Biemesderfer aka Thomas A. Bruno, and represents as follows: 1. Plaintiff obtained judgment against Defendant in the amount of $2,113 .28, on January 2, 2001 (See Exhibit "A" attached). 2. Plaintiff filed a Praecipe for Writ Execution on January 17, 2001. Service of the Writ of Execution was made on February 8, 2001. 3. A Property Claim was filed by Peggy Shiebley and Determination was made in her favor as the lawful owner of the levied upon property. 4. On February 21, 200 I, counsel for Plaintiff scheduled Defendant's deposition for March 19, 2001, and mailed to him, via certified mail, a Notice of Deposition in Aid of Execution and certified Subpoena for Discovery in Aid of Execution (See attached Exhibit "B"), Themail was returned to counsel for Defendant as "Unclaimed." Plaintiff s counsel advised Defendant by certified letter dated April 9, 200 I, that Plaintiff would apply for a writ of attaclunent for civil contempt if the Defendant did not contact counsel for Plaintiff to reschedule his deposition, A copy of the letter and post office receipt showing delivery are attached as Exhibit "D." 8. As a consequence of Defendant's failure to appear, Plaintiff has incurred costs and reasonable attorneys' fees in the amount of $250.00.
