Motion for Default Judgment
AND NOW this ~ day of March, 2001 comes CHARLES E, NACE and
JULIE M, PENNAY-NACE, husband and wife and Petitioners in the above captioned
civil action, by and through their attorney, John M, Glace, Esquire, and, pursuant to Rule
1037 of the Pennsylvania Ru1es of Civil Procedure, respectfully moves Your Honorable
Court to enter a Judgment Default against the above Respondent and grant other relief to
the Petitioners as herein requested, and, in support thereof, presents the following:
1. Petitioners filed a pro se Petition to Obtain Title to two (2) motor vehicles:
1970 Homette Trailer (VIN: MP734D) and a 1981 D&D Mobile Home (VIN:
DD 1280 122899) after they had paid in full the purchase prices as stated in a sales
agreement. Petitioner had failed to respond to repeated requests for compliance,
2, As a result of the above pro se Action, Your Honor designated February 7,
2001 at 3:30 PM in Courtroom 5 of the Cumberland County Courthouse as the time and
place for a hearing relative to this action.
3, At that time and place, Respondent appeared and, upon knowledge and belief,
questioned the service of the underlying Complaint. notwithstanding the obvious
contradiction that the Respondent appeared to challenge service, Your Honor entered an
Order of Court, attached hereto as Exhibit "iV' and made part hereof, directing
Respondent to file an answer within twenty (20) days and thereafter the Action would
proceed pursuant to the Rule of Civil Procedure,

4, In addition to the above advisement, delivered by This Honorable Court of
record, Your Honor asked for Respondent's mailing address and directed that the above
advisement be transcribed and delivered by mail to the address Respondent provided the
Court,
5, Twenty (20) days have elapsed since the February 7, 2001 Order of Court, No
responsive pleading has been received by Petitioners nor filed of record,
6, Petitioners retained the undersigned attorney, who, pursuant to the
Pennsylvania Rules of Civil Procedure, mailed on March 6, 2001 to Respondent an
Important Notice requesting him to respond to the February 7, 2001 Order of Court and
file a responsive pleading within ten (10) days or Petitioners would file for default
Judgment. Because of Respondent's continuing obdurance, this Important Notice was
mailed by two (2) means, as follows:
a, By First Class Mail, Return Receipt Requested (# Z 215 746 165 ); a
true and correct copy of the Important Notice and the Receipt for Certified
Mail is attached hereto as Exhibit "B"; and
b. By First Class Mail with a Certification of Mailing; a true and correct
copy of the Important Notice and Certification of Mailing is attached
hereto as Exhibit "C" and made part hereof.
7, Notwithstanding Respondent's representation to This Honorable Court that his
correct mailing address was P.O. Box 220, Enola, P A 17025, there has been no return
service; bJ.I1 the second and certified mailing described above in subparagraph 6b has no
been returned either,
8, Accordingly, Petitioners herebelow respectfully request that Judgment been
entered in their behalf and that the Title to the two (2) vehicles named in the Complaint be
transferred to their names jointly,.
9, Additionally, because this action is remedial and Respondent's acts have been
patently dilatory and obdurate within the purview of Title 42 CSA Section 2503(7),
Petitioners also respectfully move for sanctions to include taxation of all costs incurred or
to be incurred both through the Court of Common Pleas of Cumberland County and at
PennDOT and for payment of Petitioner's attorney's fees,

