COMPLAINT
AND NOW COMES the Plaintiff, Snoke's Excavating & Paving, Inc.,
by and through its attorney, John J. Baranski, Jr., Esquire, and
makes this complaint against the Defendant and in support thereof
avers the following:
1. That Plaintiff is Snoke's Excavating and Paving, Inc. a
business incorporated under the laws of the Commonwealth of
Pennsylvania with it principal place of business at P.O. Box 247
Walnut Bottom, Cumberland County, Pennsylvania 17266-0247.
2. That Defendant is GCW Properties, Inc., a business
incorporated under the laws of the Commonwealth of Pennsylvania,
with its principal place of business at 96 South George Street,
York, York County, Pennsylvania 17401.
3. That at the special instance and request of the
Defendant, Plaintiff performed certain services at the Indian
Springs construction site, South Hampton Township, Cumberland
County, Pennsylvania, and sold to Defendant the goods and
merchandise at the time or times, of the kind or kinds, in the
quantities and for the prices as are set forth in the statements
submitted to Defendant. A true and correct copy of each is
attached hereto and made a part hereof by reference, and marked
as Exhibits "A-I" respectively.
4. That the prices set forth in Exhibits "A-I" are fair,
reasonable and the market price for said services, goods and
merchandise.

5. That the Defendant agreed to pay said prices.
6. That all credits, if any, to which Defendant is
entitled to have been deducted from the amount owed to Plaintiff.
7. That written demand for payment has been made upon the
Defendant both by Plaintiff and by the undersigned.
8. That Defendant has failed and continues to fail to make
payment of the amount due as shown in the above, which was
$13,298.20 on March 31, 2000.
9. That Payment in full was due not later than April 30,
2000.
10. That Defendant has failed to make payment and interest
has accrued on the unpaid balance for 7 months to November 30,
2000 in the amount of $465.44.
WHEREFORE, there is due and owing from the Defendant to the
Plaintiff the sum as of November 30, 2000 of $13,763.64, which
said sum does not exceed the jurisdictional amount for compulsory
arbitration in Pennsylvania, for which Plaintiff demands judgment
against the Defendant, together with continuin
costs of suit.
