CU;;.p/~ MATTHEW EA VY and DEL VAN EA VY, each Individually: CIVIL DIVISION - LAW and Trading As INDIAN QUEEN CURIOUS & COLLECTIBLES Defendants COMPLAINT The Plaintiff, INTERART DISTRIBUTING/SUNRISE PUBLICATIONS, INC. by its attorneys, KNUPP, KODAK & IMBLUM, P.c., brings this action of Assumpsit against the Defendants to recover the sum of ONE TIl0USAND, NINE HUNDRED FORTY -SIX DOLLARS AND TEN CENTS ($1,946.10), along with interest thereon at the rate of one and one-half (1 \1,%) percent per month from July 31,1999, upon a cause of action of which the following is a statement: I, The Plaintiff, INTERART DISTRIBUTING/SUNRISE PUBLICATIONS, INC, , is a corporation organized and existing under the laws of the State of Indiana, having its principal office and place of business at Post Office Box 66549, Indianapolis, Indiana 46266. 2. The Defendant, MA TTIlEW EA VY, an adult individual, is trading and doing business as INDIAN QUEEN CURIOS & COLLECTIBLES, and has an office and place of business at 21 East Main Street, Newville, Cumberland County, Pennsylvania 1724 I. 3. The Defendant, DEL VAN EA VY, an adult individual, is trading and doing business as INDIAN QUEEN CURIOS & COLLECTIBLES, and has an office and place of business at 21 East Main Street, Newville, Cumberland County, Pennsylvania 17241. 4, On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiff's books of original entry hereto attached, made a part hereof and marked Exhibit "A", Plaintiff, at the special instance and oral request ofthe Defendants, sold and delivered goods, wares and merchandise of the kind and description set forth on said Exhibits to the total amount of Two Thousand, Forty- Nine Dollars and Fifty-Three Cents ($2,049,53), F:\USER\BONNIEJO\COMP\ WORK\25620, WPD: IlDecOO -- ,I." ~ 5. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal and market prices therefor and were the prices which the Defendants orally promised and agreed to pay Plaintiff therefor. 6, Defendants become entitled to certain credits against the charges aforementioned, as more particularly shown ou Plaintiff's Statement of Account, Exhibit "B" attached hereto and made a part hereof, to the total amount of Two Hundred Tweuty-Nine Dollars and Twenty-Eight Cents ($229.28), 7, Due to Defendants' default in payment of said amount due and owing as aforesaid, interest has been added to said account in the total amount of One Hundred Twenty-Five Dollars and Eighty-Five Cents ($125,85), as shown on Exhibit "B" attached hereto and made a part hereof. 8, The balance due and owing by Defendants to Plaintiff is the sum of ONE 1HOUSAND, NINE HUNDRED FORTY-SIX DOLLARS AND TEN CENTS ($1,946,10), as appears by the Statement of Account hereto attached, made a part hereof and marked as Exhibit "B". 9, Plaintiff has frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants have refused and neglected and still refuse and neglect to pay said amount of any part thereof WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of ONE 1HOUSAND, NINE HUNDRED FORTY- SIX DOLLARS AND TEN CENTS ($1,946,10), together with interest thereon at the rate of one and one-half (I Y:.%) percent per month from July 31, 1999.
