Plaintiff is a business entity located at 6720 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. The Defendants are adult individuals, whose last known address was 2245B Rittner Highway, Carlisle, Cumberland County, Pennsylvania, 17013. 3, On or about September 7, 1999, Plaintiff entered into a rental agreement with Defendants, wherein Plaintiff rented a 1999 "~ 1c''''~~'I''''' -. A copy of the Rental Agreement is attached hereto as Exhibit ~A". 4. Paragraph 5 of the standard Rental Agreement states, "If vehicle is lost or damaged while on rental, whether or not due to renter's fault, renter shall pay Daily Rental Company on demand the amount of such loss or damage at prevailing retail price plus Daily Rental Company's related expenses, including loss of use." Further, the automobile was delivered to Defendants with the express or implied requirement that the automobile be returned to Plaintiff in the same condition as the vehicle was delivered to Defendants. 5. The above-referenced vehicle was delivered to Defendants in a good working order with no known defects other than scratches on the passenger bottom door. 6. On or about September 20, 1999, Defendant Amy Stine lost control of the above-referenced automobile and became involved in a collision. As a result of the collision, the automobile suffered damages totaling $6,789. 7. Plaintiff also suffered loss of rental use of the vehicle while the vehicle received repairs. As a direct and proximate result of Defendants' failure to return the above-referenced vehicle in the same condition as when rented to Defendants, Plaintiff has suffered damages in the amount of $9,067. COUNT I Cumberland Valley Leasing v. Garrv E. Stine and Amv M. Stine Breach of Rental Aqreement 9. The facts set forth in Paragraphs 1 through 8 are incorporated herein by reference. 10. The Rental Agreement entered into between the parties specifically requires that if the vehicle was lost or damaged while on rental, whether or not due to the renter's fault, the renter shall pay the daily rental company on demand the amount of such loss or damage plus any and all related expenses including loss of use. See Exhibit ~A", paragraph 5. 11. The vehicle which was rented to Defendants was damaged while on rental. As such, Defendants are required to pay Plaintiff for the damages sustained to the vehicle as well as any and all related expenses. 12. Defendants, Garry E. Stine and Amy M. Stine, refuse to pay the above-referenced expenses; therefore, Garry E. As a direct and result Defendants' breach of the Rental Agreement attached hereto as Exhibit "Au, Plaintiff has suffered damages totaling $9,067. WHEREFORE, Plaintiff demands judgment against Defendants, jointly and severally, in the amount of $9,067, together with interest, delay damages, and costs of suit, which is an amount requiring this matter to be submitted to compulsory Arbitration. COUNT I Cumberland Valley Leasing v. Garrv E. Stine and Amv M. Stine Bailment 14. The facts set forth in Paragraphs 1 through 13 are incorporated herein by reference. 15. On or about September 7, 1999, Plaintiff delivered an automobile to Defendants for the purposes of Defendants' use for the following month. 16. The vehicle was delivered to Defendants with the express or implied requirement that the automobile be returned to Plaintiff in the same condition as the vehicle was delivered to Defendants. 17. The accident occurred solely as a result of Defendant Amy Stine's negligence. 19. The collision caused the vehicle to suffer various damages totaling $6,789. 20. Defendants failed to return the vehicle to Plaintiff in the same condition as the vehicle was delivered to Defendants. 21. Defendants' failure to return the vehicle to Plaintiff in the same condition as it was delivered to Defendants has directly and proximately caused Plaintiff to suffer damages in the amount of $9,077.
