COMPLAINT
AND NOW, this fiJ~ day of December, 2000, comes the Plaintiff in the above-
captioned action and by their counsel, O'Brien, Baric & Scherer file this Complaint in an

action to quiet title against the above-designated Defendants as more particularly set
forth herein:
1. The Plaintiff, Robert E. Lindsay is an adult individual residing at 701 Big
Spring Road, Newville, Cumberland County, Pennsylvania 17241.
2. The Defendants are individuals many of whose present addresses and
whereabouts are unknown (with certain exceptions where service will be made in
accordance with the applicable rules), a diligent search of the records of Cumberland
County having been made in an effort to determine the whereabouts of said
Defendants, said Defendants being the heirs at law of Joshua and Martha Gipe and
Rebecca Gipe Shartzer and George W. Shartzer.
3. The Plaintiff seeks to quiet title to certain tracts of ground located in the
village of Springfield located in West Pennsboro Township, Cumberland County,
Pennsylvania. The tracts are as follows:
Tract 1: All that herein after described premises and lots of ground with the
appurtenances situate and being in the Village of Springfield in the township of West
Pennsborough County & State aforesaid and bounded as follows by Lot NO.1 bounded
North by land of Mrs. Jane Sharp West by Jacob Keller's heirs South by Robert
Young's heirs and East by Water Street and containing forty six by sixty seven feet; Lot
NO.2 bounded North by big road West by Alley South by Jacob Myers and United
Brethren Church lot and East by said Church lot being approximately one hundred and
eighty-five feet long and seventy feet wide.
The above-described lots are part of the three lots deeded by deed poll of Sheriff
Dunlap to Joseph Kenege bearing date the fifteenth day of February, A.D. 1831, who
by his indenture dated the tenth day of March, A.D. 1835 did convey the same to Daniel
Sweigert a party hereto. Reference being thereunto had will fully and at large appear.
Thereafter, on March 8, 1863, the same premises were conveyed by Daniel Sweigert
and Elizabeth Sweigert to Joshua Gipe, which conveyance was not recorded in the
Cumberland County Recorder of Deeds office.

Tract 2: All that House and Lot situated in the Village of Springfield,
Township of West Pennsborough County of Cumberland and State of Pennsylvania.
BOUNDED AND DESCRIBED, as follows:
On the North by Main Street, On the West by lot now of George Gochenauer, On the
South by an Alley, and on the East W.G. Thrush property now William Johnson.
Containing
feet.
feet in front on Main Street and extending in depth
Being the same property that was conveyed by William Green and Nancy E. Green to
John C. Lindsay by deed dated March 1st, 1919 and recorded in Cumberland County
Deed Book T, Volume 8, page 115 on March 18, 1919.
Tract 3: All that certain messuage and lot of ground situated in Springfield,
West Pennsboro Township, Cumberland County, Pennsylvania, bounded and
described as follows, to wit:- on the East by lot of Mrs. Joanna Lindsey, on the South by
an Alley; On the West by an Alley; and on the North by Main Street.
Being the same property that was conveyed by Harry J, And Lovie M. Robinson to John
C. Lindsay by a deed notarized April 13, 1920 and not recorded in the Cumberland
County Recorder of Deeds Office.
4. One of the lots is represented by a Deed dated March 8, 1862 between
Daniel and Elizabeth Swigert, Grantors and Joshua Gipe, Grantee. A true and correct
copy of this Deed is attached hereto and marked Exhibit 1. This Deed was never
entered in the Recorders office of Cumberland County and came into Plaintiffs
possession as an heir and descendant of Joshua Gipe. Joshua Gipe at the time he
purchased the property was married to Martha Gipe. Joshua died in 1890 and Martha
died in 1892. The ownership of this land would have passed to their children, Mary J.
Gipe, John D. Gipe, Rebecca Gipe, William P. Gipe and Martha E. Gipe. Of the
children of that union the only one which married and had children was Rebecca Gipe
who married George W. Shartzer.

5. George W. and Rebecca Shartzer had five children, Flora, Elmira, Martha
Jenny, George E. and Alice E. The children of George and Rebecca Shartzer in turn
had fourteen children. All of these children are named as Defendants to the action.
6. Attached hereto are photocopies of two Deeds conveyed into John C.
Lindsay describing two lots of ground in the village of Springfield. One of these Deeds
was recorded in the Cumberland County Courthouse on March 18, 1919 and the other
Deed was unrecorded. Plaintiff came into possession of these Deeds as an heir and
descendent of John C. Lindsay. These Deeds are attached hereto and marked as
Exhibit 2 and Exhibit 3. These two lots are approximately one hundred twenty (125)
feet by two hundred (200) feet. Since he returned from World War II in 1945 the
Plaintiff has been in sole possession of these two lots and has been paying taxes on
the lots. At one time the two lots had structures on them, however for the past several
decades they have been vacant lots.
7. John C. Lindsay died in 1939 survived by his wife, Joanna Lindsay, who
died July 4, 1940. John and Joanna had four children, one of which Margaret
predeceased them in 1923. The other three children were George Lindsay, William
Lindsay and Jane Lindsay. George Lindsay married and had three children and eight
grandchildren. The Plaintiff is a son of George Lindsay. George's brother, William had
sixteen children his sister Jane had one child and Margaret who predeceased both of
her parents had three children. Accordingly, the interest in the two lots of ground
acquired by John C. Lindsay in 1919 and 1920 would have passed to his heirs in
certain fractional proportions depending on their relationship to John C. Lindsay.

