Contractor
Whereas, Richard C. Kalbach and Denise L. Kalbach, his wife, of 1106 East Powderhorn Road,
Mechanicsburg, Cumberland County, Pennsylvania, are about to execute contemporaneously herewith, a
contract with J.W. Mumper Construction, Inc., of I Bull Run Court, Mechanicsburg, Cumberland County,
Pennsylvania, for the erection of a dwelling house upon a lot of land situate in Silver Spring Township,
Cumberland County, Pennsylvania, being known as Lot No. 22, Final Subdivision Plan for Hillside Farms-
Phase II, as recorded in Cumberland County Plan Book 81, Page 67, and as more fully described in Deed
recorded in Cumberland County Deed Book 232, Page 903, to wit:
BEGINNING at a point on the eastern right-of-way line of the cul-de-sac of Man ass as Court, at the southern
comer of Lot No. 23 on the hereinafter described Final Subdivision Plan; THENCE along the southern line of
said Lot No. 23 North 60 degrees 10 minutes 33 seconds East a distance 001.92 feet to a point on the western
line ofland nff Cumberland Valley School District; THENCE along the western line of said School District
land, South 29 degrees, 49 minutes 25 seconds East a distance of306.94 feet to a point at the northernmost
comer of Lot No. 18 on the hereinafter described Final Subdivision Plan; THENCE along the northern line of
said Lot No. 18 and continuing along the northern line of Lot No. 19 on the hereinafter described Final
Subdivision Plan, South 60 degrees 10 minutes 33 seconds West a distance of287.0 I feetto a point; THENCE
continuing along the northern line of said Lot No. 19 North 77 degrees, 06 minutes, 55 seconds West a
distance of 59.00 feet to a point at the southeast comer of Lot No. 21 on the hereinafter described Final
Subdivision Plan; THENCE along the eastern line of said Lot No. 21 North 7 degrees, 29 minutes, 22 seconds
East a distance of240.61 feet to a point on the southern right-of-way line of Man ass as Court; THENCE along
the southern right-of-way line of Manassas Court by a curve to the left having a radius of95.00 feet, an arc
length of 211.09 feet to a point at the southern corner of Lot No. 23 on the hereinafter described Final
Subdivision Plan, the point and place of BEGINNING.
Now, November 29,2000, at the time of and immediately before the execution of the principal contract, and
before any authority has been given by the said Owners to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with them and
the further consideration of one Dollar, to Contractor paid by Owners it is agreed that no lien shall be filed
against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any
other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived. Witness, our hand and seals the day and year
