COMPLAINT
1. Plaintiffs' Thomas S, Mitros, Tim Gruver and Oscar Koontz are adult individuals
residing in the Commonwealth of Pennsylvania,
2, Plaintiff s' are the owners of building located at II W, King Street, Shippensburg,
P A 17257 with a business office located at 115 East King Street, Shippensburg, P A 17257,
3, Defendant, Heather Stumbaugh, is an adult individual residing at 385 East Queen
Street Apartment 2, Chambersburg, PA 17201.
4, Plaintiffs jointly own rental premises located at 11 W, King Street, Apartment E,
Shippensburg, P A 17257,
5, On November 2, 1998, Defendant executed a lease agreement for the rental premises
located at 11 W, King Street, and moved into the premises shortly thereafter. See Lease Agreement
attached hereto as Exhibit A.
6, Under paragraph 10 of the Lease, Defendant agreed to accept responsibility for any
damage caused to the premises by her, her family or her guests: "Tenant is responsible for all
damage to the lease premises and injury to people caused by tenant, tenant's family or guests," See
Exhibit A.
7, Under paragraph 14 of the Lease, Defendant agreed to accept responsibility for the
lease premises: "Tenant is responsible for, and will take good care of, the leased premises and all of
the property in and around the leased premises, Tenant agrees to pay for any damage caused by
tenant, tenant's family and tenant's guests," See Exhibit A.
8, On May 14, 1999, while moving out of the premises, Defendant and/or her agent
caused a fire in the premises by bumping into a knob that started a stove burner, on top of which had
been placed various items of personalty,

9, The aggregate sum of fire damage to the premises is $4,640,00. See Estimate
attached hereto as Exhibit B,
10, Plaintiffs also suffered lost rents in the amount of $400,00,
11, Defendant has refused to reimburse Plaintiffs for the amount of expenditures made
by them to repair the premises to its pre-fire condition,
12, As a result of her refusal to reimburse Plaintiffs for their pecuniary losses, Defendant
has breached her Lease Agreement, specifically paragraphs 10 and 14, See Exhibit B,
WHEREFORE, Plaintiffs respectfully demand judgment in their favor and against Defendant
for the amount stated herein as a result of Defendant's breach,