8. The Plaintiff, Robert E. Lindsay has been in continuous, open, notorious
and hostile possession of the Gipe lot and the two John C. Lindsay lots since 1945.
9. None of the Defendants, nor any other person has ever made any claim
for possession of or title to the premises herein described, nor has any action of
ejectment or other proceeding been instituted to obtain possession. However, the
Defendants, as many of them are heirs and descendants of the original owners, may
claim to have an apparent title, interest or claim against the aforesaid described
premises. This alleged or purported claim of the Defendants may constitute a cloud
upon the marketability of the title of the Plaintiff.
WHEREFORE, Plaintiff requests that an Order and Decree be entered forever
barring the Defendants and their heirs, personal representative and assigns, from
asserting any right title or interest in or to the described real estate unless within twenty
(20) days from the date of service of the Complaint the Defendants or their heirs,
personal representatives or assigns commence an Action in Ejectment.

AND NOW, this 22nd day of June, 2001, comes the Plaintiff in the above-
captioned action and by their counsel, O'Brien, Baric & Scherer file this Amended
Complaint in an action to quiet title against the above-designated Defendants as more
particularly set forth herein:

VERIFICATION
I verify that the statements made in the foregoing Amended Complaint are true
and correct to the best of my knowledge, information and belief. This verification is
signed by Robert L. O'Brien, Esquire, attorney for Plaintiff and is based upon
statements provided by Robert E. Lindsay as well as documents reviewed by the
undersigned as attorney for Robert E. Lindsay. This verification will be substituted and
ratified by a verification signed by Robert E. Lindsay who is presently unavailable to

All that herein after described premises and lots of ground with the appurtenances
situate and being in the Village of Springfield in the township of West Pennsborough
County & State aforesaid and bounded as follows by Lot No. 1 bounded North by land
of Mrs. Jane Sharp West by Jacob Keller's heirs South by Robert Young's heirs and
East by Water Street and containing forty six by sixty seven feet; Lot NO.2 bounded
North by big road West by Alley South by Jacob Myers and United Brethren Church lot
and East by said Church lot being six hundred and forty seven feet long and sixty-seven
feet wide.
The above-described lots are part of the three lots deeded by deed poll of Sheriff
Dunlap to Joseph Kenege bearing date the fifteenth day of February, A.D. 1831, who
by his indenture dated the tenth day of March, A.D. 1835 did convey the same to Daniel
Sweigert a party hereto. Reference being thereunto had will fully and at large appear.
Thereafter, on March 8, 1863, the same premises were conveyed by Daniel Sweigert
and Elizabeth Sweigert to Joshua Gipe, which conveyance was not recorded in the
Cumberland County Recorder of Deeds office.

AFFIDAVIT IN SUPPORT OF SERVICE BY PUBLICATION
TRACT NUMBER 1:
Your Affiant is Robert E. Lindsay, the Plaintiff in the above-captioned action.
Based on a clearer understanding of the inter-relationship of the people to be served in
the quiet title action I have filed an Amended Complaint naming additional individuals.
The one tract of land identified in the Complaint as Tract No. 1 was transferred on
March 8, 1863 into Joshua Gipe. This conveyance was not recorded in the county
courthouse. Joshua Gipe died on April 14, 1891. The Cumberland County Register Of
Wills office shows that letters in the estate of Joshua Gipe were issued to George W.
Shartzer on November 19, 1892. In Joshua Gipe's will he gave a life estate in all his
real and personal property to wife, Martha, and at her death the property was to pass to
his daughter, Rebecca Gipe Shartzer. Joshua Gipe's wife, Martha was born in 1819
and passed away in 1892. At that point and time, one hundred percent of the
ownership of Tract No.1 vested in Rebecca Gipe Shartzer, pursuant to the provisions
of Joshua Gipe's will. Rebecca Gipe Shartzer was born in 1849 and died on December
25, 1926.
The Cumberland County Register of Wills office shows that Rebecca Gipe
Shartzer died intestate and that Flora A. Shartzer was appointed personal

representative on January 21, 1927. Rebecca's husband, George W. Shartzer had
predeceased her in 1919. Rebecca and George had five children, Flora Agnes
Shartzer, born in 1867 and died in 1955; Elmira S. Smith, born in 1871 and died in
1957; Martha J. Lindsay, born in 1869 and died on June 10, 1910; George E. Shartzer,
date of birth and death unknown, although he is believed to have left the area in 1931
and was reported to have moved to the Slippery Rock area, and Alice Shartzer Mowers,
born in 1880 and died in 1950. According to intestate succession in Pennsylvania,
Rebecca Gipe Shartzers' interest in the property would have passed in fifths to these
five children.
THE HEIRS OF REBECCA GIPE SHARTZER:
George E. Shartzer was believed to have been born in the 1870's. Family
records reflect that he was a vagabond and was reported to have settled in the Slippery
Rock, Pennsylvania area. The Plaintiff has traveled to the Slippery Rock area and
checked the cemeteries to see if a marker for George E. Shartzer could be located.
The Plaintiff, Robert Eugene Lindsay, Sr. was born in 1923 and recalls his uncles
departure. The Plaintiff has maintained contact through the years with all of George's
sisters and other members of the family and no one knows what happened to George
as he stopped all contact with the family. This is one of the individuals and his heirs
which the Plaintiff seeks to serve by publication.
Flora A. Shartzer was another child of Rebecca Gipe Shartzer and was the
Plaintiff's aunt. Flora never married and had no children. Flora was the individual who
received the letters on her mother in January of 1927. Flora was born August 13,1867

