AS TRUSTEE FOR LEHMAN HOME EQUITY LOAN TRUST 1998-1, and AURORA LOAN SERVICES, INC., . CIVIL ACTION - LAW Defendants COMPLAINT 1. Plaintiffs are Peter J. Hoffman and Donna B. Hoffman, adult individuals who reside at 550 St. John's Drive, Camp Hill, PA 17011. 2. Defendants are Bankers Trust Company of California, N.A., as Trustee for Lehman Home Equity Loan Trust 1998-1 (Bankers) and Aurora Loan Services, Inc. (Aurora), of 3 Park Plaza, 16th Floor, Irvine, CA 92614 and 601 5th Avenue, P.O. Box 1706, Scottsbluff, NE 69363, respectively. 3. On April 6, 1988, by a written contract, First Union Home Equity Corp. (Union) loaned to Plaintiffs $40,000.00 and Plaintiffs executed and delivered to Union a written mortgage which conveyed to Union as security for the debt the real estate which Plaintiffs owned at 550 St. John's Drive, Hampden Township, Cumberland County, pennsylvania (subject real estate). The said mortgage was recorded on April 8, 1988 in Cumberland County Mortgage Book 899, Page 416. The said mortgage was assigned from Union to Bankers by an instrument dated October 26, 1997 and recorded in Cumberland County Miscellaneous Book 635, Page 1118. A copy of the aforesaid mortgage and assignment is attached hereto as Exhibit "A". Plaintiffs do not have in their possession a ., , ,..;,.1 "-" ;.,~,~. , ,.' ,;1:1, " < i:.j;_ copy of the note or loan agreement for the $40,000.00 loan but believe that said document is in the possession of Defendants. 4. Aurora is the loan servicing agent for Union, and has been such at all times material to the cause of action herein sued upon. 5. Pursuant to the request of Norman M. Yoffe, Esquire, attorney for Plaintiffs and President of title agency Alpha Land Security, Inc. (Alpha), Aurora faxed to him a pay-off statement for said mortgage. A copy of said document dated November 17, 1999 is attached hereto as Exhibit "B". 6. On November 23, 1999, Aurora faxed to Norman M. Yoffe a revised pay-off statement for said mortgage loan, a copy of which is attached hereto as Exhibit "C". ("Alpha" is misspelled in both faxes as AHa) . 7. Plaintiffs desired the pay-off statement for this loan since it was refinancing all of the mortgage loans on subject real estate. 8. On December 7, 1999, Aurora faxed to Plaintiffs a newly revised pay-off statement. Exhibit \\DIl. A copy of same is attached hereto as 9. On December 27, 1999, Aurora faxed to Plaintiffs a still further revised pay-off statement. A copy of same is attached hereto as Exhibit nEII. 10. On December 22, 1999, Alpha remitted to Aurora (by UPS Express) its check in the amount of $38,338.56, pursuant to the December 7, 1999 pay-off statement (Exhibit "D"), which sum included Aurora's $12.00 charge for recording the satisfaction. The remittance correspondence of the aforesaid $38,338.56 is marked as Exhibit "F". . '1r. 1_ "1._' ,-" ~ - """ "-'- c ; 11. On December 27, 1999, Alpha mailed to Aurora its additional check for $1,675.87, after a phone conversation between Alpha and Aurora confirmed that this was the correct amount due. This remittance was received by Aurora on December 28, 1999. "G" attached hereto. See Exhibi t 12. The remittance made by Alpha on December 22, 1999 requested that the mortgage satisfaction be entered of record as soon as possible. 13. Norman M. Yoffe acting as the attorney for Plaintiffs as well as for Alpha (who had through Alpha insured the title for the refinancing mortgage) checked the Cumberland County Recorder of Deeds Office on March 20, 2000, April 25, 2000, May 18, 2000, June 27, 2000 and July 26, 2000 and found on each occasion that the Union mortgage remained unsatisfied of record. 14. By faxed letter dated July 31, 2000 to Aurora, Alpha notified Aurora of the non-satisfaction and demanded the satisfaction be entered forthwith, warning that failure to do so would incur a penalty pursuant to 21 P.S. ~681 and ~682. A copy of this letter is attached hereto as Exhibit "H". 15. By letter dated August 4, 2000, Aurora wrote to Alpha advising that the mortgage release was sent to the County Recorder on February 8, 2000, but was returned for corrections on February 8, 2000. The letter further advised that when the corrections were made the satisfaction document would then be re-sent to the Recorder. A copy of this letter is attached hereto as Exhibit "I". ~ ~ .. -"- 'I" , , 16. On September 15, 2000, Attorney Norman M. Yoffe re-checked the records in the Recorder of Deeds Office and found that the satisfaction hadn't been entered. 17. Re-checks were made by Attorney Yoffe on October 17, 2000, November 27, 20000 and December 4, 2000, with the same results on each such occasion. 18. Plaintiff has incurred a bill from their attorney for the services involved in endeavoring to obtain this mortgage satisfaction which invoice they are obligated to pay. A copy of this invoice dated December 21, 2000 is attached hereto as Exhibit "J". 19. Additional invoices are likely to be received by Plaintiffs for their attorney services for the period subsequent to December 21, 2000, which they (Plaintiffs) will be also obliged to pay. 20. Plaintiffs themselves have expended many hours of their own time in attending to this matter and are seeking redress therefore. WHEREFORE, Plaintiffs demand a judgment and unliquidated damages against Defendants exceeding the $25,000.00 amount not an jurisdictional amount requiring compulsory arbitration in Cumberland County.