Petition to Obtain Title of a Purchased Vehicle
1. The Petitioners, Charles E. Nace and Julie M. Pennay-
Nace are the buyers of and they reside at Lot 4, Spring Garden
Estates, Carlisle, Cumberland County, Pennsylvania, 17013.
2. The Respondent, Robert E. Nace, is the seller of the
vehicles and he resides at Third and State Streets, West Fairview,
Cumberland County, Pennsylvania, 17025.
3. The Petitioners and the Respondent entered into an
AGREEMENT OF SALE of two (2) mobile homes which have been combined,
one (1) being a 1970 HOMETTE mobile home VIN MP734D and the other
being a 1981 D&D mobile home VIN DD1280122899, both of which are
located at Lot 4, Spring Garden Estates, Carlisle, Cumberland
County, Pennsylvania. This Sales Agreement was signed on 31 of
March, 1998, and said vehicles were paid in full on 7 of April, 2000.
4. Under the terms of the above mentioned Sales Agreement,
the titles to said mobile homes were to be signed over to the
Petitioners on the date the final payment was received.
5. Even though the Respondent was contacted on several
occasions by telephone, and proof of final payment was furnished
to him, on more than one occasion, the Respondent has refused time
and time again to submit said titles for transfer to the Petitioners.
The respondent has even refused to listen to his lawyer regarding
this matter of these titles, as was related to us and our former
Attorney at Law.

6. The Respondent has even contacted the Petit~oners'
residence by telephone, and on Four (4) separate occasions has
even threatened to kill one of the Petitioners because of these
Titles. The Pennsylvania State Police were notified each time
of these threats.
7. The Respondent has been given more than ample time
to sign the aforementioned titles over to the Petitioners, so the
Petitioners are asking the Court to intervene on their behalf and
to issue a Court Order stating that they are the true and right-
ful owners and should be listed as so on the said titles for the
abovementioned vehicles and that a copy of the Court Order be sent
to The PENNSYLVANIA DEPARTMENT OF TRANSPORTATION so that this may
be done.
8. The Petitioners are also asking the Court to order the
Respondent to reimburse them the costs of filing this Petition
and to pay all other costs incurred with the hearing of the Court
of this matter, including but not limited to Court costs and any
other costs that may incur in serving these Notices to the
Respondent.

AGREEMENT OF SALE
ARTICLES OF AGREEMENT, made this 31st day of March, 1998, between
ROBERT E. NACE and SHIRLEY A. NACE, husband and wife, of 114 North 2nd Street,
Wormleysburg, Pennsylvania, 17043, hereinafter (whether singular or plural) called Sellers,
and
CHARLES E. NACE and JULIE M. PENNA Y, as joint tenants with the right of
. survivorship, of the Borough of Carlisle, Cumberland County, Pennsylvania, 17013,
hereinafter (whether singular or plural) called Buyers,
WITNESSETH:
WHEREAS, Sellers herein are the owners of two mobile homes which have been
combined, one mobile home being a Homette mobile home VIN MP734D and the other being
a 1981 D&D mobile home VIN DD1280122899 both of which are situate on a lot of ground in
a mobile home park said lot known as Lot No.4, Spring Garden Estates, South Middleton
Township, Cumberland County, Pennsylvania which lot of ground Seller leases through
Property Management, Inc,; and
WHEREAS, Sellers desire to sell and Buyers desire to purchase the said mobile homes
and Sellers agree to assign to Buyers all of their right, title, and interest in the lease for the lot
of ground on which the mobile homes are situate.
WHEREFORE, the parties hereto, for the consideration hereinafter described and
intending to be legally bound hereby, agree as follows:
1. Sale and Purchase. Sellers, for the consideration hereinafter mentioned, agree to
sell and transfer unto the Buyers, their heirs and assigns, and Buyers agree to purchase and
accept the Homette mobile home VIN MP734D and the 1981 D&D mobile home VIN
DD1280122899, situate on Lot 4 Spring Garden Estates, South Middleton Township,
Cumberland County, Pennsylvania, which lot is leased by Sellers through Property
Management, Inc.