and died May 29,1955. She died in Cumberland County and the Cumberland County
Register of Wills office reflects that no application was made for a personal
representative to be appointed. Accordingly, her one fifth interest in Rebecca Gipe
Sharzter's property would have passed to her brothers and sister or her nieces and
nephews.
Elmira Shartzer married Charles Smith and they had two children, Arthur Smith
and Rhoda Smith Horner. Elmira Smith was born in 1871 and died in 1957. The
Cumberland County Registers office indicates that no estate was opened. Elmira Smith
survived her husband who had died in the1930's. Accordingly, her one fifth interest
passed to her two children, Arthur Smith and Rhoda Smith Horner.
Arthur Smith died in the 1970's in Cumberland County and the Registers office
has no record of an estate being opened. Arthur Smith had one child, Charles Smith
who had moved to the West Coast and died in California in the 1970's and whose body
was returned to Cumberland County for burial. Charles Smith had married a woman,
Ethel Smith whose whereabouts are unknown, although the Plaintiff does know that she
has passed away. The Plaintiff is unable after his close contact with the family
members to account for the fractional share which would have passed to Charles Smith
upon the deaths of his parents or to his wife, Ethel Smith. All family members with
whom the Plaintiff has maintained close contact have no idea where Ethel died and
whether or not she had any relatives surviving that would take under the intestate law.
Service of these unknown and unnamed individuals are requested by publication.
Elmira's other child was Rhoda Smith who died on March 27, 1989. Rhoda
Smith had married William Horner and her interest in the real estate would have passed

under the residuary clause of her will, which will is recorded in Will Book 110, Page 368
in Cumberland County. There were seven persons identified under the residuary
clause, five individuals and two churches. Attached hereto and incorporated herein is
a copy of Rhoda Smith Horner's will and Schedule J indicating her beneficiaries. The
Plaintiff will attempt to obtain releases or service upon the two churches and the
individuals to the extent that these individuals can be located.
Martha Jennie Shartzer was the mother of the Plaintiff. Martha Jennie Shartzer
married George W. Lindsay and they had three children. Martha Jennie Lindsay
passed away in 1910 and was survived by her husband and the three children.
The Plaintiffs brother, John McKnight Lindsay was born on January 5, 1908 and
died on July 21, 1975. He had married Nellie Mae Lindsay who passed away on
December 25,1983. An estate was opened to No. 21-84-68 and her interest in the
real estate would have passed to her children, Donald Lee Lindsay, born in 1934, Ruby
M. Lindsay, born in 1937, Cynthia Lindsay, born in 1940 and Johnnie Lindsay born in
1942. It is believed that the Plaintiff can obtain service and/or releases upon Donald,
Ruby, Cynthia and Johnnie who all live in Pennsylvania.
The Plaintiffs other brother, George Howard Lindsay was born on June 3,1910
and died on April 12, 1983. George married Louella Burkhart Lindsay and she died on
December 9,2000. An estate was opened in Cumberland County docketed to No. 21-
2000-1078. There was no estate opened for George Lindsay and it is believed that his
interest in the property would have passed to Louella. George and Louella had three
children, two of which predeceased their parents, Janice in 1969 and Ray in 1975. One
child survived and that individual is Howard J. Lindsay. Howard J. Lindsay lives in

Florida and in Pennsylvania. The Plaintiff believes that he can locate Howard J.
Lindsay and obtain service of this action.
The fifth and final child of Rebecca Gipe Shartzer was Alice Shartzer who
married James Mowers. Alice was born in 1880 and died in 1950 survived by her
husband who died in the 1980's. Alice and James had nine children. Her nine children
were Ralph Mowers who died in 1982, Esther Schell who died in the 1970's or 1980's in
Dauphin County, Ruth Mowers who never married but had two children. (One of Ruth's
children was the Plaintiff, who as a child was adopted and raised by George and
Martha Lindsay. The other child is Romaine S. Negley, the Plaintiffs half-sister prior to
the adoption. The Plaintiff believes that he can obtain service and/or a release from
Romaine Negley.) Another child of Alice Shartzer Mowers was Herman Mowers who
died in Perry County. Herman Mowers married but he and his wife had no children.
The Plaintiff has no idea of the whereabouts of Herman's wife or if she has died.
Raymond Mowers, another child, died in 1957 in Cumberland County. The Cumberland
County Register of Wills indicates that no estate was opened for Raymond and the
Plaintiff knows that Raymond never married and never had any children. Service by
publication for Raymond and his potential heirs are requested. Melvin Mowers died in a
hotel fire in 1969 in Chambersburg, Pennsylvania. Melvin also never married and had
no children. Accordingly there are no known heirs of Melvin and service by publication
on Melvin and his potential heirs is requested. Harold Mowers, Rachel Mowers Horn
and Norman Mowers are all living and the Plaintiff will attempt to obtain service and/or a
release from these heirs. Rachel Mowers is believed to be living in a nursing home.
The Plaintiff believes that Rachel Mowers had four or five children although there

