WHEREAS, NAE H. PARK and WON J. PARK of 4020 Lisburn Road, Mechancisburg,
Pennsylvania, is about to execute contemporaneously herewith, a contract, with CARLSON
CONSTRUCTION, INC. of 1085 Country Club Road, Camp Hill, Pennsylvania, for the erection of a
building upon premises commonly known as LOT II RIVER BEND, Township ENOLA, CUMBERLAND
County, Pennsylvania, as set fortb in the deed datedt:"'eh~ q , ace:.} , recorded at Deed Book
, Page , in the Recorder's Office for CUMBE AND County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, , at the time of and inunediately before the execution of the principal contract, and before
any authority has been given by the said Owner to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with
Contractor and the furtber consideration of One Dollar ($LOO), to Contractor paid by Owner, it is agreed
that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or
materials purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN piece, parcel or lot of lands situate in East
Pennsboro Township, Cumberland County, Pennsylvania; designated as Unit No. 11 on
the Preliminary/Final Subdivision Plan by Rettew Associates, for River Bend, A Planned
community dated November 15, 1996,Iast amended January 7,1999 and recorded in
the Office of the Recorder of Deeds in and for Cumberland County on February 24,
1999, In Plan Book 78, Page 75, and being designated as Unit No. 11 in a Declaration
of River Bend, A Planned Community, dated October 9,1998 and recorded in the
Office of the Recorder of Deeds in and for Cumberland County, in Miscellaneous Book
591, Page 477, being further bounded and described as follows, to wit:
BEGINNING at a point on the Northern line of a 40 foot wide access easement
for a private road at a corner of Lot No.1 0; thence by said Lot the following two (2)
courses and distances: (1) North 34 degrees 20 minutes 10 seconds West, a distance
of 134.25 feet to a point; (2) South 75 degrees 26 minutes 57 seconds West, a distance
of 474.29 feet to a point on line of lands now or formerly of Lehr; thence by said lands,
the foHowing two (2) courses and distances: (1) North 29 degrees 16 minutes 32
seconds West, a distance of 566.72 feet to a rebar (found): (2) North 61 degrees 32
minutes 09 seconds East. a distance of 258.47 feet to a rebar (found) at a corner of Lot
No. 12; thence by said Lot South 46 degrees 18 minutes 45 seconds East, a distance
of 31.54 feet to a point on the Westerly line of a 40 foot wide access easement for a
private road; thence along said line the following five (5) courses and distances: (1) By
a line curving to the left and having a radius of 80.00 feet, an arc length of 226.16 feet
and a chord bearing of South 37 degrees 18 minutes 06 seconds East. a distance of
158.03 feet to a point; (2) by a line curving to the right and having a radius of 980.00
feet, an arc length of 435.54 feet and a chord bearing of North 74 degrees 26 minutes
28 seconds East, a distance of 431.97 feet to a point; (3) by a line curving to the left
and having a radius of 1,720.00 feet, an arc length of 442.69 feet and a chord bearing

by a line curving to the right and having a radius of 405.00 feet, an arc length of 149.27