2. Purchase Price. In consideration whereof, the said Buyers agree to pay to the said
Sellers therefor, the sum of Seven Thousand ($7,000.00) Dollars in monthly installments as of
$323.02 said monthly installments to be applied first to interest at the rate of ten percent
(19%) per annum on the unpaid balance of principal and the remaining portion of each such
installment to reduction of principal said monthly installments to be paid on or before the 1st
day of each month beginning May 1, 1998. Seller agrees to pay a late charge of five percent
(5 %) of any monthly payment which is not made within fifteen (15) calendar days of its due
date.
3. Prepayment. Buyer shall have the privilege of paying as much more than the
required monthly installment of principal and interest as she desires, and nothing contained in
this Agreement shall be construed to limit her to said amount.
4. Taxes, Insurance, Assessments, Repairs and Charges. In addition to the said
monthly installments on account of purchase price and interest thereon, said Buyer agrees to
pay the taxes and municipal assessments, utility charges (if any), make all necessary repairs to
the premises, and keep in force not less than Seven Thousand ($7,000.00) Dollars of fire
insurance with extended coverage, with loss payable to the parties hereto as their interests may
appear. In addition, Buyer shall acquire and keep in full force and effect during the term of
this Agreement liability insurance in an amount of at least One Hundred Thousand
($100,000.00) Dollars for accident, injury or death to anyone person or to property, and
Three Hundred Thousand ($300,000.00) Dollars for accident, injury or death to persons or
property arising out of anyone occurrence, with Seller being named as additional insured. A
copy of said policy shall be provided to Seller.
5. Place of Payment. All payments shall be made to Seller at such address as said
Seller shall supply to said Buyer.
6. Possession. It is also agreed between the parties hereto that possession of said
premises shall be delivered to said Buyer on the 31st day of March, 1998, and that said Buyer
shall be entitled to receive rents, issues and profits therefrom from said date of delivery of
possession, subject to the conditions set forth herein. Buyer has inspected the property ,
including the improvements thereon, immediately prior to signing this Agreement, and accepts
said property in its present condition.
7. Alterations. Buyer agrees not to make any substantial alteration of the condition of
the mobile home without fIrst securing the written consent and approval of the Seller.
8. Title. Seller will retain title to the mobile homes in Sellers name until such time as
payment is made in full under the terms of this agreement. At that time, Seller will transfer to
Buyer the certificates of title for said mobile homes and Buyer shall be responsible for all costs
incurred upon said transfer.

9. Lot rental. Buyers have entered into a lease agreement for the lot on which the
mobile homes are situate within Spring Garden Estates mobile home park. The landlord,
however, required that Robert E. Nace, one of the Sellers herein, also join in the execution of
sai}i lease and assume responsibility thereunder. Buyers herein agree to assume all obligations
under the terms of said lease including all payments required thereunder and to abide by all
rules and regulations as established by the mobile home park. Buyer shall indemnify and hold
harmless and shall be responsible to reimburse Robert E. Nace for any and all expenses which
he may incur as a result of Buyers failure to abide by said lease or to make any payments
required thereunder.
10. Tax Proration and Sales Tax. Taxes for the current year will be prorated
between the parties hereto using the fiscal year of the taxing authorities as the basis, and the
date of this agreement, as prorating date. When the certificate of title to the mobile homes are
transfer to Buyer, Buyer shall be responsible for the payment of all sales and use taxes due to
the Commonwealth of Pennsylvania, if any, for said transfer and all other costs associated
with said transfer,
11. Breach by Buyer; Remedies of Seller. In the event Buyer shall fail to make said
monthly payments as aforesaid for the sPilce of thirty (0) days after the same shall have
become due and payable by the terms hereof, or if a breach of any of the other foregoing
conditions be made by the Buyer and not cured within ten (10) days of receipt of written notice
from Seller of said breach, Seller, at his option, may:
a. Declare a "forfeiture of Buyer's rights hereunder and cancellation of
this Agreement. On such election, all right, title and interest of Buyer
hereunder shall cease and determine, and all payments theretofore made by
Buyer shall be retained by Seller as liquidated damages and as rental for the use
and occupancy of the property, and, in such event, the Prothonotary or any
attorney of any Court of Record of Cumberland County is hereby authorized to
appear for and confess judgment in an amicable action of ejectment against the
said Buyer, his heirs, assigns, executors, administrators or lessees, and in favor
of the Seller, his heirs, assigns, administrators and executors, for the premises
herein described, and to direct the immediate issuing of Writ of Possession with
Writ of Execution for costs, including an attorney's fee of ten percent (10%) of
the unpaid balance of the purchase price, without notice and without asking
leave of Court;
b. In lieu of declaring a forfeiture, accelerate and confess judgment, or
accelerate and bring an action for the balance of the purchase price remaining
due, or for any other relief available in law or equity, including suit to recover
any payment or payments made by Seller and repayable by Buyer hereunder, it
being stipulated and agreed that such obligation to repay is a separate and
independent covenant of Buyer hereunder. No action to recover any payment or