present whereabouts are unknown and accordingly if he is unsuccessful in locating her
whereabouts he requests service by publication be made upon Rachel Mowers, her
heirs, guardians and/or assigns.
TRACTS NUMBERS 2 AND 3
The Tract Nos. 2 and 3 in the Complaint will be referred to as the Lindsay tracts.
At the present time these tracts, like tract No.1, have no structures on them and the
Plaintiff has been paying the taxes on these properties since the 1940's. Tract NO.2
was conveyed to John C. Lindsay on March 1, 1919 and was recorded in Cumberland
County Deed Book T Volume 8 Page 115 on March 18, 1919. Tract NO.3 was
conveyed to John C. Lindsay by Deed notarized April 13, 1920 but not recorded in the
Cumberland County Recorder of Deeds office. The Plaintiff is a grandson of John C.
Lindsay. John C. Lindsay married Joanne McKnight Lindsay and they had four
children, George W. Lindsay, Margaret Ann Lindsay McElwee, William C. Lindsay and
Mary Jane Lindsay Hoppis.
THE HEIRS OF JOHN C. LINDSAY:
George W. Lindsay was born in 1885 and died in 1949. He is the father of the
Plaintiff and had married Martha Jennie Shartzer who was one of the heirs of the Gipe
tract. Fractional interests in all three tracts arise due to the relationship of the
Gipe/Shartzer line and the Lindsay line. Accordingly, the information in reference to the
heirs of the Gipe/Shartzer line of the family appear on the earlier pages of this Affidavit.

been born in 1887 and passed away in 1923. Margaret McElwee had five children,
Blanche McElwee, Margaret Lorraine McElwee, Charles Earl McElwee, Anna Jane
McElwee and James Clair McElwee. Attached hereto are copies from the Lindsay
family history outlining this branch of the family.
Blanche McElwee was born in 1909 and married Vernie D. Myers, Sr.; Margaret
Lorraine McElwee was born in 1914 and died in 1966 and married Ira Philip Davis who
was born in 1913 and died in 1955; Charles Earl McElwee was born in 1917 and died in
1923; Anna Jane McElwee was born in 1919 and died in 1970 she married Merle
William Davis born 1926 and died in 1975; James Clair McElwee was born in 1920 and
married Opal Irene Shultz born in 1927.
The five children of Margaret McElwee had collectively fourteen children, At this
point the original one quarter interest of Margaret Ann Lindsay McElwee in these two
small unimproved lots has become anywhere from a one twentieth interest in her
children to a one fifty sixth interest or greater, depending on the number of children
each child had, in Margaret McElwees fourteen grandchildren. Plaintiff believes he can
obtain addresses for some of these heirs and will attempt to serve them and/or obtain
releases. Nevertheless, he requests service by publication on this branch of the family.
Another son of John C. Lindsay was William C. Lindsay who was born on
October 3, 1886 and died on October 16, 1944. He married Stella Mae who was born
on January 28,1891 and died on November 20,1979. They had fifteen children, six of
whom passed away before William C. Lindsay died and nine who survived him. Two of
the children are known, Harold Meily Lindsay and Frances Amelia Lindsay Widders.
The Plaintiff will attempt to obtain service and/or releases upon the members of this line

The fourth child of John C. Lindsay was Mary Jane Lindsay who was born on
September 9, 1891 and died on April 4, 1959. She had married Alfred Birton Hoppis
who was born September 13,1891 and who died on June 15, 1957. They had one
child, Winnie Fay Hoppis Stoner born June 8, 1927 who is still living. The branch ofthis
Lindsay family is also attached to this Affidavit. The Plaintiff will attempt to obtain
service and/or a release upon Winnie Fay Hoppis Stoner.
CONCLUSION:
Due to the large number of potential heirs that have small fractional interests in
the three tracts of unimproved real estate, service by publication is requested upon all
members with the understanding thatthe Plaintiff will exercise due diligence in serving
all heirs he can identify using reasonable diligence.

Winnie Fay Hoppis Stoner is the only daughter and child born to the late Mary Jane Lindsay and Alfred
Bert Hoppis.
Winnie Fay is the widow of Vincent Kenneth Stoner, born May 7,1921 and died March 17, 1981. They
were married at Winchester, Virginia on August 29, 1952.
Three children enriched their lives. Kathleen Jane, their first born, January 6, 1953, a son, Daniel
Burton, March 17, 1954, then another daughter, Sharon Elizabeth, April 5, 1955. Each one has married and
has a family of their own.
Winnie Fay enjoys the reunion, her family and grandchildren.
Her address is 6959 Wertzville Road, Enola, PA 17025.

ORDER OF COURT
AND NOW, this 26th day of November, 2002, upon consideration of the
Plaintiffs "Motion for Final Judgment," and it appearing that a complaint containing a
notice to defend has been served on Defendants and that Defendants have not filed an
answer within the time required under the Pennsylvania Rules of Civil Procedure, it is
hereby ordered as follows:
I. Defendants are forever barred from asserting any right, lien,
title or interest in the premises described below inconsistent with the
interest or claim of Plaintiff in the premises described below unless
Defendants file an answer to the complaint within thirty days of the date of
this order. If such action is not taken within the thirty-day period, the
prothonotary on praecipe of Plaintiff shall enter final judgment in favor of
Plaintiff.
2. A certified copy of the final judgment in favor of Plaintiff, if
and when entered, and a certified copy of this order shall be recorded by
Plaintiff in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, and shall be indexed against Defendants as grantors and
Plaintiff as grantee in the premises described below. Any interest
previously held or claimed by Defendants in the premises described below
shall be marked extinguished of record by the Recorder of Deeds of
Cumberland County, Pennsylvania, and Plaintiff shall be deemed legal and
equitable owner of the premises described below.
3. The premises referred to herein are described in Plaintiffs
complaint as follows:
Tract I: All that herein after described premises and lots of
ground with appurtenances situate and being in the Village of
Springfield in the Township of West Pennsborough County & State
aforesaid and bounded as follows:

