PETITION FOR WAIVER OF THE PUBLICATION REQUIREMENTS OF
CUMBERLAND COUNTY RULE OF PROCEDURE 5
The Petitioner, Tamika La'Shelle O'Neal, by her attorneys, the Family Law Clinic,
hereby petitions this Honorable Court to enter an Order waiving the requirements of
publication set out in C.C.R.P. 5, and respectfully represents that:
1. The Petitioner is Tamika La'Shelle O'Neal, who lives at 316 North West Street,
Carlisle, Cumberland County, Pennsylvania, 17013.
2. Concurrent with the filing of this Petition, Petitioner is fIling a Petition for Name
Change on behalf of her minor children, Romeo Xavier Duncan, born August 20, 1995, in
Harrisburg, Dauphin County, Pennsylvania, (hereinafter "Romeo"), and J'Quan Maurice
Duncan, born March 3, 1999, in Carlisle, Cumberland County, Pennsylvania, (hereinafter
"J'Quan").
3. Rule 5 of the Cumberland County Rules of Procedure requires that a petitioner in a
name change case give notice of the filing of the petition and of the hearing thereon by
publication in two newspapers.
4. Rule 5 also requires that such notice be given to the non-petitioning parent of a
minor child.
5. Because of their young ages, Romeo and I'Quan are legally incapable of contracting
debts or incurring liability for torts.
6. Petitioner has a limited income and substantial debt. Accordingly, it would be a
financial hardship on Petitioner to pay for the cost of publication.
7. Romeo and I'Quan's biological father, Len Dell Waters, and Petitioner's ex-
husband whose name the children carry, James C. Duncan, Jr., who are the only other
interested parties in this matter, will be served by U. S. mail, certified, restricted delivery ,
return receipt requested, postage prepaid.
8. James C. Duncan, Jr. has consented to this name change of Romeo and I'Quan. A
copy of his Consent to Name Change is attached as Exhibit A and incorporated herein by
reference.
9. Len Dell Waters has consented to this name change of Romeo and J'Quan. A copy
of his Consent to Name Change is attached as Exhibit B and incorporated herein by reference.

The Petitioner, Tamika La'Shelle O'Neal, by her attorneys, the Family Law Clinic,

from Romeo Xavier Duncan and J'Quan Maurice Duncan to Romeo Xavier Waters and I'Quan
Maurice Waters, and respectfully represents that:
I. The Petitioner is Tamika La'Shelle O'Neal, who lives at 316 North West Street,
Carlisle, Cumberland County, Pennsylvania 17013.
2. Petitioner is the biological mother of Romeo Xavier Duncan (hereafter "Romeo"),
who was born on August 20, 1995, in Harrisburg, Dauphin County, Pennsylvania. Romeo's
social security number is 176-76-8614. A copy of Romeo's birth certificate is attached as
Exhibit A and is incorporated herein by reference.
3. Petitioner is also the biological mother of J'Quan Maurice Duncan (hereafter
"J'Quan"), who was born on March 3, 1999, in Carlisle, Cumberland County, Pennsylvania.
I'Quan's social security number is 190-78-5842. A copy of J'Quan's birth certificate is
attached as Exhibit B and is incorporated herein by reference.
4. Since April, 1996, Romeo has lived with Petitioner at 316 North West Street,
Carlisle, Cumberland County, Pennsylvania 17013.
5. Since his birth, J'Quan has lived with Petitioner at 316 North West Street, Carlisle,
Cumberland County, Pennsylvania, 17013.
6. Romeo and J'Quan's biological father is Len Dell Waters, who lives at 2719 North

7. Romeo and 1'Quan were given the last name of Duncan because that was the
Petitioner's last name at the time of their births. At the time of the children's births,
Petitioner was married to, but separated from, her then husband, James C. Duncan, Jr..
Petitioner later divorced Mr. Duncan, who resides at 95 N. 64th Street, Harrisburg, Dauphin
County, Pennsylvania 1701l.
8. Petitioner is also the mother (by James C. Duncan, J r.) of Cheyanna Duncan, born
May 30, 1989, and Brandon Duncan, born June 12, 1990, who are Romeo and 1'Quan's half
siblings. Cheyanna and Brandon live with the Petitioner and Romeo and 1'Quan.
9. Petitioner avers that it is in the best interest of Romeo and l' Quan to have their last
names changed from Duncan to Waters, because:
a) Len Dell Waters is the biological father of Romeo and 1'Quan and plays an active
role in their lives.
b) James C. Duncan, Jr., does not claim to be the biological father of Romeo or
1'Quan. He does not play an active role in their lives.
c) Romeo and 1'Quan should have the last name of their biological father.
d) Petitioner has changed her name from her married name of Tamika La'Shelle
Duncan to her maiden name of Tamika La'Shelle O'Neal, so Romeo and 1'Quan will
not have the same last name as their mother, whether they continue to use the name
Duncan or change their last name to Waters.
e) James C. Duncan, Jr. has consented to this name change of Romeo and 1'Quan. A
copy of his Consent to Name Change is attached as Exhibit C and is incorporated
herein by reference.
f) Len Dell Waters has consented to this name change of Romeo and 1'Quan. A copy
of his Consent to Name Change is attached as Exhibit D and is incorporated herein by
reference.

PETITION FOR CONTINUANCE
The Petitioner, Tamika La'Shelle O'Neal, by her attorneys, the Family Law Clinic,
hereby petitions tbis Honorable Court to grant a continuance of the hearing in this matter,
currently scheduled for February 14,2001 at 2:30 pm. In support of her petition, Petitioner
represents as follows:
1. The Petitioner is Tamika La'Shelle O'Neal, who lives at 316 North West Street,
Carlisle, Cumberland County, Pennsylvania, 17013.
2. Petitioner is the biological mother of Romeo Xavier Duncan and J'Quan Maurice
Duncan.
3. On December 12,2000, Petitioner filed a Petition For Name Change with tbis
Court, requesting an Order changing the names of her two cbildren pursuant to 54
Pa.C.S. ~701.
4. Since the date of filing the Petition, Petitioner has cortnnunicated with the
Department of Health, and believes that she will be able to change the names of
her minor sons administratively, without the need for a hearing.
5. Romeo and J'Quan's biological father, Len Dell Waters, and Petitioner's ex-
husband (whose name the cbildren. currently carry), James C. Duncan, Jr., are the
only other interested parties in tbis matter. Both have previously consented to the

name changes and have been notified that Petitioner intends to request a
continuance in this matter.
6, On January 18,2001, the Family Law Clinic sent a letter and consent form to both
Len Dell Waters and James C, Duncan, The letters, which are attached to this
Petition as Exhibit A, asked both men whether they would consent to a
continuance of the hearing in this matter, Neither has responded to the January 18,
2001 letter,
7, Under Cumberland County Local Rule of Civil Procedure 5, Petitioner is required
to publish notice of the hearing at least ten (10) days prior to the hearing (or no
later than February 4,2001, if the hearing goes fOlward on February 14,2001).
Petitioner does not want to incur the costs of publication if a hearing is not
necessary .
8. Cumberland County Local Rule of Civil Procedure 5 also provides that a hearing
on the Petition for Name Change must be held within three (3) months ofthe
filing ofthe Petition (or no later than March 12, 2001),

Waters, in order to give them the last name of their biological father.

change the children's names at the Department of Health instead of having a hearing regarding the
change of names.

two months to allow Tamika to try and resolve this matter with the Department of Health,
