COMPLAINT
NOW comes the Plaintiff, U.S. FOOD SERVICE, INC., by and through its
ttorney, ROBERT J. MURPHY, ESQUIRE, and complains of the Defendants,
OSTA'SFINE CUISINE, t/a KOSTA'S and FROSO I. TOULOUMES, individually,
intly or severally, as follows:
1. The Plaintiff is Bevaco FoodService, Inc., Pittston Division, a corporation
uly authorized to do business in the Commonwealth of Pennsylvania, with its
rincipal place of business at 13 Rutledge Drive, P.O. Box 767, Pittston, Luzerne
ounty, Pennsylvania,
2. The Defendant is FROSO I. TOULOUMES, an adult individual doing
usiness at 451 North 21st Street, Camp Hill, Cumberland County, Pennsylvania,
nd residing at 328 West Old York Road, Carlisle, Cumberland County,
ennsylvania.
3. The Defendant is KOSTA'S FINE CUISINE t/a KOSTA'S, a company duly
uthorized to conduct business in the Commonwealth of Pennsylvania, with a
rincipal place of business located at 451 North 21st Street, Camp Hill, Cumberland
ounty, Pennsylvania.

4. At all times relevant hereto, the Defendants, individually, jointly or
everally, were customers of the Plaintiff and purchased food products or food
ervices from the Plaintiff on credit.
5. At all times relevant hereto, the Plaintiff was in the business of furnishing
o its customers food products and food services on credit, with the express or
mplied understanding that the customer would pay for all products upon receipt.
6. The Defendants, individually, jointly or severally, entered into an
greement wherein they agreed to pay all sums due as result of the sale of
roducts to them on credit, as evidenced by the contact attached hereto and
! ncorporated as Exhibit "27".
7. From the period beginning December 3, 1998, and continuing through
arch 3, 2000, the Defendants, individually, jointly or severally, ordered and
.eceived from the Plaintiff the food products andlor services itemized on the
nvoices attached hereto and made a part hereof as Exhibits "1" through "26": Said
nvoices total the sum of twenty-one thousand, five hundred and forty-seven
$21,547.17) dollars and seventeen cents,
8. As of the date of this Complaint, the Defendants, individually, jointly or
. everally, have made payments toward the above outstanding amount in the
mount of two thousand, two hundred ($2,200.00) dollars, bringing Defendants'
alance to Nineteen Thousand Three Hundred Forty-Seven ($19,347.17) Dollars
nd Seventeen Cents, and have continued to refuse to bring this account current.
9. The Defendants, individually, jointly or severally, owe the Plaintiff the
um of Nineteen Thousand Three Hundred Forty-Seven ($19,347.17) Dollars and
eventeen Cents, the amount which Plaintiff has demanded and continues to
emand.
COUNT I
Breach of Contract
10. Plaintiff incorporates herein by reference Paragraphs 1 through 9
inclusive.
11. The Defendants, individually, jointly or severally, have an agreement
nd obligation to pay for the products received, as a result of an express contract
ith the Plaintiff, a copy of which is attached hereto and incorporated herein as
xhibit "27".

12. The Defendants, individually, jointly or severally, have materially
reached their obligation with the Plaintiff, and have refused to pay the above
mount which is due and owing pursuant to the express agreement between the
arties set forth in the attached Exhibit "27".
13. As a result of the breach of contract by Defendants, individually, jointly
r severally, the Plaintiff has incurred damages in lost income in the amount of
ineteen Thousand Three Hundred Forty-Seven ($19,347.17) Dollars and
eventeen Cents, plus attorney's fees and costs.
WHEREFORE, the Plaintiff requests this Honorable Court to enter Judgment
n its favor and against the Defendants, individually, jointly or severally, in an
mount less than Thirty Thousand ($30,000.00) Dollars.
COUNT II
Breach of Implied Contract
14. Plaintiff incorporates herein by reference Paragraphs 1 through 13
nclusive.
15. The Defendants, individually, jointly or severally, had an implied
ontract in which they received products on credit with the understanding that they
ould pay the full amount due and owing to Plaintiff on the date set forth in each
nvoice set forth in Exhibits "1" through "26".
16. The Defendants, individually, jointly or severally, breached their implied
ontract with the Plaintiff in that they accepted and used products pursuant to said
mplied contract, but refused to pay the amount owed for those products itemized
n the invoices which accompanied each shipment.
17. As a result of Defendants' breach of implied contract, the Plaintiff
uffered damages in lost income in the amount of Nineteen Thousand Three
undred Forty-Seven ($19,347.17) Dollars and Seventeen Cents ($19,347.17), plus
ttorney's fees and costs.

WHEREFORE, the Plaintiff requests this Honorable Court to enter Judgment
n its favor and against the Defendants, individually, jointly or severally, in an
mount less than Thirty Thousand ($30,000.00) Dollars.
COUNT III
Quantum Meruit
18, Plaintiff incorporates herein by reference Paragraphs 1 through 17
nclusive.
19. The Defendants, individually, jointly or severally, were unjustly enriched
y the Plaintiff in that they received products from the Plaintiff as indicated by the
nvoices attached as Exhibits "1" through "26", and have refused to pay the fair
arket value for said products.
20. The Defendants accepted each shipment of products from the Plaintiff
nowing that Plaintiff demanded payment for said products, and received in writing
y way of invoices, Plaintiff's intentions to seek the fair market value for said
roducts.
21. The Plaintiff would be severely prejudiced if it was not given fair
ompensation for said products delivered to Defendants, the same being the fair
arket value as charged on the invoices attached as Exhibits "1" through "26".
22. It would be inequitable to allow the Defendants, individually, jointly or
everally, to receive value in the form of products without being required to fairly
ompensate the Plaintiff for the value of the products received by Defendants.
WHEREFORE, the Plaintiff, BEVACO FOODSERVICE, INC. a Division of U.S.
oOdService, Inc., , hereby requests this Honorable Court to enter Judgment in its
avor and against the Defendants, KOSTA'S FINE CUISINE t/a KOSTA'S, and