Lot No. 1 bounded North by land of Mrs. Jane Sharp West by
Jacob Keller's heirs South by Robert Young's heirs and East by
Water Street and containing forty six by sixty seven feet;
Lot No.2 bounded North by big road West by Alley South by
Jacob Myers and United Brethren Church lot and East by said
Church lot being approximately one hundred and eighty-five feet
long and seventy feet wide.
The above-described lots are part of the three lots deeded by deed
poll of Sheriff Dunlap to Joseph Kenege bearing date the fifteenth
day of February, A.D. 1831, who by his indenture dated the tenth
day of March, AD. 1835 did convey the same to Daniel Sweigert a
party hereto. Reference being thereunto had will fully and at large
appear. Thereafter, on March 8, 1863, the same premises were
conveyed by Daniel Sweigert and Elizabeth Sweigert to Joshua
Gipe, which conveyance was not recorded in the Cumberland
County Recorder of Deeds office.
Tract 2: All that House and Lot situated in the Village of
Springfield, Township of West Pennsborough County of
Cumberland and State of Pennsylvania.
BOUNDED AND DESCRIBED, as follows:
On the North by Main Street, On the West by lot now of George
Gochenauer, On the South by an Alley, and on the East W.G. Thrush
property now William Johnson.
Containing feet in front on Main Street and extending in
depth feet.
Being the same property that was conveyed by William Green
and Nancy E. Green to John C. Lindsay by deed dated March 1st,
1919 and recorded in Cumberland County Deed Book T, Volume 8,
page 115 on March 18, 1919.
Tract 3: All that certain messuage and lot of ground situated
in Springfield, West Pennsboro Township, Cumberland County,
Pennsylvania, bounded and described as follows, to wit:
On the East by lot of Mrs. Joanna Lindsey, on the South by an
Alley, On the West by an Alley; and on the North by Main Street.
Being the same property that was conveyed by Harry J. And
Lovie M. Robinson to John C. Lindsay by a deed notarized April 13,
1920 and not recorded in the Cumberland County Recorder of Deeds

inconsistent with the interest and claim of the Plaintiff as set forth in the Complaint filed

Now therefore, and upon Motion of Robert L. O'Brien, Esquire, IT IS HEREBY
ORDERED AND DECREED THAT:
1. The Plaintiff, Robert E. Lindsay, is the legal and equitable owner of the
tracts of land described on Exhibit "c" attached hereto and made a part hereof.
2. The Defendants, their heirs, representatives and assigns, are forever
barred from asserting any right, title, lien or interest in and to the real estate described
on Exhibit "c" in any manner inconsistent with the interests and claims of the Plaintiff.
3. The Defendants are deemed to have effectively conveyed their interest in
the tracts of land described on Exhibit "c" to the Plaintiff and any interest that
Defendants may have had in and to the tracts of land are hereby terminated and
extinguished.
4. A certified copy of this judgment shall be recorded by the Plaintiff in the
Office of the Recorder of Deeds and shall be indexed against the Defendants as
grantors and the Plaintiff as grantee thereby by removing the cloud on Plaintiff's title.

AND NOW, this 26th day of November, 2002, upon consideration of the
Plaintiffs "Motion for Final Judgment," and it appearing that a complaint containing a
notice to defend has been served on Defendants and that Defendants have not filed an
answer within the time required under the Pennsylvania Rules of Civil Procedure, it is
hereby ordered as follows:
1. Defendants are forever barred from asserting any right, lien,
title or interest in the premises described below inconsistent with the
interest or claim of Plaintiff in the premises described below unless
Defendants file an answer to the complaint within thirty days of the date of
this order. If such action is not taken within the thirty-day period, the
prothonotary on praecipe of Plaintiff shall enter final judgment in favor of
Plaintiff.
2. A certified copy of the fmal judgment in favor of Plaintiff, if
and when entered, and a certified copy of this order shall be recorded by
Plaintiff in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, and shall be indexed against Defendants as grantors and
Plaintiff as grantee in the premises described below. Any interest
previously held or claimed by Defendants in the premises described below
shall be marked extinguished of record by the Recorder of Deeds of
Cumberland County, Pennsylvania, and Plaintiff shall be deemed legal and
equitable owner of the premises described below.
3. The premises referred to herein are described in Plaintiffs
complaint as follows:
Tract 1: All that herein after described premises and lots of
ground with appurtenances situate and being in the Village of
Springfield in the Township of West Pennsborough County & State
aforesaid and bounded as follows:

Lot No. 1 bounded North by land of Mrs. Jane Sharp West by
Jacob Keller's heirs South by Robert Young's heirs and East by
Water Street and containing forty six by sixty seven feet;
Lot No.2 bounded North by big road West by Alley South by
Jacob Myers and United Brethren Church lot and East by said
Church lot being approximately one hundred and eighty-five feet
long and seventy feet wide.
The above-described lots are part of the three lots deeded by deed
poll of Sheriff Dunlap to Joseph Kenege bearing date the fifteenth
day of February, A.D. 1831, who by his indenture dated the tenth
day of March, A.D. 1835 did convey the same to Daniel Sweigert a
party hereto. Reference being thereunto had will fully and at large
appear. Thereafter, on March 8, 1863, the same premises were
conveyed by Daniel Sweigert and Elizabeth Sweigert to Joshua
Gipe, which conveyance was not recorded in the Cumberland
County Recorder of Deeds office.
Tract 2: All that House and Lot situated in the Village of
Springfield, Township of West Pennsborough County of
Cumberland and State of Pennsylvania.
BOUNDED AND DESCRIBED, as follows:
On the North by Main Street, On the West by lot now of George
Gochenauer, On the South by an Alley, and on the East W.G. Thrush
property now William Johnson.
Containing feet in front on Main Street and extending in
depth feet.
Being the same property that was conveyed by William Green
and Nancy E. Green to John C. Lindsay by deed dated March 1st,
1919 and recorded in Cumberland County Deed Book T, Volume 8,
page 115 on March 18, 1919.

