Lloyd, Deputy Attorney General, hereby remove the above-captioned matter from the Court of Common Pleas of Cumberland County, Pennsylvania to the United States District Court for the Middle District of Pennsylvania. The defendants state that the following grounds support removal: 1. On or about December 12, 2000, plaintiff filed a complaint in an action in the Court of Common Pleas of Cumberland County at No. 00-8644. Attached as "Exhibit A" is a copy of that complaint. I 2. The complaint was served by First Class U. S. Mail on December 12, 2000. 3. Defendants did not receive the complaint until January 4,2001 IDefendants apologize for the quality of the copy of the attached complaint. Unfortunately, the copy received by defendants was a carbon copy and very light, and it did not copy very well. "~ ~,'--, !l.lIilr "," 4. Plaintiff appears to set forth a claim under 42 U.S.C. g1983 against the defendants alleging violations of his Eighth and Fourteenth Amendment rights. Plaintiff does not allege any state law violations. 5. This Court has original jurisdiction over federal claims pursuant to 28 U.S.C. gg 1331 and 1343 and the action is removable to this Court pursuant to 28 U.S.c. gI441(a) & (b). 6. Notice of Removal has been served this day on plaintiff and to the Prothonotary of the . Court of Common Pleas of Cumberland County. Attached as "Exhibit B" is a copy of that Notice. 7. Defendants expressly do not waive any defenses and claims of immunity (eleventh amendment or sovereign), privilege or other defenses in filing this petition for removal. \ WHEREFORE, defendants remove the aforementioned action pending in the Court of Common Pleas of Cumberland County at Docket Number 00-8644 to this Court.
