shifting, deterioration, or other problems with the foundation, walls or other structural components of the Premises; c, There was no fill on the Premises; d, There were no environmental concerns regarding the Premises, including, but not limited to, improperly buried building materials and the like; and e. ',"h' the Defendant aforesaid to be true, and on faith thereof, completed settlement on the purchase of the real estate on September 24, 1999 and paid to the Defendant the sum of $80,000.00 representing the purchase price for the Premises set forth in the contract, 8. The Plaintiff has the words, since ascertained that statements, actions and representations of the Defendant aforesaid made by him, or the omission in making such statements or disclosures, were false and untrue and were made with the intent to cheat and defraud the Plaintiff, and were untrue in the following particulars: a. There had been flowing water in the basement which had caused the ground under the floor of the basement to erode; b, The porch had been installed in an improper manner so that the foundation blocks supporting the porch floor became crushed causing the porch to pull away from the house; c. Shingles and other building materials were buried in the yard by the Defendant 9. None of the foregoing conditions were readily apparent to the Plaintiffs nor capable of being discovered by them upon a reasonable investigation at the time they signed the Real Estate Contract or at the time they settled on the purchase of the Premises, 10, The foregoing conditions were and are material defects in the Premises, 11. The Plaintiff was induced to enter into the contract for the purchase of the Premises based on the fraudulent or negligent representations and/or omission of the Defendant aforesaid. 13. The lack of water in the basement, structural soundness of the walls, foundation and other structural components and the lack of improperly buried building materials were a material part of the contract between the parties. 14. As the result of the fraudulent or negligent representations and/or omissions of the Defendant, the Plaintiffs have been or will be forced to incur costs to repair the home in the amount of $6152,00 to $6,880.00 as evidenced by the repair estimateS attached hereto, marked Exhibit "C" and made a part hereof, 15, The Plaintiff has demanded payment of the said repair costs from the Defendant but the Defendant has failed or refused to make such payment. I have 14 years experience in the concrete construction field, I have inspected the property located at 249 H Street in Carlisle, These are my professional opinions on the items listed below, The basement floor area has existing holes letting ground water come up through the floor. You can visibly see where the floor had a trough or drain system cut in it. This was for some type of water problem they had at one time or another. This was poorly patched to fill in the trough or drain. The ground water still comes up through these areas when ground water is present. Old block wall is in very bad shape and is starting to crack and fall over, You can visi- bly see shingles, old carpet, cans and other items of trash, These items were used for fill be- tween the house anej block wall. All this fill and trash needs to be removed and hauled to an approved landfill area. Front porch was not built to carry the load of the porch roof, that was built on the con- crete front porch. The block is in very poor condition and has settled an excessive amount. The block settling is causing the front stonework on the house to crack and brake, The front porch roof needs jacked up and supported, Then the existing concrete front porch should be removed.