Plaintiff/Petitioner on the _ day of December, 2000, filed with the Prothonotary of
Cumberland County an action to quiet title whereby he requested that title to the
following three tracts of ground be quieted and that it be determined that he have sole
fee simple title to the same.
Tract 1: All that herein after described premises and lots of ground with the
appurtenances situate and being in the Village of Springfield in the township of West
Pennsborough County & State aforesaid and bounded as follows by Lot No.1 bounded
North by land of Mrs. Jane Sharp West by Jacob Keller's heirs South by Robert
Young's heirs and East by Water Street and containing forty six by sixty seven feet; Lot
No.2 bounded North by big road West by Alley South by Jacob Myers and United
Brethren Church lot and East by said Church lot being approximately one hundred and
eighty-five feet long and seventy feet wide.
The above-described lots are part of the three lots deeded by deed poll of Sheriff
Dunlap to Joseph Kenege bearing date the fifteenth day of February, A.D. 1831, who
by his indenture dated the tenth day of March, A.D. 1835 did convey the same to Daniel
Sweigert a party hereto. Reference being thereunto had will fully and at large appear.
Thereafter, on March 8, 1863, the same premises were conveyed by Daniel Sweigert
and Elizabeth Sweigert to Joshua Gipe, which conveyance was not recorded in the
Cumberland County Recorder of Deeds office.
Tract 2: All that House and Lot situated in the Village of Springfield,
Township of West Pennsborough County of Cumberland and State of Pennsylvania.
BOUNDED AND DESCRIBED, as follows:-
On the North by Main Street, On the West by lot now of George Gochenauer, On the
South by an Alley, and on the East WG. Thrush property now William Johnson.
Containing

Being the same property that was conveyed by William Green and Nancy E. Green to
John C. Lindsay by deed dated March 1st, 1919 and recorded in Cumberland County
Deed Book T, Volume 8, page 115 on March 18, 1919.
Tract 3: All that certain messuage and lot of ground situated in Springfield,
West Pennsboro Township, Cumberland County, Pennsylvania, bounded and
described as follows, to wit:- on the East by lot of Mrs. Joanna Lindsey, on the South by
an Alley; On the West by an Alley; and on the North by Main Street.

Being the same property that was conveyed by Harry J. And Lovie M. Robinson to John
C. Lindsay by a deed notarized April 13, 1920 and not recorded in the Cumberland
County Recorder of Deeds Office.
2. Many of the aforesaid Defendants/Respondents are either dead or their
whereabouts are unknown. To the extent that the whereabouts of some of the
Defendants/Respondents can be ascertained service will be made in accordance with
the applicable rules.
3. The Petitioner/Plaintiff after making a diligent search and inquiry has been
unable to ascertain the present whereabouts of many of the above-named
Defendants/Respondents and/or any personal representative of same, many of whom
are deceased.
WHEREFORE, the Plaintiff/Petitioner respectfully asks leave of court to obtain
service of the Complaint in the instant matter upon the Defendants/Respondents by
publication pursuant to Cumberland County Rule 1009-1, Rule 1066-1, Rule 1066-2,
Rule 1066-3 and Rule 1066-4.

Releases of Interest for as many heirs as have been able to be reached by mail.
Despite mailings on two separate occasions, several heirs have not responded.
3. Attached hereto is an Affidavit which outlines the various limbs and
branches of an extended and large family tree.
4. Petitioner/Plaintiff pursuant to the aforesaid Affidavit and after making a
diligent search and inquiry is unable to ascertain the present whereabouts of many of
the named Defendants/Respondents and/or personal representatives of the same,
many of whom are deceased.

The total value of the land subject to the quiet title action is no more than
a few thousand dollars. The Plaintiff/Petitioner has been paying the taxes on these lots
since his return after his service in World War \I and wishes to have a court order to
clear up the matter of the title to these properties.
WHEREFORE, the Plaintiff/Petitioner respectfully asks leave of court to obtain
service of the Complaint in the instant matter upon the Defendants/Respondents by
publication pursuant to Cumberland County Rule 1009-1, Rule 1066-1, Rule 1066-2,

AFFIDAVIT IN SUPPORT OF SERVICE BY PUBLICATION
TRACT NUMBER 1:
Your Affiant is Robert E. Lindsay, the Plaintiff in the above-captioned action.
Based on a clearer understanding of the inter-relationship of the people to be served in
the quiet title action I have filed an Amended Complaint naming additional individuals.
The one tract of land identified in the Complaint as Tract NO.1 was transferred on
March 8, 1863 into Joshua Gipe. This conveyance was not recorded in the county
courthouse. Joshua Gipe died on April 14, 1891. The Cumberland County Register Of
Wills office shows that letters in the estate of Joshua Gipe were issued to George W.
Shartzer on November 19, 1892. In Joshua Gipe's will he gave a life estate in all his
real and personal property to wife, Martha, and at her death the property was to pass to
his daughter, Rebecca Gipe Shartzer. Joshua Gipe's wife, Martha was born in 1819
and passed away in 1892. At that point and time, one hundred percent of the
ownership of Tract NO.1 vested in Rebecca Gipe Shartzer, pursuant to the provisions
of Joshua Gipe's will. Rebecca Gipe Shartzer was born in 1849 and died on December
25, 1926.