payments so made by Seller shall constitute a waiver by Seller of his right to
proceed otherwise with respectto any subsequent default. Buyer hereby
authorizes any Prothonotary or attorney to appear for and confess judgment
against the Buyer and in favor of the Seller for the entire unpaid balance of the
purchase price, together with costs, interest, insurance payments, etc., and with
ten percent (10%) added as an attorney's fee.
12. Breach by Seller; Remedies of Buyer. In the event that the Seller shall fail or
refuse to make settlement in accordance with the terms of this Agreement, the Buyer at his
option may bring suit against the Seller for breach of contract or bring suit for specific
performance.
13. No Waiver. Acceptance by Seller of any of the aforesaid monthly payments after
the same shall have become past due and in default, or any failure to enforce any of the rights
herein reserved to the Seller, or any of the penalties, forfeitures, damages or conditions herein
contained, shall not in any wise be considered a waiver of the right to enforce the same at any
time, without notice whatsoever, and any attempt to collect the amount due by one proceeding
shall not be considered a waiver of the right to enforce any of the other proceedings herein
contained, but all of the rights of the Seller and all forfeitures, penalties, damages and
conditions may be enforced, together or succ~ssively, at the option of Seller.
14. Amendment. No amendment or modification of this Agreement shall be valid
unless the same shall be in writing and signed by both parties.
15. Entire Agreement. This Agreement constitutes the entire agreement between the
parties and supersedes any prior written or oral agreements between them respecting the within
subject matter. There are no warranties, representations, agreements, arrangements or
understandings, oral or written, between and among the parties hereto relating to the subject
matter of this Agreement which are not fully expressed herein.
16. Assignment. The interest of the Buyer in this Agreement shall not be assignable,
by sale, assignment, lease, subleasing or otherwise, in whole or in part, without the prior
written consent and approval of Seller, and if such assignment is attempted, all rights and
remedies of the Seller set forth herein, or which the Seller might otherwise have, shall
immediately accrue to the Seller. Transfer of title by Will, survivorship or by descent shall
not be regarded as an assignment requiring the consent and approval of Seller. Seller agrees
not to unreasonably withhold a requested consent.
17. Recording. This Agreement shall not be recorded.
18. Time of the Essence. It is the agreement of the parties hereto that time shall be of
the essence.

19. Binding Effect. This Agreement is to extend to and be binding upon the heirs,
successors, executors, administrators and assigns of the parties hereto.

Petition to Obtain Title of a Purchased Vehicle
1. The Petitioners, Charles E. Nace and Julie M. Pennay-
Nace are the buyers of and they reside at Lot 4, Spring Garden
Estates, Carlisle, Cumberland County, Pennsylvania, 17013.
2. The Respondent, Robert E. Nace, is the seller of the
vehicles and he resides at Third and State Streets, West Fairview,
Cumberland County, Pennsylvania, 17025.
3. The Petitioners and the Respondent entered into an
AGREEMENT OF SALE of two (2) mobile homes which have been combined,
one (1) being a 1970 HOMETTE mobile home VIN MP734D and the other
being a 1981 D&D mobile home VIN DD1280122899, both of which are
located at Lot 4, Spring Garden Estates, Carlisle, Cumberland
County, Pennsylvania. This Sales Agreement was signed on 31 of

March, 1998, and said vehicles were paid in full on 7 of April, 2000.
4. Under the terms of the above mentioned Sales Agreement,
the titles to said mobile homes were to be signed over to the
Petitioners on the dat~ the final payment was received.
5. Even though the Respondent was contacted on several
occasions by telephone, and proof of final payment was furnished
to him, on more than one occasion, the Respondent has refused time
and time again to submit said titles for transfer to the Petitioners.
The respondent has even refl)sed to listen to his lawyer regarding
this matter of these titles, as was related to us and our former
Attorney at Law.

