Plaintiff, AMERICAN EXPRESS CENTURION BANK, is a Utah chartered financial institution, and a wholly owned subsidiary of American Express Travel Related Services Company, Inc., a New york Corporation, authorized to do business in Pennsylvania. 2. Defendant, CATHERINE E. ALVAREZ, is an adult individual who resides at 202 Locust Drive, New Cumberland, Cumberland County, Pennsylvania 17070. 3. The Defendant applied to for and was granted an American Express Card, bearing the account number 3722 854354 51007, and an account agreement entitled; AGREEMENT BETWEEN OPTIMA CARDMEMBER AND AMERICAN EXPRESS CENTURION BANK ("Agreement"), was mailed to the Defendant. A true and correct copy of the said Agreement is attached hereto, marked as Exhibit "111 and made a part hereof. 4. The Defendant made use of the account and has currently a balance due and owing to Plaintiff in the amount of $4,581.09. 6. Plaintiff avers that the written account Agreement between the parties provides that Plaintiff is entitled to collect its reasonable attorney's fees, incurred in collecting the balance due. 8. Plaintiff avers that its reasonable attorney's fees will amount to $916.22. 9. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or refused to pay the principal balance, attorney's fees or any part thereof to Plaintiff.