The Cumberland County Register of Wills office shows that Rebecca Gipe
Shartzer died intestate and that Flora A. Shartzer was appointed personal
representative on January 21, 1927. Rebecca's husband, George W. Shartzer had
predeceased her in 1919. Rebecca and George had five children, Flora Agnes
Shartzer, born in 1867 and died in 1955; Elmira S. Smith, born in 1871 and died in
1957; Martha J. Lindsay, born in 1869 and died on June 10, 1910; George E. Shartzer,
date of birth and death unknown, although he is believed to have left the area in 1931
and was reported to have moved to the Slippery Rock area, and Alice Shartzer Mowers,
born in 1880 and died in 1950. According to intestate succession in Pennsylvania,
Rebecca Gipe Shartzers' interest in the property would have passed in fifths to these
five children.
THE HEIRS OF REBECCA GIPE SHARTZER:
George E. Shartzer was believed to have been born in the 1870's. Family
records reflect that he was a vagabond and was reported to have settled in the Slippery
Rock, Pennsylvania area. The Plaintiff has traveled to the Slippery Rock area and
checked the cemeteries to see if a marker for George E. Shartzer could be located.
The Plaintiff, Robert Eugene Lindsay, Sr. was born in 1923 and recalls his uncles
departure. The Plaintiff has maintained contact through the years with all of George's
sisters and other members of the family and no one knows what happened to George
as he stopped all contact with the family. 'This is one of the individuals and his heirs
which the Plaintiff seeks to serve by publication.

Flora A. Shartzer was another child of Rebecca Gipe Shartzer and was the
Plaintiff's aunt. Flora never married and had no children. Flora was the individual who
received the letters on her mother in January of 1927. Flora was born August 13,1867
and died May 29, 1955. She died in Cumberland County and the Cumberland County
Register of Wills office reflects that no application was made for a personal
representative to be appointed. Accordingly, her one fifth interest in Rebecca Gipe
Sharzter's property would have passed to her brothers and sister or her nieces and
nephews.
Elmira Shartzer married Charles Smith and they had two children, Arthur Smith
and Rhoda Smith Horner. Elmira Smith was born in 1871 and died in 1957. The
Cumberland County Registers office indicates that no estate was opened. Elmira Smith
survived her husband who had died in the1930's. Accordingly, her one fifth interest
passed to her two children, Arthur Smith and Rhoda Smith Horner.
Arthur Smith died in the 1970's in Cumberland County and the Registers office
has no record of an estate being opened. Arthur Smith had one child, Charles Smith
who had moved to the West Coast and died in California in the 1970's and whose body
was returned to Cumberland County for burial. Charles Smith had married a woman,
Ethel Smith whose whereabouts are unknown, although the Plaintiff does know that she
has passed away. The Plaintiff is unable after his close contact with the family
members to account for the fractional share which would have passed to Charles Smith
upon the deaths of his parents or to his wife, Ethel Smith. All family members with

whom the Plaintiff has maintained close contact have no idea where Ethel died and
whether or not she had any relatives surviving that would take under the intestate law.
Service of these unknown and unnamed individuals are requested by publication.
Elmira's other child was Rhoda Smith who died on March 27, 1989. Rhoda
Smith had married William Horner and her interest in the real estate would have passed
under the residuary clause of her will, which will is recorded in Will Book 110, Page 368
in Cumberland County. There were seven persons identified under the residuary
clause, five individuals and two churches. Attached hereto and incorporated herein is
a copy of Rhoda Smith Horner's will and Schedule J indicating her beneficiaries. The
Plaintiff will attempt to obtain releases or service upon the two churches and the
individuals to the extent that these individuals can be located.
Martha Jennie Shartzer was the mother of the Plaintiff. Martha Jennie Shartzer
married George W. Lindsay and they had three children. Martha Jennie Lindsay
passed away in 1910 and was survived by her husband and the three children.
The Plaintiffs brother, John McKnight Lindsay was born on January 5, 1908 and
died on July 21, 1975. He had married Nellie Mae Lindsay who passed away on
December 25, 1983. An estate was opened to No. 21-84-68 and her interest in the
real estate would have passed to her children, Donald Lee Lindsay, born in 1934, Ruby
M. Lindsay, born in 1937, Cynthia Lindsay, born in 1940 and Johnnie Lindsay born in
1942. It is believed that the Plaintiff can obtain service and/or releases upon Donald,

The Plaintiffs other brother, George Howard Lindsay was born on June 3, 1910
and died on April 12, 1983. George married Louella Burkhart Lindsay and she died on
December 9,2000. An estate was opened in Cumberland County docketed to No. 21-
2000-1078. There was no estate opened for George Lindsay and it is believed that his
interest in the property would have passed to Louella. George and Louella had three
children, two of which predeceased their parents, Janice in 1969 and Ray in 1975. One
child survived and that individual is Howard J. Lindsay. Howard J. Lindsay lives in
FI.orida and in Pennsylvania. The Plaintiff believes that he can locate Howard J.
Lindsay and obtain service of this action.
The fifth and final child of Rebecca Gipe Shartzer was Alice Shartzer who
married James Mowers. Alice was born in 1880 and died in 1950 survived by her
husband who died in the 1980's. Alice and James had nine children. Her nine children
were Ralph Mowers who died in 1982, Esther Schell who died in the 1970's or 1980's in
Dauphin County, Ruth Mowers who never married but had two children. (One of Ruth's
children was the Plaintiff, who as a child was adopted and raised by George and
Martha Lindsay. The other child is Romaine S. Negley, the Plaintiffs half-sister prior to
the adoption. The Plaintiff believes that he can obtain service and/or a release from
Romaine Negley.) Another child of Alice Shartzer Mowers was Herman Mowers who
died in Perry County. Herman Mowers married but he and his wife had no children.
The Plaintiff has no idea of the whereabouts of Herman's wife or if she has died.

