2. The undersigned has been retained as local counsel for
Defendant, Bagby Elevator Company, Inc. ("Bagby"), by Mark A.
Schneider, Esquire, Florida Bar No, 857696, of the Law Firm of
Herzfeld & Rubin, 80 S,W, Eighth Street, Suite 1920, Miami, FL
33130.
3, Bagby seeks the issuance of subpoenas by this Honorable
Court to compel the deposition of testimony of two crucial fact
witnesses,
4. Robert Bounora ("Mr, Bounora") is an adult individual
currently residing at 14 South 24th Street, Camp Hill, Cumberland
County, Pennsylvania 17011.
5, Frederick Hoch ("Mr. Hoch") is an adult individual
currently residing at 3005 Schoolhouse Road, Middletown, Dauphin
County, Pennsylvania,
6, Both Mr. Bounora and Mr. Hoch are former employees of
Inclinator Company of America,
7. Both Mr, Bounora and Mr, Hoch are crucial fact witnesses
in this matter.
8. The addresses for Mr, Bounora and Mr, Hoch were not
provided to Florida counsel until February 22, 2001.
9. The parties, including Bagby, face a discovery deadline
in the Florida action of March 9, 2001,
10. It is imperative to the defense of Bagby that the
depositions of Mr, Bounora and Mr. Hoch be completed,

11, The testimony of Mr, Bounora and Mr, Hoch cannot be
compelled without the assistance of this Honorable Court in
issuing subpoenas to compel their attendance.
12. A copy of the proposed subpoena to be issued upon
Mr, Bounora and Mr, Hoch are attached hereto, incorporated herein
by reference and marked as Exhibits "A" and "B," respectively.
13. The deposition of Mr, Bounora and Mr, Hoch have been
scheduled in conjunction with the depositions of other fact
witnesses to be taken on the same day, March 8, 2001, at the
offices of Inclinator Company of America, 22 Paxton Street,
Harrisburg, Pennsylvania,
WHEREFORE, Defendant, Bagby Elevator Company, Inc" through
local counsel, prays this Honorable Court issue an Order
directing the Prothonotary of Cumberland County to issue
subpoenas upon Robert Bounora and Frederick Hoch to appear at
deposition on March 8, 2001.
