STIPULATION AGAINST LIENS
THIS AGREEMENT made this JOfI- day of t:P~000, by and
between HOME DESIGNS LIMITED, a sole proproietorship, hereinafter
referred to as Contractor,
AND
STEVEN L. SAYERS AND KRISTIN L. SAYERS, husband and wife,
hereinafter referred. to as Owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Dickinson Township, Cumberland
county, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known
as Lot #1 James and Mary Fry Subdivision, Cumberland County, PA.

NOW THEREFORE, THIS AGREEMENT WI'l'NESSETH: That the said
contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the rece~pt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Exhibit A
ALL that certain tract ofland situate in Dickinson Township, Cumberland County,
Pennsylvania, bounded and described as Proposed Lot No. I according to a
Preliminary/Final Subdivision Plan for James H. Fry and Mary E. Fry, preparelfby
Stephen G. Fisher, P.L.S. dated September 8, 1998 and revised September 27,1999,
recorded October 29, 1999 in the Office of tine Recorder of Deeds in and for
Cumberland County in Plan Book 80, page 19, as follows, to wit:
BEGINNING at a point in East Yellow Breeches Creek Road (T-463) at the dividing
line between proposed Lot No. I and Proposed Lot No.3 as set forth on the
hereinabove mentioned Plan; thence by said dividing line North 05 degrees 00
minutes 00 seconds West 25.89 feet to an iron pin set; thence continuing along the
same North 05 degrees 00 minutes 00 seconds West 177.59 feet to an iron pin set;
thence along the dividing line between Proposed Lot No. I and Proposed Lot No.2
on the hereinabove mentioned Plan North 85 degrees 00 minutes 00 seconds East
50.00 feet to an iron pin set; thence continuing along the same North 85 degrees 00
minutes 00 seconds East 159.46 feet to an iron pin set; thence along the dividing line
between Proposed Lot No.1 as set forth on the hereinabove mentioned Plan and
lands now or formerly of Davie E. Lutz and June B. Lutz, South 2 degrees 41