County Register of Wills indicates that no estate was opened for Raymond and the
Plaintiff knows that Raymond never married and never had any children. Service by
publication for Raymond and his potential heirs are requested. Melvin Mowers died in a
hotel fire in 1969 in Chambersburg, Pennsylvania. Melvin also never married and had
no children. Accordingly there are no known heirs of Melvin and service by publication
on Melvin and his potential heirs is requested. Harold Mowers, Rachel Mowers Horn
and Norman Mowers are all living and the Plaintiff will attempt to obtain service and/or a
release from these heirs. Rachel Mowers is believed to be living in a nursing home.
The Plaintiff believes that Rachel Mowers had four or five children although there
present whereabouts are unknown and accordingly if he is unsuccessful in locating her
whereabouts he requests service by publication be made upon Rachel Mowers, her
heirs, guardians and/or assigns.
TRACTS NUMBERS 2 AND 3
The Tract Nos. 2 and 3 in the Complaint will be referred to as the Lindsay tracts.
At the present time these tracts, like tract No.1, have no structures on them and the
Plaintiff has been paying the taxes on these properties since the 1940's. Tract NO.2
was conveyed to John C. Lindsay on March 1, 1919 and was recorded in Cumberland
County Deed Book T Volume 8 Page 115 on March 18, 1919. Tract NO.3 was
conveyed to John C. Lindsay by Deed notarized April 13, 1920 and recorded in the
Cumberland County Recorder of Deeds office. The Plaintiff is a grandson of John C.
Lindsay. John C. Lindsay married Joanne McKnight Lindsay and they had four

children, George W. Lindsay, Margaret Ann Lindsay McElwee, William C. Lindsay and
Mary Jane Lindsay Hoppis.
THE HEIRS OF JOHN C. LINDSAY:
George W. Lindsay was born in 1885 and died in 1949. He is the father of the
Plaintiff and had married Martha Jennie Shartzer who was one of the heirs of the Gipe
tract. Fractional interests in all three tracts arise due to the relationship of the
Gipe/Shartzer line and the Lindsay line. Accordingly, the information in reference to the
heirs of the Gipe/Shartzer line of the family appear on the earlier pages of this Affidavit.
Another child of John C. Lindsay was Margaret Ann Lindsay. She was born in
1886 and died in 1921. Margaret Ann Lindsay married Charles E. McElwee who had
been born in 1887 and passed away in 1923. MargaretMcElwee had five children,
Blanche McElwee, Margaret Lorraine McElwee, Charles Earl McElwee, Anna Jane
McElwee and James Clair McElwee. Attached hereto are copies from the Lindsay
family history outlining this branch of the family.
Blanche McElwee was born in 1909 and married Vernie D. Myers, Sr.; Margaret
Lorraine McElwee was born in 1914 and died in 1966 and married Ira Philip Davis who
was born in 1913 and died in 1955; Charles Earl McElwee was born in 1917 and died in
1923; Anna Jane McElwee was born in 1919 and died in 1970 she married Merle
William Davis born 1926 and died in 1975; James Clair McElwee was born in 1920 and
married Opal Irene Shultz born in 1927.

The five children of Margaret McElwee had collectively fourteen children. At this
point the original one quarter interest of Margaret Ann Lindsay McElwee in these two
small unimproved lots has become anywhere from a one twentieth interest in her
children to a one fifty sixth interest or greater, depending on the number of children
each child had, in Margaret McElwees fourteen grandchildren. Plaintiff believes he can
obtain addresses for some of these heirs and will attempt to serve them and/or obtain
releases. Nevertheless, he requests service by publication on this branch of the family.
Another son of John C. Lindsay was William C. Lindsay who was born on
October 3, 1886 and died on October 16, 1944. He married Stella Mae who was born
on January 28, 1891 and died on November 20, 1979. They had fifteen children, six of
whom passed away before William C. Lindsay died and nine who survived him. Two of
the children are known, Harold Meily Lindsay and Frances Amelia Lindsay Widders.
The Plaintiff will attempt to obtain service and/or releases upon the members of this line
of the family that he can locate. Service by publication is requested on those he cannot
serve or locate.
The fourth child of John C. Lindsay was Mary Jane Lindsay who was born on
September 9, 1891 and died on April 4, 1959. She had married Alfred Birton Hoppis
who was born September 13,1891 and who died on June 15,1957. They had one
child, Winnie Fay Hoppis Stoner born June 8, 1927 who is still living. The branch of this
Lindsay family is also attached to this Affidavit. The Plaintiff will attempt to obtain
service and/or a release upon Winnie Fay Hoppis Stoner.

CONCLUSION:
Due to the large number of potential heirs that have small fractional interests in
the three tracts of unimproved real estate, service by publication is requested upon all
members with the understanding that the Plaintiff will exercise due diligence in serving
all heirs he can identify using reasonable diligence. Attached hereto is a list of the
addresses the Plaintiff has secured.
