hereinafter referred to as Contractor,

FRANK H. KELLY and KAREN L. KELLY, hereinafter referred to as Ownerl whereby the former
undertook and agreed to renovation and improvements to 402 Bridge Streetl New Cumberland,
Pennsylvania, more fully described on the attached Exhibit A.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and
in consideration of the sum of ($~.OO) Dollar to it in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under theml covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwisel for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against. the said buildings or any of them, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.

LEGAL DESCRIPTION

ALL THAT CERTAIN piece of parcel of land situate in the Borough
of New Cumberland, County of Cumberland and State of
Pennsylvania, bounded and described as follows:
BEGINNING at the Northwest corner of Fourth and Bridge Streets;
THENCE Westwardly along Fourth Street, one hundred seventy-five
(175) feet to Locust Alley;
THENCE Northwardly along Locust Alley one hundred fifty (150)
feet to Lot No. 199;
THENCE Eastwardly along the Southern line of Lot No. 199, one
hundred seventy-five (175) feet to the West side of Bridge
Street;
THENCE Southwardly along the West Side of Bridge Street, one
hundred fifty (150) feet to the North side of Fourth Street, the
place of BEGINNING.
BEING Lots Nos. 196, 197 and 198 in the Borough of New
Cumberland, together wi th their appurtenances.
BEING THE SAME ~~~MISES Which Rea & Derick, Inc., by their deed

the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, granted and conveyed unto Frank H. Kelly and Karen