6. The Respondent has even contacted the Petitioners'
residence by telephone, and on Four (4) separate occasions has
even threatened to kill one of the Petitioners because of these
Titles. The Pennsylvania State Police were notified each time
of these threats.
7. The Respondent has been given more than ample time
to sign the aforementioned titles over to the Petitioners, so the
Petitioners are asking the Court to intervene on their behalf and
to issue a Court Order stating that they are the true and right-
ful owners and should be listed as so on the said titles for the
abovementioned vehicles and that a copy of the Court Order be sent
to The PENNSYLVANIA DEPARTMENT OF TRANSPORTATION so that this may
be done.
8. The Petitioners are also asking the Court to order the
Respondent to reimburse them the costs of filing this Petition
and to pay all other costs incurred with the hearing of the Court
of this matter, including but not limited to Court costs and any
other costs that may incur in serving these Notices to the
Respondent.

AGREEMENT OF SALE
ARTICLES OF AGREEMENT, made this 31st day of March, 1998, between
ROBERT E. NACE and SHIRLEY A. NACE, husband and wife, of 114 North 2nd Street,
Wormleysburg, Pennsylvania, 17043, hereinafter (whether singular or plural) called Sellers,
and
CHARLES E. NACE and JULIE M. PENNA Y. as joint tenants with the right of
survivorship, of the Borough of Carlisle, Cumberland County, Pennsylvania. 17013,
hereinafter (whether singular or plural) called Buyers.
WITNESSETH:
WHEREAS, Sellers herein are the owners of two mobile homes which have been
combined, one mobile home being a Homette mobile home VIN MP734D and the other being
a 1981 D&D mobile home VIN DD1280l22899 both of which are situate on a lot of ground in
a mobile home park said lot known as Lot No.4, Spring Garden Estates, South Middleton
Township, Cumberland County, Pennsylvania which lot of ground Seller leases through
Property Management, Inc.; and
WHEREAS, Sellers desire to sell and Buyers desire to purchase the said mobile homes
and Sellers agree to assign to Buyers all of their right, title, and interest in the lease for the lot
of ground on which the mobile homes are situate_
WHEREFORE, the parties hereto, for the consideration hereinafter described and
intending to be legally bound hereby, agree as follows:
1. Sale and Purchase. Sellers, for the consideration hereinafter mentioned, agree to
sell and transfer unto the Buyers, their heirs and assigns, and Buyers agree to purchase and
accept the Homette mobile home VIN MP734D and the 1981 D&D mobile home VIN
DD1280122899, situate on Lot 4 Spring Garden Estates, South Middleton Township,
Cumberland County, Pennsylvania, which lot is leased by Sellers through Property
Management, Inc.

