Defendant, KLP Enterprises, Inc., t1d/bla Lindham Court Apartments, 1101 Lindham Court, #704, Mechanicsburg, Cumberland County, Pennsylvania 17055. 3, On or about June 24, 1999, Plaintiff and Defendant entered into a contract for the preventative maintenance service ninety-six (96) heating and cooling units located at the 1101 Lindham Court address, 4. Plaintiff performed the work contracted for from the dates ofJune 24,1999 through Augnst 6, 1999, Copies of the invoices for each date's work are attached hereto and identified as Exhibit "C" collectively. 7, Plaintiffs bill totaled $13,630.43. 8 To date, Defendant owes Plaintiff $19,339.55, which represents the original invoice charges, finance charges and attorneys fees, 9, Despite Plaintiff's numerous attempts at collection of the monies owed to date, Defendant has continuously refused to make payment to Plaintiff of any of the remaining balance due under the terms of the contract. Due to the volume of work involved, I am using the discounted labor rate of $48.00 per hour. Generally, only customers who hold a regular annual maintenance contract with H.B. McClure Company receive the 10% labor discount, but I feel that in this case the discount is merited. I spoke with Phil, the technician who was on site at your property. He related that he believes that the cleaning! maintenance will take two to two-and..one-half hours per unit. I rounded down tc two hours per unit, (which will probably work out in your favor for some units). I allowed a fe~ dollars for coil cleaners and other shop materials that are used for maintenance services. Phil. also recommends that pleated air filters be used, but we were not sure if you would prefer to supply your own air filters or if you would want us to supply the filters. Therefore, there are two prices: one if you supply nlters, and one if we supply them. The scope of work to be performed is: Air Conditioning Unit: . Change air filters if throwaway, clean if washable . Chemically clean condenser coil . Check condition of evaporative fan motor:> and bearings, and lubricate as needed . Check condition of condenser fan motors and bearings, and lubricate as needed . Check cOndition of fan motor housing and mounts and tighten as needed . Check condition of blower motors and bearings and lubricate as needed . Check and flush condensate drain . Check temperature differential acro:os evaporative coils . Check for oil and refrigerant leaks by visual inspection . Check refrigerant charge, add refrigerant if needed (extra charge for refrigerant ) . Check thermostats and operating controls. The client is to provide reasonable means of access. H.B. McClure will be free to start and stop all primary equipment incidental to the operation of the mechanical system(s) as arranged with the client's representative.' Contractor reserves right to schedule maintenance during hours other than normal working hours, with prior approval from customer. H.B. McClure Company extends a ninety-day warranty on labor for both routine maintenance and for service repairs, unless quoted otherwise. Our main underlying policy is one of fairness to our customers, and this gUides our approach not only to warranty situations but also to all of our practices. H.B. McClure will not be liable for failure of any piece of equipment due to fire, flood, freezing, misuse, negligence, improper voltages or VOltage surges.
