RUMBLEY, Defendant COMPLAINT AND NOW, comes the Plaintiff, Dickinson College, by and through its attorneys, Mattson Deardorff Williams & Otto, and hereby avers as follows: 1. Plaintiff is Dickinson College, a Pennsylvania educational institution and nonprofit corporation with its principle place of business at West Street, Post Office Box 1773, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendant, Laura K. Rumbley, is an adult individual residing at 5771 Oak Drive, Crozet, Virginia 22932-9332. 3. Defendant is currently or was recently enrolled as a student at Plaintiff's educational institution, Dickinson College. 4. Defendant mutually contracted with Plaintiff to pay tuition, dining service fees and other educational expenses as part ofPlaintifl's promise to provide educational services and teaching to Defendant for said payment. 5. Defendant has failed to pay Plaintiff in full as mutually agreed and contracted. A copy of the Defendant's student account is attached hereto as Exhibit "A" and is incorporated herein by reference as if fully set forth. 6. As of October 31, 2000, the outstanding balance due and payable by Defendant to Plaintiff is $6,026.49, plus interest and costs accruing hereafter. See Exhibit "A" attached hereto. 7. The outstanding balance of $6,026.49 represents the total and actual overdue value of the services provided to the Defendant by Plaintiff for which Defendant has yet to pay. COUNTI BREACH OF CONTRACT 8. Plaintiff hereby incorporates by reference the averments contained in paragraphs 1 through 7 of this Complaint. 9. Plaintiff has fulfilled, performed and complied with all obligations and conditions of its agreement and contract for services with Defendant. 10. Defendant has breached the expressed and implied obligations, conditions and terms of agreement ofDefendant's contract with Plaintiffto pay the amounts stated herein. See Exhibit "A" attached hereto. WHEREFORE, Plaintiffdemands judgment against the Defendant inthe amount of $6,026.49 plus interest and costs accruing subsequent to October 31, 2000, and said amount is within the limits set forth for compulsory arbitration in Cumberland County, Pennsylvania. COUNT H QUANTUM MERUIT 11. Plaintiff hereby incorporates by reference the averments contained in paragraphs 1 through 10 of this Complaint. 12. The Defendant is liable to the Plaintiff and/or has been unjustly enriched in the amount of $6,026.49 plus interest and costs accruing subsequent to October 31, 2000. WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of $6,026.49 plus interest and costs accruing subsequent to October 31, 2000, and said amount is within the limits set forth for compulsory arbitration in Cumberland County, Pennsylvania. The loan that I can offer you is the Dickinson Flexible Financing loan, which is a combination parent/student loan. In other words your parents will also have to be on the note with you. Sally will send you an application. Complete it and return it to: Dickinson College Student Accounts Office P.O. Box 1773 Carlisle, PA 17013-2896 If you find a better deal at your local bank or credit union, go for it. The Flexible Financing interest rate is less than the 1.5% on an open student account. Tracy told me that you were upset about the short lime frame that Laura was given for contacting us regarding her outstanding account. I know that it is never pleasant to receive a dunning letter of reminder about past due bills, especially those with the notice ofimpending additional legal action. Please let me assure you that we have not yet turned Laura's accounts over to a collection agency, however, we won't be able to hold off indefinitely.