2, Purchase Price. In consideration whereof, the said Buyers agree to pay to the said
Sellers therefor. the sum of Seven Thousand ($7,000.00) Dollars in monthly installments as of
$323_02 said montWy installments to be applied first to interest at the rate of ten percent'
(19 %) per annum On the unpaid balance of principal and the remaining portion of each such
installment to reduction of principal said monthly installments to be paid on or before the 1st
day of each month beginning May 1, 1998, Seller agrees to pay a late charge of five percent
(5 %) of any monthly payment which is not made within fifteen (15) calendar days of its due
date,
3_ Prepayment. Buyer shall have the privilege of paying as much more than the
required monthly installment of principal and interest as she desires, and nothing contained in
this Agreement shall be construed to limit her to said amount
4. Taxes, Insurance, Assessments, Repairs and Charges. In addition to the said
monthly installments on account of purchase price and interest thereon, said Buyer agrees to
pay the taxes and municipal assessments. utility charges (if any), make all necessary repairs to
the premises, and keep in force not less than Seven Thousand ($7,000.00) Dollars of fire
insurance with extended coverage, with loss payable to the parties hereto as their interests may
appear. In addition, Buyer shall acquire and keep in full force and effect during the term of
this Agreement liability insurance in an amount of at least One Hundred Thousand
($100.000.00) DolIars for accident, injury or death to anyone person or to property, and
Three Hundred Thousand ($300,000.00) Dollars for accident, injury or death to persons or
property arising out of anyone occurrence, with Seller being named as additional insured. A
copy of said policy shall be provided to Seller.
5. Place of Payment. All payments shall be made to Seller at such address as said
Seller shall supply to said Buyer.
6, Possession. It is also agreed between the parties hereto that possession of said
premises shall be delivered to said Buyer on the 31st day of March, 1998, and that said Buyer
shall be entitled to receive rents, issues and profits therefrom from said date of delivery of
possession, subject to the conditions set forth herein_ Buyer has inspected the property,
including the improvements thereon, immediately prior to signing this Agreement, and accepts
said property in its present condition.
7. Alterations. Buyer agrees not to make any substantial alteration of the condition of
the mobile home without first securing the written consent and approval of the Seller.
8. Title. Seller will retain title to the mobile homes in Sellers name until such time as
payment is made in full under the terms of this agreement At that time, Seller will transfer to
Buyer the certificates of title for said mobile homes and Buyer shall be responsible for all costs
incurred upon said transfer.

9. Lot rental. Buyers have entered into a lease agreement for the lot on which the
mobile homes are situate within Spring Garden Estates mobile home park. The landlord,
however, required that Robert E, Nace, one of the Sellers herein, also join in the execution of
sai(llease and assume responsibility thereunder. Buyers herein agree to assume all obligations
under the terms of said lease including all payments required thereunder and to abide by all
rules and regulations as established by the mobile home park, Buyer shall indemnify and hold
harmless and shall be responsible to reimburse Robert E, Nace for any and all expenses which
he may incur as a result of Buyers failure to abide by said lease or to make any payments
required thereunder.
10, Tax Proration and Sales Tax. Taxes for the current year will be prorated
between the parties hereto using the fiscal year of the taxing authorities as the basis, and the
date of this agreem<':nt, as prorating date_ When the certificate of title to the mobile homes are
transfer to Buyer, Buyer shall be responsible for the payment of all sales and use taxes due to
the Commonwealth of Pennsylvania, if any. for said transfer and all other costs associated
with said transfer.
11. Breach by Buyer; Remedies of Seller. In the event Buyer shall fail to make said
monthly payments as aforesaid for the space of thirty (30) days after the same shall have
become due and payable by the terms hereof, or if a breach of any of the other foregoing
conditions be made by the Buyer and not cured within ten (10) days of receipt of written notice
from Seller of said breach, Seller, at his option, may:
a. Declare a forfeiture of Buyer's rights hereunder and cancellation of
this Agreement. On such election, all right, title and interest of Buyer
hereunder shall cease and determine, and all payments theretofore made by
Buyer shall be retained by Seller as liquidated damages and as rental for tjJ.e use
and occupancy of the property, and, in such event, the Prothonotary or any
attorney of any Court of Record of Cumberland County is hereby authorized to
appear for and confess judgment in an amicable action of ejectment against the
said Buyer. his heirs, assigns, executors, administrators or lessees, and in favor
of the Seller, his heirs, assigns, administrators and executors, for the premises
herein described, and to direct the immediate issuing of Writ of Possession with
Writ of Execution for costs, including an attorney's fee of ten percent (10%) of
the unpaid balance of the purchase price, without notice and without asking
leave of Court;
b. In lieu of declaring a forfeiture, accelerate and confess judgment, or
accelerate and bring an action for the balance of the purchase price remaining
due, or for any other relief available in law or equity, including suit to recover
any payment or payments made by Seller and repayable by Buyer hereunder, it
being stipulated and agreed that such obligation to repay is a separate and
independent covenant of Buyer hereunder. No action to recover any payment or

