is about to execute a contracht with JIM MILLER CUSTOM BUILDER,

INC., of Dillsburg, York countt, Pennsylvania, the Contractor, for
the construction of a dwelling house, and related structures or
improvements, upon that cert~in land situate in Silver Spring

Township, Cumberland County" Pennsylvania, more particularly

bounded and described as set :florth in Exhibit "A" attached hereto
and made a part hereof.
NOW, this

immediately before the executton of the said principal contract,
and before any authority has ~een given by the said Owner to the

said Contractor to commence fork on, or to furnish or purchase
materials for the aforesair buildings or construction, in
consideration of the making of said contract with said Contractor

and the further consideration ~f One Dollar to said Contractor paid
by said Owner, it is agreed t~at no liens or claims shall be filed

or made against said buildin~s and/or land, or any part, piece,
parcel or lot thereof, by sai~ Contractor, or any sub-contractor,

or by any materialmen, workme* or other persons for or on account

of any labor provided or materials furnished or purchased, or any
, extra labor or materials provided, furnished or purchased for said
buildings or construction, hereby expressly waiving any and all
rights to file or make such liens and claims,
AND, in furtherance hereof, the said Contractor does hereby
represent and warrant that as of the time of the execution hereof,
neither said Contractor, nor any sub-contractors, materialmen,
workmen or any other persons have commenced any work on, or
furnished or purchased any materials for the aforesaid buildings or
construction.
IN WITNESS WHEREOF, the said Owner and Contractor, each
intending to be legally bound hereby, have duly executed this
Stipulation on the aforesaid day, month and year.

EXHIBIT "A"
ALL THAT CERTAIN tract or parcel of land being situated in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows,
to wit;
BEGINNING AT A POINT on the Northeastern right-of-way line of Stone Run Drive, a 50
foot wide right-of-way, said point being the Southeastern corner of Lot #21; thence along
the Southeastern line of said lot North 35 degrees 00 minutes 00 seconds East a distance
of 150.00 feet to a point, on the line of land now or late of M. John and Lloyd J. Edris;
thence along the line of land now or late of M, John and Lloyd J. Edris South 55 degrees
00 minutes 00 seconds East a distance of 48.31 feet to a point; thence along the same
South 66 degrees 30 minutes 00 seconds East a distance of 42.54 feet to a point, said
point being the Northwest corner of Lot #23; thence along the Northwestern line of said
lot South 35 degrees 00 minutes 00 seconds West a distance of 158.48 feet to a point on
the Northeastern right-of-way line of Stone Run Drive; thence along said right-of-way
line North 55 degrees 00 minutes 00 seconds West a distance of 90.00 feet to a point, the
PLACE OF BEGINNING.
BEING Lot #22 of a plan of lots known as "Walnut Point, Phase I", and containing
13,676.78 square feet or 0.3140 acres. Said plan being recorded in Cumberland County
