Crabtree, by and through his undersigned counsel, hereby files this Motion for Leave to File Appeal from District Judgment Nunc Pro Tunc in avers and support thereof the following: 1. Movant is Thomas C. Crabtree, an adult individual with an address of 5 Sara Drive, Dover, Pennsylvania 17315. 2, Respondent is Zeplin's Security Group, with an address of2026 Market Street, Camp Hill, Pennsylvania 17011. 3. On or about October 12, 2000, Respondent Zeplin's Security Group filed a Complaint before District Justice Robert V. Manlove against Movant seeking $2,641.30 as a result of an alleged breach of contract. 4. This action was docketed at CV-375-00. 5 The contract involved the installation of a security system at the Movant's home, together with monthly monitoring. , , , ].. 1""1' I "--~-== '1.,.."", ,_. 6. On or about October 30, 2000, Movant filed a counterclaim againstthe Respondent in the amount of$3,380.20 also as a result of breach of the same contract. 7. The Movant's complaint was also docketed at No. CV-375-00, the identical docket number, 8. On December 5, 2000, the Honorable District Justice Robert Manlove entered judgment on both cases under the same docket number. 9. The District Justice entered a judgment in the amount of $2,707.30 in favor of the Respondent on the Respondent's claim, docketed at No. CV-375-00, and entered judgment for the Respondent on the Movant's claim also docketed at No. CV- 375-00. 10. On January 2, 2001, Movant filed a Notice of Appeal on the appropriate form appealing the judgments entered in Docket No. CV -375-00, believing the Movant had appealed both judgments entered by the District Justice. 11. As Movant's counsel was preparing its complaint in this matter, Movant's counsel discovered certain case law that suggests separate notices of appeal should have been filed in this case. 12. Movant's counsel filed only one notice of appeal inasmuch as the judgments both contained an identical docket number, CV-375-00. 13. District Justice Manlove was notified of the appeal from the decision at Docket No. CV -375-00 by certified mail, return receipt requested on January 3, 2001, 14. The Prothonotary's Rule to File a Complaint is dated January 2, 2001. 2 " , " 'r" 15. The Respondent, Zeplin's Security Group, was served with the Notice of Appeal and Rule to File a Complaint by certified mail, return receipt requested, on January 3, 2001. 16. To date, no entry of appearance has been entered on behalf of the Respondent, and no complaint has been filed on behalf of the Respondent. 17. While Movant believes that he has preserved all issues as a result of filing an appeal from the judgment entered by the District Justice at Docket No. CV -375-00, out of an abundance of caution, Movant respectfully requests leave of this Honorable Court to file a separate appeal from the Movant's action against Respondent, docketed at the same docket number. 18. The Respondent will not be prejudiced in any way as a result of this action. 19. Movant has demonstrated good cause herein as required under the applicable Rules of Civil Procedure inasmuch as the District Justice actions had identical docket numbers. 20.