payments so made by Seller shall constitute a waiver by Seller of his right to
proceed otherwise with respect to any subsequent default. Buyer hereby
authorizes any Prothonotary or attorney to appear for and confess judgment
against the Buyer and in favor of the Seller for the entire unpaid balance of the
purchase price, together with costs, interest, insurance payments, etc_, and with
ten percent (10%) added as an attorney's fee,
12. Breach by Seller; Remedies of Buyer. In the event that the Seller shall fail or
refuse to make settlement in accordance with the terms of this Agreement, the Buyer at his
option may bring suit against the Seller for breach of contract or bring suit for specific
performance.
13_ No Waiver. Acceptance by Seller of any of the aforesaid monthly payments after
the same shall have become past due and in default, or any failure to enforce any of the rights
herein reserved to the Seller, or any of the penalties, forfeitures, damages or conditions herein
contained, shall not in any wise be considered a waiver of the right to enforce the same at any
time, without notice whatsoever, and any attempt to collect the amount due by one proceeding
shall not be considered a waiver of the right to enforce any of the other proceedings herein
contained, but all of the rights of the Seller and all forfeitures, penalties, damages and
conditions may be enforced, together or successively, at the option of Seller.
14. Amendment. No amendment or modification of this Agreement shall be valid
unless the same shall be in writing and signed by both parties.
15. Entire Agreement. This Agreement constitutes the entire agreement between the
parties and supersedes any prior written or oral agreements between them respecting the within
subject matter. There are no warranties, representations, agreements, arrangeml;nts or
understandings, oral or written, between and among the parties hereto relating to the subject
matter of this Agreement which are not fully expressed herein.
16. Assignment. The interest of the Buyer in this Agreement shall not be assignable,
by sale. assignment, lease, subleasing or otherwise, in whole or in part, without the prior
written consent and approval of Seller, and if such assignment is attempted, all rights and
remedies of the Seller set forth herein, or which the Seller might otherwise have, shall
immediately accrue to the Seller. Transfer of title by Will, survivorship or by descent shall
not be regarded as an assignment requiring the consent and approval of Seller. Seller agrees
not to umeasonably withhold a requested consent.
17. Recording. This Agreement shall not be recorded.
18. Time of the Essence. It is the agreement of the parties hereto that time shall be of
the essence.

19. Binding Effect. This Agreement is to extend to and be binding upon the heirs,
successors, executors, administrators and assigns of the parties hereto.

I have been retained for several matters involving the above Defendant by both his
family and the Conrads, his estranged wife's family. This wowd include the 3:300 Plv1
hearing yesterday in the above matter; however my agreement to attend and represent
Plaintiffs was only after 1 was advised by telephone of this additional action
Unfortunately, during this wel:k's Dauphin County criminal week, I became attached fc_" a
pretrial criminal matter and was not available, even to call your oHice until 4 30 PM
Without proffering this as an excuse, I have traversed the Carlisle to Harrisburg Route R I
section numerous times already this week
I did talk to Julie Nace iast night and she informed me ( on a very basic level )
what had transpired in Court yesterday, Since I was provided only a partial copy ofthe
pleadings. I did have some questions; which I infer were the same questions you presented
to both parties, both appearing before you pro sc. I did confer ,vith Julie Naee regarding
service durillg a collateral 1l<-1ion involving Robert Nace last week before Judge Oler and
stressed the importallce ofpertectcd service It is my understanding that Robert Naee
appe<tred and admitted knowledge ofthe yesterday's hearing, but denied perfected
service. This obdurate behavior is consistent with his history lor aU litigation in
Cumberland County that I have reviewed including several PFA contempt hearings befort~
Your Honorable Court.
It is my t111ther understand.ing that you have issued a Rule to Robert Nllce,
requesting him to show cause why he won't sign the title over to his brother and

other Order relative to the above action to my office and 1 will immediately address it
